c. The VA has mandated electronic invoice submission to the Veterans Affairs Financial Services Center (VAFSC). VAFSC has partnered with Tungsten Network e-Invoicing network, for submissions of all electronic invoices to VA. Tungsten Network electronic invoicing is free to all VA vendors. In order to submit electronic invoices, all VA vendors must register with Tungsten Network by submitting an email to VA.Registration@Tungsten-Network.com or calling 1-877-752-0900 option 2 for Enrollment.

d. Contractor shall submit an electronic invoice by the tenth (10th) of the following month services were performed to the Veterans Affairs Financial Services Center (VAFSC) e-Invoice through the website at https://portal.Tungsten-Network.com/Login.aspx. For questions regarding the submission of VA electronic invoices, Tungsten Network customer service may be contacted at 1-877-489-6135.

e. All invoices shall reference the vendor name and address, customer name, contract number, appropriate obligation/funding order number, description of services provided, quantity, unit price, and total invoice amount (any additional info). Invoices shall also include any payment discount terms.

4. GOVERNMENT INVOICE ADDRESS (See SF1449 Block 18):

a. All invoices from the contractor shall be submitted electronically in accordance with 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

b. Facsimile, e-mail, and scanned documents are not acceptable forms of submission for payment requests.

c. VA’s Electronic Invoice Presentment and Payment System – The Veterans Affairs Financial Services Center (VAFSC) uses a third-party contractor, Tungsten Network e-Invoice, to transition vendors from paper to electronic invoice submission. Please go to this website: http://www.tungsten-network.com/customer-campaigns/veterans-affairs-us/ to begin submitting electronic invoices, free of charge.

d. As of July 1, 2020, the VA10091 form has been eliminated and the VAFSC is requiring our vendors to update and add their information in the Customer Engagement Portal (CEP) at https://www.cep.fsc.va.gov/. This is for new vendors being added to FMS only.

5. ACQUISITION OF COMMERCIAL ITEMS: This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 13.5 Simplified Procedures for Certain Commercial Items in which simplified acquisition procedures in FAR Part 13 will be used. FAR Part 14 and 15 will not be used. From this RFQ, the Government intends to award a firm-fixed price contract where the contractor provides a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.

6. RFQ QUESTIONS: In order to maintain integrity of this solicitation and subsequent award date, all offerors are advised that any question and answer requests must be submitted in a written form via e-mail to the Contracting Officer susan.pasholk@va.gov no later than TUESDAY APRIL 27, 2021 AT 9:00 AM LOCAL TIME. Contracting will issue a consolidated response via solicitation amendment to https://beta.sam.gov Contract Opportunities within 2 business days to all parties

7. CONTRACTING OFFICER AUTHORITY:

The Contracting Officer (CO) is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity, or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

8. SITE VISIT: It is strongly suggested and expected that the offeror inspect the campus to be serviced to fully understand the nature of the work and the conditions under which the work is to be performed. In no case shall failure to inspect the campus constitute grounds for a claim after contract award.

SITE VISIT IS SCHEDULED FOR MONDAY APRIL 26, 2021 AT 9:30 AM LOCAL TIME. OFFERORS SHALL MEET COR ADAM KREGER (414-384-2000 X44773) AT GRAPHICS CENTER BUILDING 113.

PLEASE NOTE: WHILE ON CAMPUS, ALL PERSONS WILL BE REQUIRED TO WEAR MASKS INSIDE ANY VAMC BUILDING AND WHILE TRAVELING IN VEHICLES FOR PURPOSES OF THE SITE VISIT.

9. PARKING, SMOKING AND VA REGULATIONS:

a. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

b. All VA facilities are drug free.

c. All contractor personnel are required to adhere to all VA rules and regulations.

d. Smoking is prohibited on the entire campus, both inside and outside the VA Facility

e. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

f. VHA DIRECTIVE 1192: This Veterans Health Administration (VHA) directive establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities through the vaccination or masking of health care personnel (HCP). AUTHORITY: Title 38 United States Code (U.S.C.) 7301(b), 7318(b). Contractor is responsible for providing face masks and influenza vaccines for all employees working at a VA facility. If Directive 1192 is applicable the Contractor, in conjunction with the Contracting Officer Representative (COR), is responsible in ensuring that all aspects of this directive are implemented.

10. SECURITY & PRIVACY CONTROL:

The Authorization & Accreditation (A&A) requirements of VHA Handbook 6500.6 do not apply to this requirement, therefore, a Security Accreditation Package is not required. No A&A or MOU/ISA is required. Sensitive information exposure as part of this contract involves applicable security controls within the facility as part of the VA Information Security If there are any questions related to privacy, please have a member of your staff contact the VA Privacy Service at (202) 461-6309. Visitor Passes:

Issuance of visitor passes is the responsibility and at the discretion of each Facility Director. Visitor passes may be issued to individuals requiring short-term access to a VA (Veterans Affairs) facility for a period not to exceed 15 days in a 365-day period. Visitor passes are issued on a daily basis and expire at the end of the day of issuance. Visitor passes are issued following, at a minimum, review of one valid and current State or Federal government issued photo ID. Visitors must be escorted in areas restricted to the general public.

Facility Check In/Out Requirements:

The Contractor shall be required to report to The Graphics Center, Bldg. 113 to sign-in in the Logbook. This check-in is mandatory. The (Field Service Engineer) FSE shall be required to log-out at Graphics Center.

SCOPE OF WORK/SPECIFICATIONS

The Contractor shall provide all labor, supervision, materials, tools, and equipment necessary to witness/perform the required inspections to the vertical transportation system located on the campus at the Clement J. Zablocki VA Medical Center, Milwaukee, WI in accordance with the Statement of Work.

1.0 SCOPE OF WORK

It is the responsibility of the inspector to determine if the equipment is in safe operating condition, that it has not been altered except in conformity to the applicable codes or regulations, and that each elevator (vertical transportation system) will perform in accordance with all applicable inspection requirements. In the performance of this contract, the contractor shall take such safety precautions to protect the lives and health of occupants of the building.

The Inspector shall witness/perform the following tests/inspections:

· Perform Annual vertical transport inspection.

· Perform Semi-Annual Inspections.

· Witness annual no-load safety test (traction) of the car, counterweight safeties, governors, and buffers in accordance with ANSI (American National Standards Institute) A.17 Safety Codes and local regulations.

· Witness annual no-load safety test (hydraulic) and cylinder leakage test (hydraulic) in accordance with ANSI A.17 Safety Codes and local regulations. Inspector shall submit a copy of the test results to the COR.

· Witness Three Year Load Test performed by Elevator Maintenance Contractor on elevators required, per the schedule of elevators. Testing to take place within the month of November in the Option Year 1 and Option Year 4 of the contract. The Maintenance Contractor shall perform load testing in accordance with ANSI safety codes and local regulations. Inspector shall submit a copy of the test results to the COR.

· Witness Five Year Load Test performed by Elevator Maintenance Contractor on elevators required, per the schedule of elevators. Testing to take place in the Base Year and Option Year 4 of the contract and shall be scheduled in advance with the COR. The Maintenance Contractor shall perform load testing in accordance with ANSI safety codes and local regulations. Inspector shall submit a copy of the test results to the COR.

All contractor performed inspections shall be subject to re-inspection, examination, and testing by government inspectors or their representatives at any time during the course of work. The COR shall have the right to reject defective inspections or reports. Rejected inspections or reports shall be satisfactorily corrected and or replaced without additional expense to the VA. The Inspector is required to furnish tools and labor to witness load tests. Elevator Maintenance Contractor shall provide elevator technician, and test weights as required for all load tests and inspections. VA elevator mechanic shall accompany inspector on all inspections. Inspections shall be conducted in accordance with NFPA (National Fire Protection Agency)70, NFPA (National Fire Protection Agency) 70E, ASME (American Society of Mechanical Engineers) A17.1 and A17.2 latest additions.

1.1 Scheduling

Approved inspection due dates shall not be altered without the consent of the COR. Inspector shall coordinate all inspections with the COR. All inspections shall be coordinated a minimum of thirty days prior to inspection dates. Inspections that may severely affect elevator service (not more than two (2) cars down at a time for more than 24 hours), or incapacitate a bank of elevators, shall be performed after normal working hours, and approved in advance by the COR. All other inspections shall be accomplished during normal business hours (7:00 AM to 3:30 PM Monday through Friday except National Government Holidays).

1.2 Inspector Qualifications

Pursuant to ANSI/ASME A17.1 section 1000, ASME A17.2 ASME 17.3, inspection contractor shall provide proof of Qualification of Elevator Inspectors (QE-1) certification, a copy of inspectors QEI credentials shall be current and have no lapsed periods for a minimum of five years. All inspectors or inspector’s assistants shall be an ASME/NAESA (National Association of Elevator Safety Authorities) qualified elevator inspector with at least five years’ experience as a certified inspector. Inspector shall be made available within a two day period from notification for additional onsite consultation and to clarify questions that may arise as a result of inspections at the discretion of the COR at no additional charge. Inspector shall be available for phone, fax, or e-mail consultation during normal business hours.

2.0 EQUIPMENT TO BE COVERED UNDER THIS CONTRACT

The vertical transportation systems as listed below.

Additional non-constructed elevators put into service after new or remodeled building construction shall be included into inspection program upon COR request and by contract modification. New elevators shall be inspected per applicable codes and regulations in force at the time of elevator construction design.

3.0 GENERAL INFORMATION

3.1 Security Requirements

A Contractor’s photo ID badge is required for all Contractor personnel. VA ID badges will be provided by Police Service in accordance with the current policies and procedures established by them.

3.2 Hours of Operation

Normal hours of operation are Monday through Friday from 7:00 am to 3:30 pm Local/CST, excluding national holidays. The contractor may be asked to do some inspections after normal business hours at no additional cost.

Federal and National Holidays observed by the VAMC are:

New Year's Day Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day

Also included would be any other day specifically declared by the President of the United States to be a National Holiday.

When a holiday falls on a Sunday, the following Monday shall be observed as a legal holiday by U.S. Government agencies. When a holiday falls on a Saturday, the preceding Friday shall be observed as a legal holiday.

3.3 Documentation

A written Employee/Vendor Service Report (ESR) report shall be provided to the COR upon completion of each visit. The report shall include a detailed description of the elevators inspected. The ESR must, at a minimum, document the information listed below legibly and in complete detail. A written report is required upon completion of all work performed under this agreement. Failure to provide written reports could result in delay in payments. Reports must be submitted in a mutually agreed upon format.

d. Date, time (starting and ending), equipment downtime, and hours on-site

e. VA purchase order number (Using the incorrect number could delay processing of invoices)

f. Signatures of the FSE performing the inspection and the VA employee who witnessed the services described

g. A separate annual report, presented in binder format, must be submitted for each device inspected within thirty (30) days of completion of the inspection. The report shall state the location of inspection, the identifying device number, and the type of device, all ASME deficiencies, the reference section, and the number or letter designation of deficiencies, a heading, and space to indicate scheduled date of repair, actual date of repair and date of inspection. All recommended upgrades shall be listed and identified as recommended upgrades on the same document. ASME “Checklist for Inspection of Electric Elevators” (A134C1 Attachment (A)) and ASME “Checklist for Inspection of Hydraulic Elevators” (AO50C7 Attachment (B)) shall be completed for each device inspected, dependent on type of device inspected. A certificate of inspection for each device listing the building, device number, type of duty, city, capacity, speed, date of inspection, elevator mechanic and or elevator maintenance company, elevator inspector signature and inspectors qualified elevator inspector number, shall be included on the certificate. This certificate shall be included in the report package.

h. If during any inspection a safety issue is identified that may cause injury to occupants or staff, in or around the elevators, the Inspector is to immediately notify the Graphics Center and the COR.

Within thirty (30) days of completing the final portion of the inspections, the Contractor will submit a report with all the ASME checklists and a summary of findings to include suggested repairs, replacements, and any issues that are found. This report is to be provided electronically with an additional two (2) hard copies to the COR.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days prior to the contract expiration. The “specified” rates under this clause will be those rates in effect under the contract each time an option is exercised under this clause.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days prior to the contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 calendar days prior to contract expiration. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed FIVE (5) years.

(End of Clause) C.5 52.219-14 LIMITATIONS ON SUBCONTRATING (JUN 2020) (DEVIATION) (a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Definition. “Similarly situated entity,” as used in this clause, means a first-tier subcontractor, including an independent contractor, that—

(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and

(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.

(c) Applicability. This clause applies only to—

(1) Contracts that have been set aside for small business concerns or 8(a) participants;

(2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) participants;

(3) Contracts that have been awarded on a sole-source basis in accordance with subpart 19.8;

(4) Orders set aside for small business concerns under multiple-award contracts, as described in 8.405-5 and 16.505(b)(2)(i)(F), if the order amount is expected to exceed the simplified acquisition threshold;

(d) Independent contractors. An independent contractor shall be considered a subcontractor.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a NAICS code for—

(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract. Other direct costs are excluded to the extent they are not the principal purpose of the contract and cannot be obtained from small business concerns;

(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract;

(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 85 percent subcontract amount that cannot be exceeded; or

(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 75 percent subcontract amount that cannot be exceeded.

(f) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (e) of this clause will be performed by the aggregate of the joint venture participants.

(g) The Contractor shall comply with the limitations on subcontracting as follows:

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6.
