Description: Material Management Building
1. Contracting Activity: Department of Veterans Affairs, VISN 12 Network Contract
Office Southern Tier Construction Team for Jesse Brown VA Medical Center.

3. Description of Action: The action taken here is for a new Sole Source Construction
Services Firm Fixed Price type contract using the name brand equipment.

4. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
a. SIEMENS: The new space will be equipped with new Fire Alarm components that must interface with the existing Fire Alarm System and its programming. It must be capable of meeting the specifications of the existing Fire Alarm System.
5. Description of Services:
The total estimated value of the proposed actions is: $20,000.00
a. SIEMENS: The Project consists of constructing a new 1st Floor Addition of approximately 4,660 square feet of new Warehouse Facility (including ancillary spaces) adjacent and connecting to the existing building, and approximately 4,885 square feet of renovations to existing space, to provide access to the new space.
A new interior stairwell provides access to the first and roof levels. This new space will be equipped with new Fire Alarm components linked to the existing
Siemens brand Fire Alarm System. The new components must interface with the existing Fire Alarm System and its programming. It must be capable of meeting the specifications of the Fire Alarm System. The estimated material cost for this requirement is $20,000.00.
6. Statutory Authority: The statutory authority permitting an exception to Fair
Opportunity is Section 41 U.S.C. §3304 as implemented by Federal Acquisition
Regulation (FAR) 6.302:

An urgent and compelling need exists, and following the procedures would result in unacceptable delays; the agency need for the services is so urgent that providing a Fair
Opportunity would result in unacceptable delays;
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures; or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer).
A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
7. Rational/explanation supporting use of cited authority: In accordance with FAR
6.302-1(c)(1), only one responsible source and no other supplies or services will satisfy each of the agency requirements listed.
a. SIEMENS: The adjacent buildings are served by a Siemens Fire Alarm System. The new components in the new building expansion must interface with the existing Fire
Alarm System and its programming, and must also be capable of meeting the specifications of the existing Fire Alarm System. For this reason, the new Fire Alarm components are specified as Siemens brand to simplify the startup and re-programming of the existing Fire Alarm System. Also, because the Chicago Fire
Department responds to signals from the existing Fire Alarm System, it is vital to keep this notification as similar as possible to keep response times as short as possible.
The order must be issued on a sole-source basis in the interest of economy and efficiency
8. Description of Market Research conducted and results thereof, or statement why
Market Research was not conducted:
a. SIEMENS: Market research was not conducted because the facility requires
Siemens brand components to interface with the existing Fire Alarm System. Siemens is a well-known brand in the field and is competitive with other fire alarm systems.
No manufacturer/developer of fire alarm systems and components offers components which are readily adaptable to competitor systems.
9. Brand Name Only: The procurement is not estimated to exceed $25,000 and this documentation will be posted along with the IFB, as required.
10. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
