About this file

This is a Request for Bid (RFB #JL-4698A) issued by the Wisconsin Department of Corrections, Purchasing Services Section, on behalf of the Division of Community Corrections. The solicitation seeks vendors to provide extradition transport and security services for transporting inmates from out-of-state jurisdictions to Wisconsin prison or jail facilities and potentially from Wisconsin facilities to out-of-state jurisdictions. Bids were due March 13, 2015, with an estimated contract start date of April 16, 2015.

The contract covers secure transportation services for inmates using specially trained personnel and DOT/Federal Motor Carrier Safety Administration licensed vehicles. Wisconsin DOC processes approximately 1,200 inmate transports annually, with recent expenditures of $557,647 in FY13 and $591,467 in FY14. The initial contract term is two years with options for three additional one-year renewals. Awards will be made based on the lowest price per mile for male inmate transport from pickup to drop-off point, with vendors required to include all labor, travel, and insurance costs. The contract requires specialized vehicles with video surveillance, GPS tracking, appropriate restraints, and qualified staff including female security personnel for female inmate transports. Contractors must maintain specific insurance coverage including $2-5 million auto liability depending on vehicle capacity, and comply with federal transportation regulations and HIPAA requirements for handling inmate medical information.

INTRODUCTION, PURPOSE, AND SCOPE

1.1

PURPOSE OF THIS REQUEST FOR BID

The Department of Corrections, hereinafter referred to as the "DOC", through its Purchasing Services Section, hereinafter referred to as "Purchasing," on behalf of Division Of Community Corrections, hereinafter referred to as "DCC," requests bids for the purchase of Extradition Transport and Security Services.

The contractor will provide transportation for inmates in a secure, safe manner from out of state jurisdictions to Wisconsin prison or jail facilities in a specialized secured vehicle. The contractor may also be required to transport inmates from a Wisconsin prison or jail facility to an out of state jurisdiction. This will require contractor to have specially trained personnel and be licensed or credentialed by the Department of Transportation, Federal Motor Carrier Safety Administration. The contractor will be required to handle and transport minimum to maximum inmates in a secured vehicle in a safe manner, protecting the community from the risk of an escape. The contractor will not be required to provide armed transport.

The Wisconsin DOC currently has approximately 1200 inmate transports annually. 68 females were transported in 2013 and 65 females year to date in 2014. Total expenditures for extradition services in FY13 equaled $557,647. Total expenditures for extradition services in FY14 equaled $591,467.

Other State or non-state agencies may use the resulting contract, if agreeable to both the DOC and the vendor, to obtain the benefits of volume purchases and/or reduction in administrative expenses.

As the transport of offenders may involve contractor staff holding prescribed medications of offenders, a Business Associate Agreement (Appendix B) will be required (See Section 7.9).

1.2

CONTRACT TERM

The contract initial term will be for two years, with options to renew the contract for three additional one-year terms. Renewal(s) beyond the initial contract term is contingent upon the performance of the contractor during the contract period and upon availability of funds. These are not automatic renewals. Contracts will be reviewed by the DOC before a decision is made. Any renewal(s) must be authorized by mutual written agreement of the vendor and the state.

1.3

EXECUTED CONTRACT

In the event of contract award, the contents of this RFB (including all attachments), RFB addenda and revisions, and the bid of the successful bidder, and additional terms agreed to, in writing, by DOC and the contractor must become part of the contract. Failure of the successful bidder to accept these as a contractual agreement may result in a cancellation of the award.

In the event of any conflicts or disputes between the parties about the meaning of any part of the contract, the following priority of documents will be used to resolve the conflict or dispute:

State of Wisconsin standard terms and conditions

Final Signed Contract - including any attachments or amendments

Official State of Wisconsin Purchase Order Bidder’s written bid response State of Wisconsin Request for Bid - including any amendments;

Other exhibits/attachments

Successful bidder(s) should retain a copy of this DOC Request for Bid document and their own response to the RFB solicitation, as it becomes part of the awarded contract.

1.4

CANCELLATION AND TERMINATION

This Contract may be terminated for the following conditions:

The DOC may terminate the Contract at any time, with or without cause and without penalty by delivering thirty (30) days written notice to the Contractor.

The DOC has a Vendor Performance Evaluation process for soliciting feed-back from contract users about vendor performance and compliance with contract specifications. Vendor noncompliance with the terms, conditions or specifications that is persistent and/or significantly impacts the quality and performance provided pursuant to the contract may be considered in breach of contract. Negative Vendor Performance Evaluation Surveys may result in non-renewal or termination of contract.

If at any time the Contractor performance threatens the health and/or safety of the DOC, the DOC has the right to cancel and terminate the Contract without notice.

Failure to maintain the required Certificates of Insurance, Permits and Licenses must be cause for Contract termination. If the Contractor fails to maintain and keep in force the insurance as provided in Section 4.4, the DOC has the right to cancel and terminate the Contract without notice.

If at any time a petition in bankruptcy must be filed against the Contractor and such petition is not dismissed within 90 calendar days, or if a receiver or trustee of Contractor's property is appointed and such appointment is not vacated within 90 calendar days, the DOC has the right, in addition to any other rights of whatsoever nature that it may have at law or inequity, to terminate the Contract by giving 10 calendar days notice in writing of such termination.

Failure of the DOC to comply with contract terms, conditions or specifications must provide the sole cause for which the Contractor is entitled to terminate the contract. The Contractor must notify the Department in writing within thirty (30) days after the Contractor becomes aware of the alleged noncompliance with a complete description of the same. If the DOC does not, within forty-five (45) days after its receipt of the Contractor’s notice, either (1) effect a cure or (2) if the noncompliance is not one that can reasonably be cured within forty-five (45) days, develop a plan to cure the noncompliance and diligently proceed according to that plan unto a cure is effected, then the Contractor may terminate the Contract for cause by written notice to the DOC. The Contractor may not terminate the Contract without cause unless express written consent to do so is provided by the DOC.

1.5

VENDORNET REGISTRATION

Department of Administration and State Bureau of Procurement policies no longer require maintenance of bidder’s lists or individual notification of vendors on bidders’ lists. In addition, there is no requirement to post solicitations for bids/proposals in the Legal Notices of the Official State Newspaper. Vendors who fail to register with VendorNet or who register or change/add commodity codes after the posting of a solicitation may not receive notification of procurement solicitations including amendments or cancellations.

The State of Wisconsin’s purchasing information and vendor notification service is available to all businesses and organizations that want to sell to the state. Anyone may access VendorNet on the Internet at http://vendornet.state.wi.us/vendornet/asp/reginfo.asp to get information on state purchasing practices and policies, commodities and services that the state buys, and tips on selling to the state. Vendors may use the same Web site address for inclusion on the bidders list for commodities and services that the organization wants to sell to the state. A subscription with notification guarantees the organization will receive an e-mail message each time a state agency, including any campus of the University of Wisconsin System, posts a request for bid or a request for proposal in their designated commodity/service area(s) with an estimated value over $50,000. Organizations without Internet access receive paper copies in the mail. Increasingly, state agencies also are using VendorNet to post simplified bids valued at $50,000 or less. Vendors also may receive e-mail notices of these simplified bid opportunities.

To obtain information on the state’s bidder registration, visit the VendorNet Web site at http://vendornet.state.wi.us or call the VendorNet Information Center (1-800-482-7813). In the Madison area, call 608-264-7898.

Make sure to select all the appropriate NIGP (Commodity) Codes. Bid lists are generated by NIGP codes.

Consider using a generic email address that is accessed or delivered to multiple recipients (example: bids@xyzcompany.com). This will insure that the bid notice is received.
