1.2. Background
The Daytona Beach Pier is the most recognizable landmark on Daytona Beach and has been the center of beach life since the beginning of the community.
The original pier, constructed of palm logs, was built before the turn of the 20th century and extended
600 feet into the ocean. It was built by Thomas Keating and was known as the Keating Pier. It was located at the end of Main Street, where the present pier is located.
On January 20, 1920 a fire destroyed the pavilion and most of the pier. In 1924, Keating sold the remains of the pier to Jeter McMillan who tore it down and began construction of a new pier. The new Pier
Casino opened on June 11, 1925. The pier was 1,000 feet in length and featured a Victorian style building. Its ornate ballroom could accommodate 2,000 dancers and hosted some of the top bands of the day. In addition to dances, the Pier Casino was the scene of charity balls, weddings, beauty contest, social events as well as civic meetings.
During the years of beach racing, some of the pilings were removed to allow race cars to pass under the pier. The Pier Casino was also a popular location for photos of the famous racers who came to Daytona
Beach. Those photos were seen worldwide and helped Daytona Beach to become known as "The
World's Most Famous Beach." The pier has changed ownership several times since McMillan died in
1946. In 2004, it was acquired by the city of Daytona Beach who then leased it to a corporate operator.
In 2009, the city took operational control of the pier, completely refurbished it and sought a long-term, quality tenant for the casino building.
On June 5, 2012, the Daytona Beach Pier reopened and the restaurant Joe's Crab Shack opened its doors and began serving its unique brand of seafood and casual entertainment.
Over the years, the pier has withstood the constant pounding of the Atlantic surf, fire and hurricanes, but it still stands, just as it was built in 1925. However, it currently is only about half as long as it was originally. The Pier has been known as the Ocean Pier, Keating Pier, Pier Casino, Main Street Pier and now the Daytona Beach Pier, but to most people it is simply known as "the pier" - the most recognizable landmark on Daytona Beach and source of many Daytona memories.
The Daytona Beach Pier is located at 1200 Main Street, Daytona Beach, FL 32118, the pier is a contributing property to the Daytona Beach Main Street National Registry Historic District, it is recorded in the Florida
Master Site File, and has been certified by the United States National Park Services as a “Certified Historic
Structure”. The City contracted WGI, Inc. (WGI) to evaluate the structural capacity of the current pier, Request For Proposal #2702RFQ Title: 2702RFQ - Daytona Beach Replacement Pier Consultant perform a feasibility study for the construction of a new pier, and determine what modifications or improvements to the pier and surrounding area can be provided to enhance the Main Street Business and
Entertainment District. WGI completed their scope of services in January 2023, the corresponding report will be included with this RFQ.
The existing pier is a timber framed structure that was constructed in 1925. The pier is constructed with a multitude of timber piles that over the years have been replaced or repaired. WGI performed an analysis of the existing pier and calculations showed the main structural components do not meet current design codes.
The City wishes to preserve the current location of the restaurant over the water and maintain the historical value of the building. Consequently, the new pier will be constructed independently of the restaurant. Based on the analysis of the existing structure, the restaurant’s substructure is not dependent on the adjacent pier components. However, phased under this Contract the CONSULTANT will be tasked with evaluating the restaurants substructure. If applicable, provide recommendations on strengthening the restaurants substructure or providing a monitoring plan of the substructure.
The City entered a lease agreement with the State of Florida Division of State Lands (DSL) on behalf of the
Board of Trustees of the Internal Improvement Trust Fund (TIITF) on May 25, 2001 as a result of the approval of House Bill 891 by the Governor of the State of Florida. The law required that the City acquire ownership of the existing pier and restaurant within five years of the effective date of the act. The City acquired the pier and restaurant in September 2003 and January 2004 respectively to fulfill the initial requirements of the lease. The term of the lease is 35 years meaning the expiration date is May 2036. The lease specifically outlines that non-water-dependent activities may be included as the lease is for the purpose of furthering the City’s downtown redevelopment initiative. This is a deviation from standard SSL leases not implemented through a legislative act. The lease also requires that any modifications to the lease would require a legislative act.

3. SCOPE OF WORK
3.1. Scope of Work
Designs that allow for a "top down" construction method is preferred as it helps to mitigate construction impacts during Turtle Nesting season. Consultant will need to acquire the necessary Federal, State, and
Local Permits to construct the new pier.
3.2. Environmental Permitting
Pre-Application Coordination - The CONSULTANT will attend two (2) pre-application meetings with regulatory agencies to introduce the project and identify any environmental concerns that may be present early in the review process. It is anticipated that the Florida Department of Environmental Protection
(FDEP) and the U.S. Army Corps of Engineers (USACE) will be the permitting agencies. The Florida Fish and
Wildlife Conservation Commission (FWC), U.S. Fish and Wildlife Service (USFWS), National Marine
Fisheries Service (NMFS), Florida State Historic Preservation Office (SHPO), and the U.S. Coast Guard
(USCG) will be the commenting agencies. If Federal Emergency Management Agency (FEMA) funding is pursued, as applicable, CONSULTANT is to ensure compliance with the Endangered Species Act (ESA), Rivers and Harbors Act (RHA), and Magnuson-Stevens Fishery Conservation and Management Act (MSA).
CONSULTANT services to include approaching regulators with an option for the removal and replacement of the existing multi-story restaurant and bar and the potential inclusion of other amenities along the pier.
The purpose of the pre-application meetings is to verify available permitting pathways and obtain agency feedback and comments before application submittal. The pre-application discussion assists the project engineers and permitting staff with any early project design modifications to achieve the lowest form of permitting and assists the agency staff with making timely, well-informed decisions on permit issuance.
Based on agency feedback, CONSULTANT will coordinate with the City to consider alternative design concepts.
Permit Applications - The CONSULTANT will prepare application forms and supporting documentation, including the Environmental Narrative, for state and federal permitting. GIS mapping and analysis will be conducted in support of the preparation of the narrative, which will describe existing conditions and characterize the nature of potential impacts on natural resources as well as avoidance and minimization measures. Regulatory agencies will evaluate the project activities for direct, secondary, and cumulative impacts on natural and water resources. The proposed design will differ from the historic configuration;
therefore, it is anticipated that the following permits will be required:
• USACE Standard Permit; and
• FDEP Joint Coastal Permit with Sovereign Submerged Lands Letter of Consent or Lease.
• Volusia County Health Department
• FDEP for Sanitary and Water
Biological Assessment - Section 7 of the Endangered Species Act (ESA) review is necessary for federal permitting. Development of a Biological Assessment (BA) is recommended to streamline the review process and expedite permit issuance. As a note, the average timeframe for USACE agency staff to begin reviewing an application is approximately 9 months, and the average timeframe for USACE to prepare, submit, and initiate formal consultation with USFWS and NMFS and for the commenting agencies to provide concurrence through a Biological Opinion under Section 7 ESA ranges another 9 to 18 months.
The BA would accompany the USACE application submittal and provide an opportunity for the USACE and associated commenting agencies (NMFS and FWS) to perform Section 7 consultation in a more efficient timeframe. A draft copy of the BA is to be submitted to the City for review and comment. Following City review, the CONSULTANT will respond to one round of City comments before agency submittal.
CONSULTANT will provide revisions in response to agency comments.
It is assumed that compensatory mitigation and/or conservation measures (such as relocation of resources) are not required. If regulatory agencies require conservation or mitigation efforts, such as seagrass mitigation, CONSULTANT will provide a preliminary evaluation of mitigation options and strategies if required. A full mitigation plan or resource relocation plan is not included in this scope but may be provided as an optional service.
Requests for Additional Information - Requests for Additional Information (RAI) may be received from the consulting or permitting agencies via telephone, email, or written correspondence. CONSULTANT will respond to up to four (4) total RAIs as determined by of the City, and coordinate with the agencies via email and teleconference. One field meeting with representatives of agency personnel (FDEP) is anticipated to be required to confirm benthic resource findings.
3.3. NEPA Documentation
Consultant to prepare and submit on behalf of the City all necessary National Environmental Policy Act
(NEPA) Documentation for the project.
Natural Resource Evaluation - A Natural Resource Evaluation (NRE) should be prepared for projects that meet or involve one or more of the following:
• Federal listed and candidate species/critical habitat consultation (informal or formal)
• Wetland impacts require either a standard/individual or regional general permit (SAJ - 92)
• Substantial adverse effects to Essential Fish Habitat (EFH)
If a NRE is required for one resource (species, wetland, or EFH), a section for the other resources present in the project area should also be included. For example, a project requires the development of an NRE because of species consultation, but has minor wetland impacts, and no EFH impacts. The NRE developed should include a Protected Species and Habitat and Wetlands Sections with a statement in the project overview that EFH is not applicable. The Protected Species and Habitat section needs to include information sufficient to complete agency consultation and the Wetlands section should include a discussion of the minor wetland impacts.
For projects that have natural resource impacts that do not exceed any of the thresholds listed above, a technical memorandum discussing the impacts may be sufficient.
NREs require review by the Office of Environmental Management (OEM) regardless of federal Class of
Action. NREs for State Environmental Impact Reports (SEIRs) or Non-major State Actions (NMSAs) will not require OEM review.
3.4. Grant Services
The City would like to pursue FEMA Grant assistance with the construction of this project. Grants are the principal funding mechanism FEMA uses to commit and award federal funding to eligible state, local, tribal, territorial, certain private non-profits, individuals and institutions of higher learning. Consultant to prepare and submit on behalf of the City the necessary grant application package to FEMA. In addition, the Consultant to provide other viable grant options for consideration and potential acquisition.
3.5. Pre-Design Services
Consultant to review all three options from the WGI Feasibility Study and present the material to City
Commission after updating the corresponding cost estimates and ranking the alternatives, including any new alternative(s). Address related questions from City Commission regarding each pier configuration alternative. Request City Commission to select which option they would like to move forward with the design.
3.6. Pier Structural Design
The Consultant shall design and prepare construction drawings for the replacement fishing pier and tying the new pier into the restaurant location or if permittable and selected by City Commission the removal and replacement of the multistory restaurant. 5.8. GENERAL REVIEW PROCEDURES
The Purchasing Code, Chapter 30, Code of the City of Daytona Beach, sets forth the general review procedures for competitive sealed Offers. Under the Purchasing Code, the City Manager is required to evaluate and rank Responsive Proposals in accordance with the criteria identified in the Solicitation.
Before submitting a recommendation for final action on this Solicitation to the City Commission, the City
Manager is authorized to “shortlist’ and negotiate with one or more of the Proposers who submitted the highest ranked Proposals. As part of these negotiations, the City Manager may request revised Offers from shortlisted Proposers.
The City Manager has adopted a policy delegating the task of initially ranking Responsive Offers to a
Selection Committee. The Selection Committee may require personal interviews with Proposers before submitting its recommendations to the City Manager.
5.9. LOCAL PREFERENCE
Pursuant to the Purchasing Code, preferences may be given in the evaluation of Responsive Offers to Local
Vendor. A “Local Vendor” is a Proposer which has maintained a permanent place of business with full-time employees within the city limits of the City of Daytona Beach for a minimum of six months prior to the date Offers were received for the Contract at issue, which generally provides from such permanent place of business the kinds of services solicited, and which at the time of the Solicitation fully complies with state and local laws, including City zoning and licensing ordinances.
In order to qualify as a Local Vendor, the Proposer must submit a properly completed Local Vendor affidavit as part of its Proposal. A Proposer who fails to properly complete and sign this affidavit or submit it with the Proposal will not be considered for local preference in this Solicitation. The City is the ultimate arbiter as to whether the Proposer qualifies as a Local Vendor; and the City may require the Proposer to submit additional documentation verifying that the Proposer qualifies as a Local Vendor.
A Proposer qualifying as a Local Vendor will be given the following Preferences:
A. At the City’s discretion, the Proposer may be given bonus points of up to 10% of the total available points used to score Offers for ranking purposes. The exact percentage awarded may be adjusted based on the extent of work to be subcontracted to non-local Vendor.
B. After the Selection Committee has evaluated and ranked Offers, if the highest-ranked Local
Proposer’s Proposal would not otherwise be among the list of the highest–ranked Proposals submitted to the City Manager, the list will be modified to include the highest-ranked Local
Vendor’s Proposal. In addition, if the evaluation criteria included price, all of the Proposers on the modified short list will be given the opportunity to submit best and final fee schedules; and final ranking provided by the Selection Committee will be based on the best and final Offers. For purposes herein, the reference to “best and final” will not serve to alter the City Manager’s authority from requiring a short listed Proposer to submit a revised Offer.
Note: If this Request for Proposals will use Federal Funding, this section will not apply.
5.10. REJECTION OF OFFERS
The City reserves the right to reject any or all Proposals in whole or in part and to award by items, parts of items, or by any aggregate group of items specified. The City also reserves the right to waive technical defect when in its judgment the best interests of the City thereby will be served.
5.11. AWARD
The award will be made by the City to the Proposer most qualified and offering the best value to the City, which will be determined by evaluation of Proposals using the evaluation criteria contained in the
Solicitation, and in accordance with applicable rules and regulations governing the purchase and Contract adopted and established by the City, and the State of Florida.
Any Contract resulting from this Solicitation may, in the alternative, be awarded by the City of Daytona
Beach Community Redevelopment Agency (CRA). Therefore, any Offers submitted in response to this
Solicitation shall be deemed to be Offers to the CRA as well as the City. Any final written contract may be with the CRA instead of the City, and in such instances, any required insurance, performance and payment bonds, may be required to run in favor of the CRA in addition to or in lieu of the City.
5.12. SELECTION PROCESS
For the purpose of selecting the most qualified Proposal, the City will use a competitive selection process as set forth in pertinent City and State procurement requirements. The procedure will involve the following steps:
A. The City will advertise and email notice of formal Requests for Proposals to interested Proposers.
The City’s Selection Committee will review, rank, and shortlist all Proposals received by the established deadline for submission. Oral presentations by the short-listed Proposers to clarify their Offers may be required. These presentations will serve to explain implementation techniques integral to the written Proposal. Subsequent to the receipt of Proposals, the City may schedule a time for each requested oral presentation at a place convenient to the City.
B. The City’s Selection Committee will then rank each Proposal and prepare a recommendation for approval by the City Manager. Upon receipt of the City Manager’s approval, the City’s Project
Manager shall negotiate a contract with the highest ranked Proposer(s) approved by the City
Manager. Should the Project Manager be unable to negotiate a satisfactory contract with the any of the shortlisted Proposers, the City Manager, or designee, shall terminate such negotiations with any or all of the shortlisted Proposers and begin negotiations with remaining Proposers based on ranking, until negotiations are successful or this Solicitation is cancelled.
C. The City Commission has the sole authority to bind the City to the terms and conditions of a contract that has been approved in a public meeting of the City Commission. The City
Commission reserves the right to modify or reject any contract for the acquisition of goods and/or services submitted to it for consideration.
5.13. LICENSES, PERMITS, AND FEES
All Proposals submitted shall include in the price the cost of any business or professional licenses, permits or fees required by the City and any agency having jurisdiction over the Services solicited through this
Request for Proposal.
5.14. PATENT INFRINGEMENT
By submission of a Proposal, the Proposer certifies that the Services to be furnished will not infringe any valid patent, copyright, or trademark and the successful Proposer shall, at his/her own expense, defend any and all actions or suits charging such infringement and hold the City harmless in case of any such infringements.
5.15. TAXES
All Proposals shall be exclusive of federal taxes. Tax exemption certificates will be furnished upon request.
5.16. FLORIDA PUBLIC RECORDS LAW
Sealed Offers received by the City pursuant to the Request for Proposals will be temporarily exempt from disclosure in accordance with Florida’s Public Records Laws. F.S. §119, states that Offers are not public record for 30 days from the date of the opening of the Offers or the date a Notice of Intent to Award is posted, whichever is first. Thereafter, all Offers will be open for a personal inspection by any person pursuant to Public Records Law.
If the Proposer believes that the Offer or any portion thereof is permanently exempt from disclosure under the public records laws, the Proposer must state the grounds for this position in CAPITAL LETTERS in a certified letter addressed to the Purchasing Agent and received at least 3 days prior to the Offer opening. The Proposer will be contacted prior to the opening of the Offer and a determination will be made as to whether or not it is exempt prior to opening. If a determination is made that it is not exempt from disclosure, the Proposer may in writing request the return of the sealed Proposal.
5.17. QUALIFYING PROPOSERS
Prior to awarding of Offer, the City may require submission by Proposer of complete financial statement and questionnaire describing Proposer’s financial ability and experience in performance of similar work.
