About this file

This is an amendment to solicitation 36C25725Q0275 providing answers to vendor questions about a courier service contract between VA clinics in Tyler, TX and the Dallas VA Hospital. The incumbent is FCX LLC under contract 36C25720C0116 ($169,428.15 from 7/1/2020 to 6/30/2025).

The amendment clarifies that this is a firm-fixed price SDVOSB set-aside requiring one round trip per day (522 trips/year plus 1 estimated unscheduled trip) between Tyler and Dallas starting 7/1/2025. Key details include: monthly invoicing in arrears, signature required upon delivery, no loading dock access needed, transported items include a 50-gallon cooler with 3-5 sterile instrument trays (10"x12"), mail and supplies. The vendor provides the cooler while VA provides containers. Technical, past performance and price factors are weighted equally in evaluation. Training certifications/proof of insurance can be provided within one week of award rather than with proposal submission. Proposals are due 3/14/2025 at 3:00 PM ET, with a 10MB file size limit. If no qualified SDVOSB proposals are received, a new solicitation would be issued as a small business set-aside.

Vendor Questions

Vendor A

1. Is this a new contract, or is there an incumbent currently performing these services?

a. If there is an incumbent, could you please provide the incumbent’s name and the previous award

ID?

i. The incumbent is FCX LLC. The previous contract was 36C25720C0116.

2. If no SDVOSB businesses submit a bid, would this contract be reissued as a Total Small Business Set-

Aside or an unrestricted procurement?

a. We would like to know if a non-SDVOSB small business may be considered if no qualifying

SDVOSB proposals are received?

i. A new solicitation would need to be issued as a small business set-aside for vendors that are not SDVOSBs to be considered.

3. Could you clarify the process for handling unscheduled courier trips?

a. The solicitation mentions an estimated one unscheduled trip per year; would additional trips be negotiated separately, or should we include a contingency in our pricing?

i. The number of unscheduled trips per year is estimated. Pricing should be provided for the unscheduled trips as part of the response to the solicitation, per the Addendum to

Instructions to Offerors in RFQ 36C25725Q0275, page 28.

Vendor B

1. Pricing & Billing

a. Is there a preferred pricing format or breakdown the government would like to see in our proposal?

i. Pricing is to be based on per trip. One billable trip is one round trip from Tyler to Dallas.

b. Will the contract be firm-fixed price, time, and materials, or cost-reimbursable?

i. This will be a firm fixed price type contract.

c. How will billing and payment processing be handled, and what is the expected payment schedule?

i. Invoicing is to be submitted monthly in arrears.

2. Additional Considerations

a. Are subcontractors allowed for this contract, and are there any limitations on their use?

i. Yes. See VAAR 852.219-75 in Section C.

b. Will there be any requirements for reporting or tracking deliveries (e.g., GPS tracking, signature upon delivery)?

i. Signature upon delivery

c. Will the VA provide access to loading docks or reserved parking spaces at the pickup and drop-off locations?

i. Loading dock access is not needed.

d. Will there be a pre-bid conference or site visit to better understand the operational requirements?

i. No. There will be no site visit or pre-bid conference.

e. What are the key evaluation factors that will weigh most heavily in the award decision (e.g., price, past performance, technical approach)?

i. All evaluation factors are equal.

f. What is the expected contract start date and transition period, if applicable?

i. Per the attachment “RFQ 36C25725Q0275,” pages 1 (Block 20), page 4 (Statement of

Work, Period of Performance), and pages 12-13 (Price/Cost Schedule), the anticipated start date will be 7/1/2025.

g. Are there any additional security clearances or certifications required for personnel handling these materials?

i. Please see page 7-8, “Training,” in the RFQ for lists of trainings/certifications that are required. There are no security clearances required.

Vendor C

1. I would like to inquire if an existing contract exists. I’d also like the vendor’s name, period of performance, original award amount, and previous solicitation or contract number?

a. Yes. The current contract is 36C25720C0116, awarded to FCX, LLC, for $169,428.15. The period performance is 7/1/2020 to 6/30/2025.

Vendor D:

1. Is this new work or is there an incumbent contractor? If there is an incumbent, who are they and what is the contract number?

a. The services have been performed under 36C25720C0116 by FCX, LLC.

2. Evaluations will be conducted through a comparative analysis in accordance with FAR 13.106-2(b)(3) to determine the best value to the Government. Will the Government please advise if Technical is most important then Past Performance and Price least important or how the Government will determine the

Best Value.

a. Weighted evaluation factors are not used.

3. The requirement for the past performance appears to be unrealistic and restrictive. In most instances with commercial and Federal Government contracts, the Courier as described in the Statement of Work is part of a larger contract. Restricting the Past Performance to 2 Federal Government contracts and 1

Commercial Contract does not seem reasonable. Recommend the requirement be 3 Past Performance either Federal Government or Commercial. The work is what is important not the contracting agency, it is simply a transfer of knowledge and maintaining adherence to the contractual requirements. As written, this requirement severely restricts competition.

a. See attached for updated evaluation criteria.

4. The Government lists the evaluated areas as Technical, Past Performance and Price but does not tell how they are assessed. Is the Technical Acceptable/Unacceptable? Is Past Performance Based on Substantial

Confidence through No Confidence and Neutral Ratings allowable?

a. For Technical, vendors will be evaluated using comparative analysis to determine if they meet, do not meet, or exceed the criteria described at FAR 52.212-2(d)(A).

b. For Past Performance, FAR 52.212-2(d)(B) states “Past performance will be evaluated for a minimum “Satisfactory” performance using the three (3) references provided and a review of assessment reports in Contractor Performance Assessment Reporting System (CPARS).” If there is no past performance available (i.e., never performed services in the past), a vendor will not be determined to have less than a “Satisfactory” performance rating. See attached for updated evaluation criteria and Addendum to FAR 52.212-1.

c. For Price, FAR 52.212-2(d)(C)(2) states, “Price will be evaluated for reasonableness, completeness, and fairness by comparing the proposed prices for each ordering period with the

Independent Government Estimate and the prices posed by other offerors.”

5. Please confirm the Past Performances do not have any time limits to be considered as recent.

a. There are no time limits.

6. We did not see any page limits for our Technical or Past Performance responses. Is there a page limit to these responses and our submission?

a. There is not a page limit, but there is an aggregate document size limit of 10 megabytes, as stated in the Addendum to Instructions to Offerors.

7. The RFQ states offerors must Provide copies of Liability Insurance and Provide copies of all required training certificates. Since we are not the incumbent this places all other offerors at a distinct disadvantage. We have not procured vehicles for this specific opportunity nor hired a staff. Request the

Government remove this requirement for the submission and select a reasonable/date after contract award to present this documentation to the Government.

a. Evaluation criteria is changed to “Contractor shall affirm they can provide proof of all required training described in the Courier Responsibilities, HIPAA Compliance/Security Requirements and

Training sections of the SOW within one (1) week of contract award.”

b. See attached for updated evaluation criteria.

Vendor E

1. Does one (1) round-trip equate to picking up in Tyler, TX, dropping off in Dallas and picking up in Dallas and Dropping off in Tyler?

a. Yes.

Vendor F

1. What was the cost of the final full option year of the previous contract?

a. Per the Addendum to Instructions to Offerors, this question will not be answered.

2. How many drivers/vehicles are currently used to service the current contract?

a. Per the Addendum to Instructions to Offerors, this question will not be answered.

3. What is the vehicle size currently servicing this location?

a. Per the Addendum to Instructions to Offerors, this question will not be answered.

4. How many cubic feet of storage are required for transportation, and what is the maximum size and quantity of items to be transported daily?

a. The blood draw consist of a 50 gallon cooler, with 3-5 sterile instrument trays measuring

10”x12”, mail, and supplies. Clean items cant be in the same area as dirty instruments.

5. STATEMENT OF WORK: Goods Transported: Letter C indicates “The government will supply the instruments and containers to be transported and notify the courier when there are no items requiring transport.” However, Letters F and G both indicate the Vendor is to provide containers.

a. Vendor provides the cooler, and the VA provides the containers.
