This document is a Participating Addendum for Computer Equipment, Peripherals & Related Services between the State of North Dakota and Apple Inc., executed under the NASPO ValuePoint Master Agreement Number 23003. The addendum involves Apple Inc. as the Contractor and enables participation by North Dakota state agencies, institutions under the State Board of Higher Education, other government entities (including counties, cities, townships, educational entities, governmental boards, nonprofit entities, tribal agencies, and the International Peace Garden).
The addendum authorizes Apple to sell products and services in Band 2 Personal Computer Devices (Non-Windows OS) to participating entities. Apple is required to provide quarterly sales reports and has a liability cap mechanism where at 40% of the total liability, the state may terminate the agreement or propose an amendment. The contract includes commercial general liability coverage of $2,000,000 per occurrence and is effective from July 1, 2023, or the date of the last signature, with termination aligned to the master agreement's timeline.
