In accordance with P.L. 109-461, this acquisition is 100% set aside for Service Disabled Veteran Owned Small Business concerns. Offerors must be both VISIBLE and VERIFIED by the Department of Veterans Affairs Center for Verification and Evaluation at the time of submission of proposal. Failure to be both Verified by CVE and Visible on Vetbiz at the time of proposal submission will result in the offeror's proposal being deemed non-compliant

SCOPE OF WORK

GENERAL:

Jack C. Montgomery Veterans Affairs Medical Center (JCMVAMC) requires contract for painting. Services are to ensure cost effectiveness and service efficiency and in support of the VA Mission. All contract services will be performed at the following location(s) and during the periods of performance. Contract painting is required so the medical center can keep up with the constant need for repairs. This will help maintain an ascetic appeal to all veterans and visitors that visit the facility.

1. SCOPE OF WORK : Provide materials, supply and labor to conduct a interior paint refresh and dry wall repair as indicated in drawings. Surfaces to be painted are hallways as outlined in drawings 2-4, and approximately 20 patient rooms as indicated in drawing 1. There is a mural located in one of the hallways that must be carefully preserved and not damaged.

Contractor will clean up any drips, spills, overpainting, etc., and remove all of contractor materials and debris from the facility premises. Prepare the Medical Center premises, located at 1011 Honor Heights Drive for painting. Facility desires to match the existing color of paint and sheen on each surface, semi-gloss, egg shell, satin, etc. As such, all paint will be supplied by the VA facility to insure proper color and sheen. All rollers, brushes and pans and painting materials, including necessary scaffolding and coverings such as tarps, plastic and drop cloths will be supplied by the contractor.

All scuffs, gouges, and holes in the walls will be repaired and sanded flush before painting will commence. The work for this project will entail floor to ceiling coverage, when possible. There are areas that have higher ceilings that may require the use of scaffolding. Proper safety precautions will need to be followed when patients are in these areas. Scaffolding will be supplied by the contractor that is awarded this contract. Cubicles will remain in their existing positions, and the contractor will paint behind the cubicles, if accessible. All surfaces will be prepared using proper fill mud, and primers to insure a quality finish. Where texture is required, it must match what is currently on the surrounding walls. All window and doors will be properly trimmed and finished so product will appear professional and consistent. Fixtures not needed to be moved that are considered permanent and fastened are case work in open call center areas, restroom sinks and fixtures, and water fountains. All small appliances will be removed, pulled out, to be painted around and behind to include refrigerators. All removable signage that will not cause any damage to the walls will need to be removed and replaced in the same position and location as original. Permanent fixtures that do not need to be removed are permanently fastened bulletin boards and cabinetry.

All materials are guaranteed to be as specified and all work shall be performed in accordance with the specifications above.

All work areas are to be cleaned on a daily basis and no construction materials can be left in the facility where patients and employees are interrupted on their travels through the medical facility.

4. PERIOD OF PERFORMANCE: All work will be completed within 30 calendar days after NTP. Work will primarily be done after the hours of 4 PM when patient traffic is reduced. There will be times when work during the facility working hours of 7:30 am-4:00 pm will be allowed, upon coordination with the COR.

5. INSTALLATION/REQUIREMENTS: The contractor will be responsible for any work crew that is on sight to perform painting duties. All contractors are responsible for getting proper parking licenses and passes. Contractor will follow contract guidelines that are outline in the scope of work. Any damages caused by contractor or any of their personal will be the responsibility of the contractor. All contracting employees will wear some type of ID that indicates they are a contractor or sub-contractor performing the painting requirements.

Attached floor drawings to be used to demonstrate SQF. This is a guide to show the approximate footage of patient rooms on the wards. Drawing 2 shows the area with the highest ceiling. This is the area scaffolding may be required.

PART I - INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

PART I/SECTION A – REQUEST FOR QUOTE

This is a Request for Quote in accordance with FAR Part 13. Potential offerors must follow all instructions in order to be compliant with the solicitation.

It is the responsibility of the offeror to verify that their offer is complete. The offeror is responsible for submitting all required forms and documents with the offer.

The Government will award a single contract resulting from this solicitation to a responsible SDVOSB offeror whose offer conforming to the solicitation will be most advantageous to the Government based on Past Performance and Price.

I.1A JOINT VENTURES

If submitting an offer as a joint venture as defined by P.L. 109-461 AND Department of Veterans Affairs I.L. 049-06-4, http://www.vetbiz.gov/library/jtventure.pdf , an offeror must provide a copy of the joint venture agreement specific to the project that is consistent with the percentage of required work and net proceed. Additionally, the offeror must provide a breakdown or labor of which is to be performed by the SDVOSB firm and that which is performed by the small business joint venture firm and that which is sub-contracted. All Joint Ventures will be required to be registered and verified as an entity in VETBIZ.

I.3A PRE-QUOTE SITE VISIT

A site visit will be held May 2, 2018 at 10:00 A.M. CDT at the Jack C. Montgomery VAMC, located at 1101 Honor Heights Dr., Muskogee, OK 74401. All participants will meet at building 11. Please refer to attached parking diagram and Station map for location information. All offerors, consultants, subcontractors, manufacturers and suppliers are encouraged to attend this meeting to familiarize themselves with the project, project site, and to provide any questions in regards to this solicitation and project, in writing, prior to the scheduled conference date. No questions shall be accepted or answered at the Site Visit. All questions generated from this visit must be submitted in writing to Robyn Young at robyn.young2@va.gov. See FAR Clause 52.236-3, Site Investigation and Conditions Affecting the Work, and FAR Provision 52.236-27, Site Visit (Construction) of this solicitation.

I.4A SELECTION CRITERIA/QUOTE PREPARATION INSTRUCTIONS

Quotes will be evaluated in accordance with FAR 13.106 Simplified Acquisition Procedures Award will be made based on the following factors:

Factor 1 – Past Performance Factor 2 – Price The Government reserves the right to award without discussions. Therefore offerors are encouraged to provide their best Quotes with the past performance information requested for evaluation. The Government, based on the Quote material presented, will award to the Quote that best demonstrates to be most advantageous for the Government.

Factor 1 - Past Performance: Past performance information will be evaluated in accordance with FAR 15.305(a)(2). In assessing past performance the Government may employ several approaches including: (a) reviewing past performance data submitted (b) seeking additional present and past performance and (c) using data independently obtained from other Government and commercial sources (e.g., the Past Performance Information Retrieval System (PPIRS)).

Offerors shall provide past performance information on two (2) federal, state, local government or private contract of similar type, scope, size and complexity. For purposes of this evaluation, a relevant project is further defined an interior painting project at an active commercial facility. Project shall have a minimum amount of $20,000 or more and completed within the past three years from the date of issuance of this RFQ.

Basis of Evaluation: In order to be considered acceptable for this factor the offeror must have received satisfactory or better evaluations on a minimum of one (1) recent and relevant project.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. If that offeror is otherwise acceptable for non-price factors and has the lowest price the matter will be referred to the Small Business Administration for a Certificate of Competency, in accordance with the procedures contained in FAR Subpart 19.6, and 15 U.S.C. 637(b)(7).

Factor 2 - Price: Offerors shall provide pricing as requested in the Schedule of Service identified within the SF1442 Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

•Comparison of proposed prices received in response to the RFQ
•Comparison of proposed prices with the IGCE.

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

PART I/SECTION B - INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

I.1B COST RANGE: Between $25,000 and $100,000 I.2B GENDER: Wherever the masculine gender is used in this solicitation and contract documents, it shall be considered to include both masculine and feminine.

I.3B METRIC PRODUCTS:

Products manufactured to metric dimensions will be considered on an equal basis with those manufactured using inch-pound units, providing they fall within the tolerance specified using conversion tables contained in the latest revision of Federal Standard No. 376, and all other requirements of this document are met.

If a product is manufactured to metric dimensions and those dimensions exceed the tolerance specified in the inch-pound units, a request should be made to the Contracting Officer to determine if the product is acceptable. The Contracting Officer, in concert with the Contracting Officer’s Representative (COR), will accept or reject the product.

I.4B REQUESTS FOR INFORMATION:

The Contract Specialist (CS) and Contracting Officer (CO) are the only points of contact for this acquisition. Offerors shall address any questions to the CS/CO via email address or telephone number shown on the SF1442. Questions will be accepted through ten (10) calendar days prior to closing date. Questions will not be answered to individual requester but will be posted to FedBizzOpps.

I.5B QUOTE REQUIREMENTS

General – Both Past Performance and Price Quote shall be submitted in response to this solicitation. Quotes shall be submitted via email to Robyn.Young2@va.gov. Emails are limited to five (5) MB. The Quote, in its entirety, shall not exceed two emails (one email for price Quote, and one email for technical Quote) of 5MB each. Price shall be in a separate electronic document from any technical and/or past performance portions of the Quote. The offeror’s technical response shall clearly address each evaluation factor listed in this solicitation. Failures to submit in the format required and clearly address those factors may result in rejection of the offer. Electronic copies of the Quotes will be time/date stamped by Microsoft Outlook upon receipt of email. Further details on electronic submission are outlined below. Offerors shall include all required Representations and Certifications and complete their registration in System for Award Management (SAM). See FAR 52.204-7 and 52.204-8, of this solicitation.

Quotes shall be received by 3:00 PM Central Standard Time on May 18, 2018. There will be no public opening of the Quotes. Submit Quotes to: Robyn.Young2@va.gov.

Important Notice: Apparent successful offerors must apply for and receive verification from the Department of Veterans Affairs Center for Verification and Evaluation (CVE) in accordance with 38 CFR Part 74 and VAAR 819.70 by submission of documentation of Veteran status, ownership and control sufficient to establish appropriate status, offerors must be both VISIBLE and VERIFIED by the Department of Veteran Affairs Center for Verification and Evaluation at the time of contract award. Failure to be both VERIFIED by CVE and VISIBLE on VetBiz at the time of contract award will result in the offeror’s Quote being deemed non-responsive. All offerors are urged to contact the CVE and submit the aforementioned required documents to obtain CVE verification of their SDVOSB status if they have not already done so.

I.6B REQUIREMENTS FOR ELECTRONIC SUBMISSION OF OFFER

Unless paper offers are specifically authorized in an individual solicitation, all responses to solicitations must be submitted electronically as described below. Responses submitted in a paper form are unacceptable. Failure to comply with this requirement may jeopardize the possibility of receiving an award for the contract due to noncompliance with the terms of the solicitation. You must submit your electronic offer, and any supplemental information (such as spreadsheets, backup data, technical information), using any of the electronic formats and media described below.

In addition, contractors are notified of the award via an electronic Notice of Award e-mail. The award document will be attached to the Notice of Award e-mail.

Acceptable Electronic Formats (Software) for Submission of Offers

1. Files readable using the current Microsoft© Office version Products: Word, Excel, PowerPoint, or Access. Print or scan images of spreadsheets are not acceptable. Please see security note below for caution regarding use of macros. When submitting construction drawings contractors are required to submit one set in AutoCAD and one set in Adobe PDF. (purpose: contracting can open the PDF version and engineering can open AutoCAD files)

E-mail Submission Procedures: For simplicity in this guidance, all submissions in response to a solicitation will be referred to as offers.

a. Subject Line: Include the solicitation number, name of company, and closing date of solicitation. Use only one of the terms Quotation, Offer, or Bid depending on the solicitation type.

b. Size: Maximum size of the e-mail message shall not exceed five (5) megabytes. Only one email is permitted unless otherwise stated in this solicitation or in writing by the Contract Officer submitting the solicitation.

c. Unless approved by the contracting officer: DO NOT submit a link to your PDF documents. Please submit your request in an email for other electronic format at least ten (10) calendar days before the scheduled closing date of the solicitation. Security Issues, Late Bids, Unreadable Offers

1. Late submission of offers are outlined at FAR 52.215-1(c)(3). Particular attention is warranted to the portion of the provision that relates to the timing of submission.

1. Please see FAR 15.207(c) for a description of the steps the Government shall take with regard to unreadable offers.

1. To avoid rejection of an offer, vendors must make every effort to ensure their electronic submission is virus-free. Submissions or portions thereof submitted and which the automatic system detects the presence of a virus or which are otherwise unreadable will be treated as “unreadable” pursuant to FAR 15.207(c).

1. The virus scanning software used by our e-mail systems cannot always distinguish a macro from a virus. Therefore, sending a macro embedded in an e-mail message or an e-mail attachment may cause the e-mail offer to be quarantined. You may send both the spreadsheet and the spreadsheet saved in PDF format to ensure that your Quote is readable.

Password protecting your offer is not permitted. The Contracting Officer will file the offer electronically which will allow access only by designated individuals.

2.1 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.2 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Muskogee, OK

2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

2.4 52.236-27 SITE VISIT (CONSTRUCTION) (FEB 1995) ALTERNATE I (FEB 1995)

4.2 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 days after Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

4.3 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JUL 2013)

(a) Definitions. As used in this clause— Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts—

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.

(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
