About this file

This single source justification document from the Department of Veterans Affairs Network Contracting Office 10 supports a planned sole source procurement of fifteen Point Blank Vision ballistic body armor vests from Point Blank Body Armor. The vests must be custom fitted to individual officers and use Point Blank's patented Outlast temperature regulating material, which no other ballistic vest manufacturer offers. Market research found at least two small business resellers of Point Blank products but neither could meet pricing and delivery needs. As such, this justification argues the vests are only available from a single source. The related solicitation will be a small business set-aside for the custom sized Point Blank Vision vests, with an estimated value of $15,750.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source (Brand-Name) Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C250-23-AP-4953

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 10, located at

5500 Armstrong Road, Battle Creek, MI 49037, in support of VISN 10 John D. Dingell VA Medical Center at 4646 John R Street, Detroit, MI 48201.

2237: 553-23-3-2126-0189

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This procurement if for fifteen (15) Point Blank Vision (Part No. VS5ABDBV0M) ballistic body armor (vests). Ballistic body armor is a mandatory issue item per VA police regulations. It must be Level IIIA or better, meet NIJ standards, be lightweight, custom fit to officers, made of anti-microbial microfiber material, have removable internal cumberbund, split shoulder access and adjustment, and made with materials that ensure moisture wicking and temperature control. The requested ballistic body armor is peculiar to one manufacturer, Point Blank Body Armor, 2102 SW 2nd Street, Pompano Beach, FL 33069. Point Blank is considered a large business, and the SBA has not waived the nonmanufacturer rule, therefore the VA “Rule of Two” is not attainable.

The estimated value of the proposed action is $15,750.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Point Blank Vision ballistic body armor uses a patented material, “Outlast”.

Outlast phase-changing material will absord, store and release body heat to maintain temperature balance for up to 70% reduction in sweat. Reduced sweat ensures longer life and more sanitary conditions of the ballistic vests. Search of ballistic vest manufactuerers by the requesting police officer showed no other products have the same temperature controlling material. Vest panels must be custom fit based on exact measurements of individual officers. Panels should be contoured for the male or female body. Panels and carrier cannot be “closet fit” standard sizes to ensure proper fit required for effectiveness. Of the various brand/model ballistic vests worn by police officers over the years, the officers state the Point Blank vests are the most comfortable to wear. Proper fit and comfort are extremely important due to the length of time the officers wear the vests.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted using SBA’s VetCert and DSBS, GSA Advantage, and SAM.gov.

Search of VetCert using NAICS 339113 resulted in 837 potential SDVOSB/VOSB’s. Search of DSBS using same NAICS and keywords “ballistic vest” resulted in zero SDVOSB’s or VOSB’s. Additional DSBS search using same NAICS and key words “Point Blank” resulted in one SB, Semforex, Inc.

Semforex, Inc. was listed as a VOSB in DSBS but vendor is not certified in VetCert. No mandatory source VA contracts for ballistic vests. Six vendors were found on GSA Advantage offering this https://www.acquisition.gov/?q=/browse/far/13 VHABACRozemJ Highlight

Contracting officer emailed the six vendors to determine who could provide the vests and provide custom fitting at the Detroit VA. Inventory Management Solutions and M-Pak, Inc. gave positive responses and provided quotes, SRT Supply gave a negative response, and the remaining vendors did not respond. Inventory Management Solutions offered the best price at $15,292.50 and they are a VetCert certified SDVOSB; However, when the CO reached out to them to obtain a new quote since the prior quote had expired, the vendor stated they could not currently issue new quotes for any of their Point Blank products. The other quote from M-Pak was priced at $1,191.67 per vest, which seemed a little high based on the market research and market research quotes obtained by the police department. There are at least two small business vendors who can supply Point Blank body armor in the open market, NYE Uniform Company and Semforex, Inc. CO intends to issue a small business set-aside combined synopsis/solicitation in the open market for the Point Blank body armor.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
