About this file

This is a Solicitation Addendum issued by the North Carolina Department of Administration, Facility Management Division, for Invitation for Bid (IFB) #13-DOA2355908792 regarding the procurement of waste and cardboard compactors for the DHHS Building in Raleigh, NC. The solicitation seeks one waste compactor and one cardboard compactor, specifically Marathon RJ-250SC 34 ground-fed compactors with 41" x 58" feed openings and continuous feed capability, to replace existing open-top dumpsters. The non-mandatory site visit occurred on September 3, 2026 at 10:00 a.m. ET at the DHHS Building, 1915 Health Services Way, Raleigh, NC 27607. Written questions were due by September 8, 2026 at 2:00 p.m. ET, with state responses provided in this addendum dated September 10, 2026. Bid opening is scheduled for September 15, 2026 at 2:00 p.m. ET. The contract term runs from final execution through the warranty period, not to exceed three years. Contract award is anticipated by September 30, 2026.

Vendors must submit separate line-item pricing for each compactor unit, installation services, and applicable tariff surcharges under FOB Destination terms. Delivery must be completed within thirty consecutive calendar days after purchase order receipt to the DHHS loading dock, accessed through a 14-foot-tall roll-up door. A minimum twelve-month warranty or manufacturer's warranty, whichever is longer, is required, covering defective parts replacement, labor, freight, and technician travel at no cost. Vendors must be registered with the North Carolina Secretary of State prior to contract execution, maintain North Carolina business registration in good standing, comply with E-Verify requirements, provide three customer references for the exact model offered, and complete financial stability certification. Award will be made to the lowest responsive bid meeting specifications. No portion of work may be subcontracted without prior written state consent. The solicitation is a one-time purchase, and the State reserves the right to make separate awards, reject any bids, or cancel the IFB entirely.

2. The following are questions received about the Solicitation and the State’s response to those questions:

Question

Document Section Vendor Question State’s Response

1 Scope Is this a one-time purchase? Yes 2 Page 5, Section 1.1 Contract Term. This section says the Contract Term will be through the warranty period stated by the awarded vendor, but no longer than 3 years. During this term, could the DOA make additional purchases? How does the awarded vendor need to handle price changes during the term of the contract?

Any additional purchases outside of the scope of this contract would follow standard procurement rules for new procurement or amendment at the time of need.

3 Scope Are you replacing existing compactors or is this new installation?

Replacing current open top dumpsters

4 Scope If replacing, is the awarded vendor responsible for uninstalling the old compactors and hauling away?

No, FMD Contract Administrator will coordinate with FMD contracted waste removal company to remove current open top dumpsters upon delivery schedule of the new compactors.

5 Scope Will you provide pictures of the installation site for vendors who cannot attend the site visit?

See attached to this addendum

6 Page 14, Section 4.12

Is the requirement to register with the NC Secretary of State. Why is this necessary for a Foreign Business? After reading 57D-7-01 as directed. This section provides a list of exclusions that do not constitute "transacting business" in NC. The sections that apply to this opportunity are (5) "soliciting or procuring orders, whether by mail or through employees or agents or otherwise, where the orders require acceptance to be made outside of the territory of this State to becoming binding contracts" and

(9) "Conducting an isolated transaction completed within a period of six months but not repeated transactions of a similar nature."

The requirement of a foreign business to register with the NC Secretary of State is a statutory requirement to ensure accountability, legal compliance, and transparency. Any exceptions to the statutory requirement will be considered upon contract award.
