This project shall generally consist of, but not limited to; providing all labor, supplies, transportation, and equipment required to correct electrical deficiencies at the Coatesville VA Medical Center (CVAMC).
All work shall be performed in accordance with (IAW) the Statemen t of Work (SOW), the attached documents, and all Federal, State, and local codes.
Magnitude of Construction: Between $2,000,000.00 and $5,000,000.00.

This is a Service Disabled Veteran Owned Small Business (SDVOSB) set-aside acquisition.
An Award will be made to the responsive, responsible bidder by way of a Firm-Fixed-Price (FFP) contra ct whose bid constitutes the lowest price to the Government.
All documents for this solicitation will be available on the FedBizOpps website (http://www.fedbizopps.gov). It is the responsibility of the contractor to check this website frequently for updates and amendments to this solicitation.
Interested parties are encouraged to attend the scheduled Site Visit, which will be held at 1400 Blackhorse Hill Rd, Building 70, Coatesville, PA 19320, on 12/19/2018 at 9:00 AM (Local), IAW FAR 52.236-27 - Site Visit (FEB 1995).
The Contractor shal l be responsible for the correct title classification of workers and compliance with all applicable wage and hour laws.
Instruction To Offerors:
Bidders are required to submit sealed bids in accordance with the instructions outlined in Section 13 (below) and by submitting a bid amount on the Bid Schedule, located on Page 3. Electronic submissions are not authorized for any bid requiring a sta mped bid bond. Bid Bonds must be presented in hard copy with raised seal at the time of bid opening. Questions regarding the solicitation must be submitted to the Contract Specialist by email at Lev.Stowe@va.gov, no later than December 26, 2018, at 4:00 PM (EST), after which time questions will not be answered.

STATEMENT OF WORK
FOR
THE CORRECTION OF ELECTRICAL DEFICIENCIES
PROJECT NO. 542-12-106
COATESVILLE VA MEDICAL CENTER
DESCRIPTION:
Correct all electrical deficiencies outlined herein at the Coatesville VA Medical Center (CVAMC).
PLACE OF PERFORMANCE:
The Coatesville VA Medical Center (CVAMC) - 1400 Blackhorse Hill Rd, Multiple Buildings, Coatesville, PA 19320; see drawings for specific locations of performance, and a detailed list of technical requirements at each site.
BACKGROUND:
During one of the earliest phases of modernization to the Coatesville VA Medical Center’s electrical system, Federal Pacific Electric (FPE) installed various equipment throughout the facility that no longer complies with current electrical codes and safety standards.
SCOPE:
The purpose of this project is to correct all electrical deficiencies outlined in this Statement of Work (SOW), including those referenced in the SOW which refer to separate attachments to the contract. The objective is to target all FPE equipment for replacement and modernization as well as all antiquated electrical systems throughout the CVAMC Campus, as listed in Attachment “A” (Drawings); i.e., electrical switchgear, panelboards, circuit breaker panels, bonding and grounding, improper wire sizes, and equipment related to those circuits such as; motors, motor starters, and Automatic Transfer Switches (ATS), etc. Work will include, but is not limited to; drafting Red-Line drawings, cost estimates, and project scheduling and phasing.
GENERAL INFORMATION:
A. Attachments:

· The contractor shall refer to the Contracting Officer Representative (COR) for clarification and guidance.
PERFORMANCE REQUIREMENTS:
The contractor shall provide all labor, supplies, transportation, and equipment required to correct all electrical deficiencies at the Coatesville VA Medical Center (CVAMC) in accordance with; the attachments provided, and the sources referenced, while complying with all applicable Federal, State, and local codes, including the Department of Veterans Affairs (VA) requirements outlined herein.
A. Industry Code Compliance:
The contractor shall comply with all applicable National Electrical Codes (NEC), including the National Fire Protection Association (NFPA) 70E - Standards for Electrical Safety in the Workplace, NFPA 99 – Health Care Facility Codes, and Joint Commission requirements.
B. Permits:
The contractor shall obtain all environmental and other necessary permits required prior to the commencement of any work under this contract.
C. Summary of Work:
1) All items listed for each location in Attachment “A”,
2) The specifications referenced in Attachments “A” & “B”,
3) Completing the Campus-Wide Power System Study, referenced in Section 26 05 74 of Attachment “B”,
4) Building 17 Chiller Breaker: Install new 1600 A 480 V, 3 Pole Draw-Out circuit breaker in modified cubicle & provide connection, and new door with escutcheon; refer to Attachment “A”.
D. Construction Barrier:
1) The Pre-construction Risk Assessment (PCRA) and Infectious Control Risk Assessment (ICRA) shall include a solid door entry, full High-Efficiency Particulate Air (HEPA) exhaust, and a barrier from the floor to the ceiling deck (above any acoustic ceiling) when applicable.
2) The contractor shall provide a safety barrier around the construction site / work area, comprised of a plastic barrier and caution tape.
GENERAL REQUIREMENTS:
A. Required Contractor Notifications and Scheduling:
1) Shutdown of Equipment and/or Facility Power: The contractor shall notify the COR two (2) weeks in advance of the need to schedule a shutdown or disconnection of facility power, and/or any power that supplies electricity to any and/or all spaces at the CVAMC.
2) Gaining Access to Secured Areas: The contractor shall notify the COR two (2) weeks in advance of the need to gain access to secured areas if such access is required.
3) Interference in Performance Requirements: The contractor shall immediately notify the COR if and/or when performance requirements under this contract must be interrupted in support the normal functioning of the facility; e.g., utility services, mealtimes, inspections, the distribution of medication to patients, emergency responses, the passage of facility patients/personnel, etc.
4) Product Literature & Maintenance Requirements: The contractor shall supply the COR with product literature and maintenance requirements (if any) for all items installed under this contract.
B. Cleanup and Disposal:
1) Disposal / Recycling of Trash and Hazardous Waste:
a. All recyclables; e.g., abandoned wire, starters, and related equipment will be recycled by the contractor. The contractor shall provide the COR with a receipt showing that the items listed were recycled appropriately.
SPECIAL CONTRACTOR PROVISIONS: The following provisions shall be adhered to by contractor personnel throughout the duration of this contract:
A. Portable Generators:
1) To minimize time without power, the contractor shall supply an applicable size portable generator to power the load (facility or individual circuits) of the electrical equipment affected.
B. Emergency Escape Lighting:
1) Contractors will provide emergency escape lighting when applicable.
C. Submission of Red-Line Drawings:
1) The contractor shall provide the COR with Red-Line drawings in the following format prior to the completion of the project;
a. One (1) full size drawing (hard copy)
b. Two (2) half size drawings (hard copies)
c. Three (3) CD’s
D. Contractor Storage:
1) The contractor must provide their own storage structure.
SPECIAL CVAMC PROVISIONS:
A. Storage Site:
1) The CVAMC will provide the contractor with a storage site prior to the commencement of all performance requirements and it will be available to the contractor throughout the duration of the contract.
a. The dimensions of the storage site will be large enough to accommodate a 40’ x 12’ shipping container.
b. The COR will provide the contractor with the exact location of the storage site prior to the contractor’s receipt of the Notice to Proceed.
PERFORMANCE SCHEDULE:
A. Working Hours:
1) Work shall be performed Monday through Friday (except Federal Holidays), 7:00 AM (Local) – 5:00 PM (Local).
2) Contractor performance outside of the working hours (off-hours work) previously specified is only authorized after a notification to the COR has been approved.

INSTRUCTIONS TO BIDDERS
(a) Bidding materials consisting of drawings, specifications and contract forms may be obtained by qualified General (Prime) Contractors interested in submitting bids direct to the Department of Veterans Affairs from www.FBO.GOV
(b) Subcontractors, material firms and others interested in preparing sub-bids may obtain a list of Prime Contractors from www.FBO.GOV via the Interested Vendors Section.
(c) A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
(d) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification.

Contractor shall completely prepare site for building operations, including demolition and removal of existing materials, and furnish labor and materials and perform work for “Correcting Electrical Deficiencies”. The Contractor acknowledges that it has taken steps reasonably necessary to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost; any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government. The Contractor agrees to be responsible for the correct classification of workers.

“All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record. The information shall contain, at a minimum, a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years.
All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.
Self insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.
A Determination of Responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines above may result in a determination of “Non-Responsibility” for the bidder/offeror. NOTE: Any information received by the Government that would cause for a negative Determination of Responsibility may make the bidder/offeror ineligible for award.
This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.
Contractor shall be required to complete all contract work and schedule a final inspection within the specified contract performance period. Should the Contractor fail to complete the contract work (including scheduling of the final inspection), and it is determined by the Government to be a Contractor-caused delay, the Contractor shall be in default status. If the Government determines it to be in the best interest of the Government to allow the Contractor to continue to perform contract work, the Contractor shall provide equitable consideration in the form of Liquidated Damages from the first day of inexcusable delay through final acceptance by the Government. These damages are associated with the additional time granted for completion and acceptance of contract work. Such agreement shall not be deemed a waiver of the Government’s right to terminate this contract in the event the Contractor fails to complete the contract work (including scheduling of the final inspection) on or before the completion date.
TRAINING: Effective July 31, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course. The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. Failure to present the proper training documentation will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
It is the responsibility of the Contractor to provide TB training annually and a PPD test annually for any employees providing services at the VA Medical Center, Coatesville, PA. The government reserves the right to review the contractor's records. Failure to present the proper training documentation upon the Contracting Officer’s request will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
PRIVACY & CONFIDENTIALITY: Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. Information maybe overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this agreement or its attached documents in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breeches of the privacy and confidential should be reported immediately to the Contracting Officer, Contracting Officer’s Representative (COR) or the Facility Privacy Officer.
KEYS: All keys provided the Contractor or any subcontractor for use during the project shall be returned to the Contracting Officer's Representative (COR) at completion of the work or upon request. No keys shall be reproduced by the Contractor or any subcontractor. There shall be a charge for each key that is lost or not returned to the COR.
CONTRACTOR NORMAL WORK HOURS: The contractor work hours are from 7:00AM to 5:00PM, Monday through Friday, excluding federal holidays. Federal holidays that fall on a non-work day – Saturday or Sunday - the holiday usually is observed on Monday if the holiday is on Sunday or on Friday if the holiday is on Saturday. The contractor may request authorization from the Contracting Officer to work an alternative schedule or on holidays. However, the Contracting Officer reserves the right to deny or authorize the contractor’s request at his or her discretion considering the best interests of the Government. 2.1 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)
(a) Definitions. As used in this provision— "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
"Federal contracts and grants with total value greater than $10,000,000" means—
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
"Principal" means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

For clarity, references to the report in this section refer to the entirety of the annual unclassified report, including any separate reports that are incorporated by reference into the annual unclassified report.
(1) Check the table of contents of the annual unclassified report and the country section headings of the reports incorporated by reference to identify the foreign countries listed there. Determine whether the Offeror or any person owned or controlled by the Offeror may have engaged in any activity related to one or more of such foreign countries.
(2) If there may have been such activity, review all findings in the report associated with those foreign countries to determine whether or not each such foreign country was determined to be in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or to be not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. For clarity, in the annual report an explicit certification of noncompliance is equivalent to a determination of violation. However, the following statements in the annual report are not equivalent to a determination of violation:
(i) An inability to certify compliance.
(ii) An inability to conclude compliance.
(iii) A statement about compliance concerns.
(3) If so, determine whether the Offeror or any person owned or controlled by the Offeror has engaged in any activity that contributed to or is a significant factor in the determination in the report that one or more of these foreign countries is in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. Review the narrative for any such findings reflecting a determination of violation or non-adherence related to those foreign countries in the report, including the finding itself, and to the extent necessary, the conduct giving rise to the compliance or adherence concerns, the analysis of compliance or adherence concerns, and efforts to resolve compliance or adherence concerns.
(4) The Offeror may submit any questions with regard to this report by email to NDAA1290Cert@state.gov. To the extent feasible, the Department of State will respond to such email inquiries within 3 business days.
(d) Do not submit an offer unless—
(1) A certification is provided in paragraph (b)(1) of this provision and submitted with the offer; or
(2) In accordance with paragraph (b)(2) of this provision, the Offeror provides with its offer information that the President of the United States has—
(i) Waived application under U.S.C. 2593e(d) or (e); or
(ii) Determined under 22 U.S.C. 2593e(g)(2) that the entity has ceased all activities for which measures were imposed under 22 U.S.C.2593e(b).
(e) Remedies. The certification in paragraph (b)(1) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly submitted a false certification, in addition to other remedies available to the Government, such as suspension or debarment, the Contracting Officer may terminate any contract resulting from the false certification.

2.4 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.5 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. (1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;

2.6 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

(2) If the provision at 52.204–7, System for Award Management, is not included in this solicitation, and the Offeror has an active registration in the System for Award Management (SAM), the Offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certifications in the solicitation.
