4. PROPOSAL EVALUATION:

4.1 To arrive at a Best Value decision, the Source Selection Authority, using the SSEB documentation will integrate the evaluation of Technical, Past Performance, and Price. Technical and Past Performance are of equal weight, and when combined, are significantly more important than Price. While the Government and the SSA will strive for maximum objectivity, the evaluation process, by its nature, is subjective and therefore, professional judgment is implicit throughout the entire evaluation process.

4.1.1 Offeror may, at the discretion of the Government, be asked to provide information for clarification purposes regarding their proposals. Requests for such clarification information do not constitute discussions.

4.1.2 The offeror shall be held responsible for the validity of all information supplied in his/her proposal, including that provided by potential subcontractors. Should subsequent investigation disclose that the fact and conditions were not as stated, the proposal may be rejected.

4.2The Government will determine, based on the information provided, if the offeror has demonstrated the ability to perform complete project management of construction projects at the dollar levels indicated in the solicitation.
4.3.1The evaluation will be divided into three (3) factors. Technical and past performance are equal, and when combined, are significantly more important than price. Ratings will be assigned for sub-factors and an overall rating will be assigned for each factor. After a rating has been assigned, there will be an overall technical rating for each contractor.

4.4.6 Volume I Technical

The technical factor is comprised of the 4 subfactors below. Each subfactor will receive an adjectival rating. All subfactors are equal.

4.4.6.1 Subfactor 1, Experience: The Government will evaluate the offeror’s narrative and answers concerning the proposed team – defined as the Prime and/or First Tier subcontractor(s) - experience in managing construction projects similar to the proposed project in size, complexity, and type. The Government will evaluate the offerors and their team’s experience with relevant projects. Each project that the contractor submits for this factor will be individually evaluated for relevancy as Relevant, Somewhat Relevant or Not Relevant and shall contribute to the overall Experience rating. More relevant and more recent experience will rate higher than less relevant and less recent experience. Significant consideration will be given to projects where team members served in the same role (i.e., Prime, subcontractor) as they will be fulfilling in the current project. Contractors that do not, have relevant experience to meet the solicitation’s minimum requirements may be eliminated from consideration. The relevancy ratings will be used with the information provided in Exhibit A, in order to create an overall Experience rating.

4.4.6.2 Subfactor 2, Personnel and Organization:

The government will evaluate the proposed team to ensure the primes and/or subs are capable of performing the work detailed in the SOW. This will include each firm’s overall organization as well as individual’s qualifications to perform the work. Contractors and their staff that demonstrate successful prior experience working together with their proposed subcontractors will be rated more favorably than contractors that are unable to demonstrate prior experience working with their proposed subcontractors.

4.4.6.3 Subfactor 3, Work Methods:

The Government will evaluate the offeror concerning their work methods to perform this construction project. This will include the proportion of in-housework, travel distance, safety, and quality control. Contractors with higher proportions of in-housework, shorter travel distances, safer records and stronger quality control programs will be rated more favorably.

4.4.6.4: Subfactor 4: Schedule

The Government will evaluate the offeror concerning their capability to schedule this construction project. This will include each firm’s and individual’s qualifications to generate a schedule and their proposed schedule, to include the critical path and float, and proposed outcomes.

4.5 Volume I, Past Performance

The Government will evaluate the offeror's past performance to determine the level of confidence that the proposed team – defined as Prime and/or First Tier subcontractor(s) - will successfully perform the current requirement. As part of this evaluation, VA will consider the relevancy of the projects submitted, to include the size and scope. Significant consideration will be given to prior projects conducted within fifty (50) miles of the Lebanon VA. The Government may evaluate present and past performance information by using data independently obtained from other Government or commercial sources, including, but not limited to: Government databases; personal business experience with the offeror; and information provided in the Offeror’s Past Performance Relevancy Questionnaire (Exhibit A); Subcontractor Information (Exhibit B); Past Performance Evaluation Questionnaires, (Exhibit E) completed by the offeror’s references. Past Performance information on contracts not listed by the offeror, or that of planned subcontractors, may also be evaluated.

The Government may contact references and contact parties other than those identified by the offeror, and information received may be used in the evaluation of the offeror’s Past Performance. The evaluation may take into account Past Performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition. If multiple subcontractors are provided for the same discipline, the government will use the lowest rated subcontractor in the evaluation. The Government reserves the right to obtain and evaluate Past Performance information from any source it deems appropriate. The following ratings will be used to define the past performance risk:

4.5.1 The Past Performance proposal evaluation will consider such things as business practices, customer relationship, and ability to successfully perform as proposed and other considerations considering currency, relevancy, sources, context, and trends. Past Performance includes current on-going (present) performance.

4.5.2 The Government will conduct a performance risk assessment based upon the Past Performance of the proposed team as it relates to the probability of successful accomplishment of the work required by the solicitation. Ratings will consider the offeror's Past Performance considering currency, relevancy, sources, context, and trends, using descriptive adjectives that most accurately define the offeror's performance risk considering all potential evaluation criteria identified in this factor. Relevance will be considered in the overall Past Performance rating. Ratings will consider the offeror's Past Performance considering currency, relevancy, sources, context, corrective actions taken and trends. An adjectival rating for past performance will be assigned based on the confidence of success on this project, based on recency and relevancy of projects submitted, CPARS evaluations, and personal knowledge.

4.5.3 The evaluation may take into account Past Performance information regarding predecessor companies or key personnel who have relevant experience that will perform major or critical aspects of the requirement when such information is relevant to this acquisition.

To conduct the performance risk assessment, the Government may use data provided by the offeror, and data obtained from other sources. The Government may: evaluate present and past performance information by using data independently obtained from other Government or commercial sources, including, but not limited to Government databases; rely upon personal business experience with the offeror; and use the information provided in the Offeror’s Past Performance Relevancy Questionnaires, (Exhibit A) and through Past Performance Evaluation Questionnaires, (Exhibit E) completed by the offeror’s references. Past Performance information on contracts not listed by the offeror, or that of planned subcontractors, may also be evaluated. The Government may contact references and contact parties other than those identified by the offeror, and information received may be used in the evaluation of the offeror’s Past Performance. While the Government may elect to consider data obtained from other sources, the burden of providing current, accurate and complete Past Performance information rests with the offeror. The Government reserves the right to obtain and evaluate Past Performance information from any source it deems appropriate.

4.5.4 Currency, Relevancy: The Government will consider the currency, relevancy and trends of the performance information while conducting its performance evaluation. Exhibit A may be used for this purpose.

4.5.4.1 For the purpose of this solicitation, currency is performance occurring within the last five years through the solicitation release date. Within this period, performance occurring later in the period may have greater significance than work occurring earlier in the period. For example, performance information for work occurring during 2022 may have greater importance than performance information for work occurring during 2018.

4.5.4.2 In assessing relevancy, the Government may evaluate the references for similarity of the construction methods to the scope of this solicitation, (multi-discipline or specialized area), scope/type of contracts/projects, price magnitude of projects as it relates to price, area of consideration, client type and location of work performed as it relates to the location(s) of work to be performed under this contract.

4.5.4.3 In accordance with FAR 15.306(a) (2), if award will be made without conducting discussions, offerors may be given the opportunity to clarify certain aspects of their proposals, e.g., the relevance of an offeror's Past Performance information and adverse Past Performance information to which the offeror has not previously had an opportunity to respond, or to resolve minor clerical errors.

4.5.5 NON-PRICE EVALUATION FACTOR RATING: The Government will rate an offeror's non-price proposal, with an overall rating, that combines the Past Performance and Technical Performance evaluations.

4.6 PRICE EVALUATION: The purpose of the Price evaluation is to provide an assessment of the reasonableness of the proposed price in relation to the solicitation requirements. Proposals will be evaluated in the following manner.

4.6.1 Proposal Price Schedule of Values with a breakdown identifying major functional areas identified in Exhibit C.

4.6.2Prices will be evaluated for reasonableness utilizing one or more of the price analysis techniques set forth in FAR 15.305.
4.6.3Government intends to make award to a responsible Offeror submitting a conforming proposal without discussions however, the Government reserves the right to conduct discussions if deemed to be in the best interest of the Government.

4.6.4 Prompt payment discounts will not be considered in the evaluation of offers.

4.6.5 Those proposals evaluated as not satisfying the entire price criteria may be eliminated from consideration for award unless the Contracting Officer determines otherwise.

4.6.6 In the event minor clerical error has occurred, then the offeror may be given an opportunity to correct the minor error within the constraints of the "clarifications" process or the Contracting Officer determines discussions are required.
