VHAPM Part 808.405-6 Limiting Sources Page 1 of 2 Original Date: 08/30/2017 Revision 02 Eff Date: 02/21/2020

DEPARTMENT OF VETERANS AFFAIRS

FAR 8 – Justification for Limiting Sources (LSJ) For

Limiting Sources (<SAT)

Acquisition Plan Action ID: 36C242-20-AP-1275

1. Contracting Activity: Department of Veterans Affairs, VISN 2, Syracuse VA Medical Center

800 Irving Avenue Syracuse, NY 13210

2. Description of Action:

This is a request for a 3 month rental of a GE SIGNA Excite 1.5 Tesla MRI Scanner; model GE 23X HDXT. This is the only system that will meet the interim requirement while the main MRI is being replaced.

Brand Name Equipment:

Manufacturer: General Electric

Equipment: GE SIGNA Excite 1.5T Mobile MRI System; model GE 23X HDXT

3. Description of Supplies or Services:

The estimated value of the proposed action is $157,775.00

This requirement is for a three (3) month rental of GE SIGNA Excite 1.5 T Mobile MRI System;

model GE 23X HDXT. It is the only system that will meet the facility’s interim requirement while the main MRI unit of the same make and model are being replaced in the medical center. As the medical center does not have a back up MRI one must be provided to accommodate the Veterans during the installation of the new MRI on the unit. The unit is necessary as it is what the VA staff is familiar with and know how to operate. To deviate from this particular model would result in needing a new Enterprise Risk Assessment that would need to be intiated after the the different model is awarded. This would result in additional 3 months to complete making this rental not viable. By staying with this standard model MRI it will conform to the Access Control List (ACL) that allows secure connection between all connecting equipment.

This requested model MRI will also have the interface already created so that a new one would not be needed. The result is a existing Plug and Play interface to the Hospital network. Any other interfaces might take weeks or months to be developed and tested resulting in this rental to be voided.

4. Authority: IDENTIFY THE AUTHORITY AND SUPPORTING RATIONALE (see 8.405-

6(a)(1)(i)(A), (B), and (C) or 8.405-6(b)), AND IF APPLICABLE, A DEMONSTRATION OF THE

PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY

OR SERVICE.

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rationale/explanation to support cited authority:

The rental of the mobile MRI Unit is necessary for the medical center to stay on track for the installation of the new MRI in the facility. The reason for the same make and model is for contuinance of healthcare for the Veterans at the same level the staff has been utilizing with the current MRI. This MRI will produce the same results as the current identical unit on the floor. It is essential for the unit to be in place June 1st, 2020 as the removal of the current unit will commense. Staff need to have a turn key unit to utilize for the Veterans.

Any delays would cause an extreme increase in cost or possible cancellation of the project set in place.

6. BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ, as required by FAR 8.405-1(e).

7. Note that this determination satisfies the requirements of FAR 8.405-6.
