About this file

This document is an Assurance of Compliance form from the Pennsylvania Department of Aging, establishing mandatory compliance requirements for contractors receiving Federal financial assistance from the Department of Health and Human Services. The assurance obligates contractors to comply with four primary federal civil rights statutes: Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title IX of the Educational Amendments of 1972, and the Age Discrimination Act of 1975. Each statute is coupled with corresponding Department of Health and Human Services regulations (45 C.F.R. Parts 80, 84, 86, and 91, respectively), prohibiting discrimination based on race, color, national origin, disability status, sex, and age in programs and activities receiving Federal financial assistance. The assurance remains binding on the contractor, its successors, and assignees for the duration of Federal financial assistance receipt and extends to real property, structures, and personal property provided or improved with Federal funds.

The compliance assurance constitutes a mandatory condition for continued receipt of Federal financial assistance and is enforceable through judicial proceedings by the United States. The contractor must identify an authorized signatory with appropriate organizational authority to execute the document, including providing the signatory's title, organization name, address, and execution date. The obligation applies indefinitely to real property or structures used for purposes related to the Federal assistance or similar services, and for the duration of contractor ownership or possession of any personal property provided through Federal funding.
