CONTINUATION PAGE
Q1. The new solicitation appears similar to previous RFQ 36C10G18Q0120 (canceled). Are there specific changes of importance that we should pay particular attention to in this new solicitation?
GOVERNMENT RESPONSE:
There were several changes made to the technical requirements, specifically ATTACHMENT B - WARMING CABINETS - PRODUCT DESCRIPTION.
Q2. May we assume that references to Vein Finders in Attachment E are a result of transcription error?
GOVERNMENT RESPONSE:
The text was revised. ATTACHMENT E - WARMING CABINETS – SOLICITATION PROVISIONS is hereby deleted and replaced with the new ATTACHMENT E - WARMING CABINETS – SOLICITATION PROVISIONS in this solicitation amendment.
Q3. Freight costs have become more difficult to project due to escalating fuel prices. They are, of course, also highly variable depending on the number of cabinets included in a single shipment and the destination. With regard to Volume III Price and Attachment A, is a statement to the effect that “Shipping cost will be assessed at rates current at the time an order is placed” acceptable? Or must a shipping cost be included in the proposed price of each item, even those in the forward option years?
GOVERNMENT RESPONSE:
As stated in ATTACHMENT C - WARMING CABINETS – CONTRACT ADMINISTRATION, the shipping terms for each delivery order is Free on Board (FOB) Destination. Please see Federal Acquisition Regulation 47.303-6 F.o.b. Destination, for complete details on contractor responsibilities with regards to transportation. Additionally, this is a Firm-Fixed Price Requirements Contract. Therefore, all costs must be imbedded into the quoted unit price for the base year and each option year.
Q4. Concerning Attachment F, the Past Performance Questionnaire, what are the numeric “Rating Guidelines” referred to under Offeror Evaluation? The only apparent rating guidelines described in the Questionnaire instructions are in letter form (M, A, G, O).
GOVERNMENT RESPONSE:
The text was revised. The solicitation ATTACHMENT F - WARMING CABINETS – PAST PERFORMANCE QUESTIONNAIRE is hereby deleted and replaced with the new ATTACHMENT F - WARMING CABINETS – PAST PERFORMANCE QUESTIONNAIRE in this solicitation amendment.
Q5. Further concerning Attachment F, the RFQ number that respondents are required to include in the subject line for their email to be successfully transmitted (Part III) is missing a “C” after the number 36. May we assume that the Solicitation Number listed in the Solicitation Notice should be used as the number in the subject line? (Also, it appears your name is misspelled in the email address included in Part III.)
GOVERNMENT RESPONSE:
Solicitation ATTACHMENT F - WARMING CABINETS – PAST PERFORMANCE QUESTIONNAIRE, specifically Part III - RETURN INFORMATION is revised as follows:
Please return this completed Past Performance Questionnaire AS AN ATTACHMENT via e-mail to Tonya W. Purce at tonya.purce@va.gov and Beth Davis beth.davis2@va.gov in PDF format. The subject line of the email must read: RFQ 36C10G18Q0188 - NX EQ Warming Cabinets Past Performance Questionnaire in order for the email to be successfully transmitted and received. Please e-mail the completed questionnaire by 4:00PM ESDST on Wednesday, June 13, 2018.
Q6. The "salient characteristics" listed in the solicitation are word for word from the Steris Amsco website specifications section. No other SCs were provided. The VA is not allowed to list only specifications from the brand name as its "salient characteristics.” Can you please revise the salient characteristics for this solicitation to fit those needed by the VA for Warming Cabinets; not to salient characteristics proprietary to brand name product(s) such that no one else can meet the characteristic?
GOVERNMENT RESPONSE:
The requirement Salient Characteristics are revised to more clearly identify the general, physical, functional, and performance characteristics of the product. The technical specifications have been changed and therefore, the ATTACHMENT B - WARMING CABINETS - PRODUCT DESCRIPTION is hereby deleted in its entirety and replaced with the ATTACHMENT B - WARMING CABINETS - PRODUCT DESCRIPTION in this solicitation amendment.
Q7. Steris is a large company; can you please confirm whether you have a NMR Waiver in place of the procurement?
GOVERNMENT RESPONSE:
A search of the Small Business Administration’s website, https://www.sba.gov/sites/default/files/articles/NMR%20CLASS%20WAIVER%20LIST-AS%20OF%2001-01-2015_3.pdf , revealed that there is no existing class waiver for NAICS Code 339113, PSC 6515.
Q8. Why is this solicitation not set-aside for SDVOSB/VOSB?
GOVERNMENT RESPONSE:
The information obtained during the pre-solicitation planning process for this program did not support competition restrictions outside of the established 100% Total Small Business Set-aside. Additionally, the Government encourages all types of small business to submit a quote if they can meet or exceed all of the requirements in the solicitation.
Q9. Why are you anticipating a single award? Given that this is for all of the VA for two years, is it feasible that the total sales under the contract could top $112M? If so, they are not allowed to issue a single award contract per FAR 16.503(b)(2):(2) No requirements contract in an amount estimated to exceed $112 million (including all options) may be awarded to a single source unless a determination is executed in accordance with 16.504(c)(1)(ii)(D).
GOVERNMENT RESPONSE:
The Government has determined that the estimated total cost of the intended Single Award Firm-Fixed Price Requirement contract, when considering procurement history and estimated quantities meets the thresholds provided in FAR 13.500 Simplified Procedures for Certain Commercial Items, which states:
“This subpart authorizes the use of simplified procedures for the acquisition of supplies and services in amounts greater than the simplified acquisition threshold but not exceeding $7 million ($13 million for acquisitions as described in 13.500(c)), including options, if the contracting officer reasonably expects, based on the nature of the supplies or services sought, and on market research, that offers will include only commercial items.”
Additionally, based on the Government’s knowledge of the market, a Single Award Firm-Fixed Price Requirements contract is feasible as no delivery orders against the resulting contract will be issued in an amount estimated to exceed $112 million.
