718-526-1000 X-7503 Project No. 561A4-20-101, Replace Flooring, in accordance with the statement of work (SOW), specifications, and drawings attached hereto. Location of this project is VA NJ Healthcare System, Lyons Campus, New Jersey. The contractor shall furnish all materials, supplies, equipment, personnel and supervision to accomplish this project.
Completion Time: 180 calendar days from the notice-to-proceed (NTP) date.
Contractor will be responsible to coordinate and schedule work to minimize to short duration and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the Contracting Officer (CO). Work shall comply with Veterans Affairs (VA) Specifications and regulations, all applicable Federal, State and Local codes, including specific regulations related to working at the VA New Jersey, Lyons Campus.
This is a Service-Disabled Veteran-Owned Small Business set aside procurement and will be conducted in accordance with Public Law 109-461. All prospective bidders must be registered in the System for Award Management (SAM) at www.sam.gov, Duns & Bradstreet at www.DNB.com, and are verified/visible/certified in VIP VetBiz at www.vetbiz.gov at the time of offer submission and before award of this procurement. Offerors must submit their annual Vets4212 Report. The North American Industry Classification System Code (NAICS) is 238330, Business Size is $16.5 Million.
Magnitude of Construction: Between $500,000 and $1,000,000.

A.3 PRE-BID SITE VISIT AND BID OPENING INSTRUCTIONS
Project Number 561A4-20-101 – Replace Flooring at Lyons VAMC Pre-Bid Site Visit Instructions A pre-bid site visit is scheduled for Thursday, November 18, 2021 at 10:00 AM EST. Prospective bidders shall meet at VA New Jersey Healthcare System, Lyons Campus, 151 Knollcroft Road, Bldg. 10 Conference Room, Lyons NJ. 07939.
Attendees will be limited of no more than 2 representatives from each company will be allowed. NO OTHER SITE VISITS WILL BE ALLOWED. INTERESTED BIDDERS ARE STRONGLY ENCOURAGED TO ATTEND.
What to Expect: While on the VA New Jersey, Lyons Campus, visitors shall comply with COVID-19 preventive measures of wearing a face covering and social distancing. All visitors are asked to take personal responsibility for compliance in the best interest of public health and safety.

A.4 STATEMENT OF WORK
Project # 561A4-20-101 Replace Flooring Lyon’s Campus
1. Contract description.
To provide construction services for project 561A4-20-101 Replace Flooring at the VA Lyons Healthcare System.
2. Background.
Project is necessary to update and replace the existing flooring that was installed in specified areas of Bldg. 2, 3, 10, and 11 located on the Lyons Campus of the VA New Jersey Healthcare System. Currently, the areas specified in the project contain carpeted floors that were installed over 30 years ago. Carpeting has been found to be a breeding ground for mold and bacteria and the VA NJ Healthcare network is moving away for its use in the medical centers.
3. Scope.
Provide renovation of the areas enumerated below and as detailed in the construction package including contract drawings, contract specifications for upgrade to the following areas:
i. Bldg. 2, Rm.115 (approximately 262 sf); Removal of trace amounts of hazardous material, and Floor replacement
ii. Bldg. 3, 1st Fl., Gallery, Exam/Treatment Waiting & Reception areas, Digestive/Pulmonary Waiting & Reception areas, Pharmacy & Pharmacy Waiting areas (approx. 7,242 sf); Floor Replacement
iii. Bldg. 10, Rm.215 and Rm.215A (approx. 1,469 sf); Floor Replacement
iv. Bldg. 11, 1st Fl., Rms.107, 108, 109, 110, 111 (approx. 2,997 sf); Floor Replacement
v. Bldg.11, 2nd Fl., Rms.227, 228, 229,230, 231, 232, 233, 234, 234A, 234B, 235, 236 (approx. 5,460 sf); Floor Replacement
ALTERNATE NO.1: Eliminate demolition and new work scheduled for Bldg. 10, Rm.215 and Rm.215A (approx. 1,469 sf).
4. Specific Tasks.
A. The scope of work shall include but not be limited to the following main items:
1. Existing base material in all contracted spaces will be removed and disposed of and replaced with new materials (outlined in the specifications and drawings).
2. Existing interior flooring material in all contracted spaces, in accordance with the requirements will be removed and disposed. All floors within the contract, are to receive new interior flooring material (outline in the specifications and drawings). Including wall bases and integral coves (if specified).
3. Prior to installation of the new floor(s), the newly demolished areas will be cleaned, patched/repaired and leveled as required.
4. The 2nd floor level of building 10 requires the selective removal of the highest points of the existing concrete slab/structure in order to provide a level finished floor. (This scope has been outlined as Deduct Alternate 1).
B. State of Bid Items:
1. Work includes general construction, necessary removal of existing finishes and construction and certain other items. Before submission of final bid proposal, the bidder shall examine the site of the proposed work to determine the existing conditions that may affect the complete execution of the work. Any modifications to the existing system shall be included in the scope and provided with NO extra cost to the Department of Veteran Affairs.
2. Contractor is responsible for the removal, safe storage and reinstatement of all furniture, equipment (minus Office of Information Technology equipment, OIT), etc. Safe Storage must be a secured location, under lock and key, in a storage trailer or other designated form of storage to house furniture and/or equipment. The VA will not provide temporary storage space. After construction is complete the General Contractor, is to reinstall furnishings to previously documented locations. Any loss or damages are the sole responsibility of the contractor during the removal and storage, until reinstatement is complete.
5. Performance Monitoring (if applicable).
Work shall be coordinated with facility thru the Contracting Office Representative (COR). COR will monitor the contractor work performance on daily basis and the contractor is required to submit daily’s progress report to the COR.
6. Security Requirements.
General Contractor’s employees shall not enter the project site without appropriate security badge. They may also be subject to inspection of their personal effects when entering or leaving the project site.
No photography of VA premises is allowed without written permission of the Contracting Officer except as specifically required by the scope of the work.
VA reserves the right to close or shut down the project site and order General Contractor’s employees off the premises in the event of a national emergency. The General Contractor may return to the site only with the written approval of the Contracting Officer.
8. Other Pertinent Information or Special Considerations.
a. Inspection and Acceptance Criteria. The COR is responsible for certifying that the work done under the contract is performed to time and standard. They are also responsible to assure the inspection and acceptance of products provided incidental to services.
9. Risk Control Contractor shall take all measures for safety & infection control and provide all material necessary for protecting existing equipment and property in affected areas of construction against dust and debris, so that equipment and affected areas to be used in the Medical Centers operations will not be hindered.
Contractor shall permit access to Department of Veterans Affairs personnel and patients through other construction areas which serve as routes of access to such affected areas and equipment. Coordinate alteration work in areas occupied by Department of Veterans Affairs so that Medical Center operations will continue during the construction period.
Contractor shall minimize interference of construction activities with flow of Medical Center traffic, keep roads, walks and entrances to grounds, to parking and to occupied areas of buildings clear of construction materials, debris and standing construction equipment and vehicles.

BASE BID The contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work for VA Project No. 561A4-20-101 to Replace Flooring as required by drawings and specifications The contractor shall provide, but not limited to a complete construction service, including all labor, material, equipment and supervision to perform general construction, removal and replacement of the existing flooring that was installed in specified areas of Bldg. 2, 3, 10, and 11 located on the Lyons Campus as shown in the AE drawings and specifications.
The Contract period of performance for Base Bid construction shall be 180 calendar days from Notice to Proceed (NTP) which includes 30 days for contract closeout.

A.6 VHA SUPPLEMENTAL CONTRACT REQUIREMENTS FOR ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR FEDERAL CONTRACTORS
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1) If fully vaccinated, shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2) If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test.
3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.

By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.
(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.
(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment Protections, as noted in the General Conditions of this Specification. Copies of the Standard Form of Payment Bond may be obtained upon application to the Issuing Office.
DESCRIPTION OF WORK: GENERAL CONSTRUCTION: The contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work to replace the existing flooring that was installed in specified areas of Bldg. 2, 3, 10, and 11 located on the Lyons Campus of the VA New Jersey Healthcare System.
Magnitude of Construction: $500,000.00 and $1,000,000.00

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

2.5 52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be percent of the bid price or , whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

2.9 VAAR 852.211-72 TECHNICAL INDUSTRY STANDARDS (NOV 2018)
(a) The Contractor shall conform to the standards established by: Department of Veterans Affairs, Veterans Health Administration (VHA) as to VA Master Construction Specifications.
(b) The Contractor shall submit proof of conformance to the standard. This proof may be a label or seal affixed to the equipment or supplies, warranting that the item(s) have been tested in accordance with the standards and meet the contract requirement. Proof may also be furnished by the organization listed above certifying that the item(s) furnished have been tested in accordance with and conform to the specified standards.
