Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search.
Violations of VA regulations may result in citation answerable in the United States (Federal) District
Court, not a local district, state, or municipal court.
17. Conformance Standards. Contract service shall ensure that all work is performed in accordance with Joint Commission, DNR, EPA, DOT, OSHA and governing federal, local and state regulations and guidelines.
a) Environmental Protection Agency (EPA) 40 CFR
b) Food and Drug Administration (FDA) Quality System Regulation as stated in 21 CFR Part
c) Department of Transportation (DOT) 49 CFR
18. Payment. Invoices shall be paid in arrears on a monthly basis through electronic Tungsten submission. Invoices must include the Contract Number, Purchase Order Number and covered period of service. In addition, all invoices shall include total number of pounds (estimated if actuals are not available), rate per pickup or designated monthly unit as agreed upon in the contract.
Invoices shall be itemized per each delivery and pickup. Contractor shall have the ability to charge interest on late payment in the event VAMC does not pay Contractor on time.
19. Force Majeure (also defined under 52.212-4 (F) Excusable Delays)
Except for VAMC’s obligation to pay amounts due to Contractor, any failure or delay in performance due to contingencies beyond a party’s reasonable control, including strikes, riots, terrorist acts, compliance with Applicable Laws or governmental orders, fires, inclement weather and acts of God (collectively “Force Majeure Event”), shall not constitute a breach of this
Agreement.
During any period when performance of a party’s obligation is prevented by a Force Majeure
Event, that obligation shall be suspended provided that the party whose performance is suspended shall resume performance as soon as reasonably possible upon cessation of the Force Majeure
Event. The party claiming inability to perform shall notify the other party as soon as practical upon the beginning and ending of the Force Majeure Event.
The parties may make reasonable efforts to perform the obligations of this Agreement during the
Force Majeure Event. If Contractor is reasonably willing or able to provide some level of the
Services during a period of a Force Majeure Event, Contractor’s reasonable performance under the circumstances shall be sufficient, and partial performance shall not be considered a breach of performance. If Contractor is required to incur additional expenses in performing its obligations during a Force Majeure Event or thereafter as a result of damages caused by the Force Majeure
Event, then Contractor may pass through those expenses to VAMC, and VAMC shall reimburse
Contractor in accordance with the terms of this Agreement.
20. SPECIAL CONTRACT REQUIREMENTS:
a) SANITARY CONDITIONS: The contractor shall dispose of the miscellaneous trash and nonedible garbage so as not to cause conditions detrimental to public health or to constitute a public health or to constitute a public nuisance. The contractor shall assume full responsibility for compliance with all Federal, City, and County laws, rules and regulations governing the removal of waste materials. Any trash or garbage scattered by the contractor on the Medical Center in Cincinnati or Fort Thomas grounds shall be recovered and removed by the contractor. The pickup area shall be left in a clean and sanitary condition.
b) POINTS OF COLLECTION: Collection stations for refuse materials are listed. The contractor shall position bulk containers for customer ease in depositing refuse. This may require repositioning of containers from time to time. The contractor shall also position containers to minimize interference with adjacent parking areas, sidewalks, roadways, overhead utilities, trees, and other potential obstructions.
c) CUBIC YARD CAPACITY: Proposed capacity of containers is indicated above. The government reserves the right to change the cubic yard capacity at any collection station or change the number of collection stations as long as it does not increase the overall total cubic yard capacity requirement of this PWS. The government may also reduce the frequency of collections.
d) OFF-SITE DISPOSAL: The contractor shall transport and dispose of all solid waste at a licensed off-site disposal area selected by the contractor. Disposal shall be in accordance with existing local, state, and federal regulations. The contractor shall be responsible for any permit or fees associated with the use of off-base disposal locations.
21. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP)
SOLID WASTE REMOVAL AND CO-MINGLED RECYCLING SERVICES
1. PURPOSE
This Quality Assurance Surveillance Plan (QASP) provides a systematic method to evaluate performance for the stated contract. This QASP explains the following:
• What will be monitored?
• How monitoring will take place.
• Who will conduct the monitoring?
• How monitoring efforts and results will be documented.
This QASP does not detail how the contractor accomplishes the work. Rather, the QASP is created with the premise that the contractor is responsible for management and quality control actions to meet the terms of the contract. It is the Government’s responsibility to be objective, fair, and consistent in evaluating performance.
This QASP is a “living document” and the Government may review and revise it on a regular basis. However, the Government shall coordinate changes with the contractor. Copies of the original QASP and revisions shall be provided to the contractor and Government officials implementing surveillance activities.
1.1. GOVERNMENT ROLES AND RESPONSIBILITIES
The following personnel shall oversee and coordinate surveillance activities.
a. Contracting Officer (CO) - The CO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms, and shall safeguard the interests of the United States in the contractual relationship. The CO shall also assure that the contractor receives impartial, fair, and equitable treatment under this contract. The CO is ultimately responsible for the final determination of the adequacy of the contractor’s performance.
b. Contracting Officer’s Technical Representative (COTR) –The COTR is responsible for technical administration of the contract and shall assure proper Government surveillance of the contractor’s performance. The COTR shall keep a quality assurance file. The COTR is not empowered to make any contractual commitments or to authorize any contractual changes on the Government’s behalf.
PERFORMANCE STANDARDS
Performance standards define desired services. The Government performs surveillance to determine if the contractor exceeds, meets or does not meet these standards.
The Performance Requirements Summary Matrix, Technical Exhibit 4 of the Contract, includes performance standards. The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality
Level (AQL).

1.2. INCENTIVES
The Government shall use Exercise of Option Period (if any) and positive Past Performance.
1.3. METHODS OF QA SURVEILLANCE
Various methods exist to monitor performance. The COTR shall use the surveillance methods listed below in the administration of this QASP.
a. DIRECT OBSERVATION. (Can be performed periodically or through 100% surveillance.)
b. PERIODIC INSPECTION. (Evaluates outcomes on a periodic basis. Inspections may be scheduled [Daily, or Weekly] or unscheduled, as required.)
c. USER SURVEY. (Combines elements of validated user complaints and random sampling.
Random survey is conducted to solicit user satisfaction. May also generate inspections and sampling.)
d. VALIDATED USER/CUSTOMER COMPLAINTS. (Relies on the patient to identify deficiencies. Complaints are then investigated and validated.)
e.100% INSPECTION. (Evaluates all outcomes.)
f. PERIODIC SAMPLING. (Variation of random sampling. However, sample is only taken when a problem/deficiency is suspected. Sample results are applicable only for the specific work inspected. Since sample is not entirely random, it cannot be applied to total activity performance.)
g. RANDOM SAMPLING. (Designed to evaluate performance by randomly selecting and inspecting a sample of cases.)
h. Progress or status meetings.
i. Analysis of contractor's progress reports. (Evaluate cost, schedule, etc.)
1.4. RATINGS
Metrics and methods are designed to determine if performance exceeds, meets, or does not meet a given standard and acceptable quality level. A rating scale shall be used to determine a positive, neutral, or negative outcome. The following ratings shall be used:
Green – Acceptable
Yellow – Marginally Acceptable, with Corrective Actions Required
Red – Not Acceptable, no Corrective Actions Available
1.5. DOCUMENTING PERFORMANCE
a. ACCEPTABLE PERFORMANCE
The Government shall document positive performance. Any report may become a part of the supporting documentation for any contractual action.
b. UNACCEPTABLE PERFORMANCE
When unacceptable performance occurs, the COTR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the
COTR shall document the discussion and place it in the COTR file.
When the COTR determines formal written communication is required, the COTR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor's program manager.
The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to present this corrective action plan to the COTR. The
Government shall review the contractor's corrective action plan to determine acceptability.
Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the CO.
1.6. FREQUENCY OF MEASUREMENT
a. Frequency of Measurement.
During contract performance, the COTR will periodically analyze whether the negotiated frequency of surveillance is appropriate for the work being performed.
b. Frequency of Performance Assessment Meetings.
The COTR shall meet with the contractor at least quarterly (either in person or by telephone unless waived by the Contracting Officer) to assess performance and shall provide a written assessment.
