Attachment 2: Conflict of Interest, Offeror

Conflicts of Interest (Offeror)

Submit sufficient information for Treasury to be able to evaluate any conflicts of interest, to include the following (Contractor should note that there is no page limit to this section):

1. A description of all organizational conflicts of interest and potential conflicts of interest of the Contractor, any proposed subcontractor, or any proposed consultant, addressing each conflict or category of conflicts separately in a detailed manner (e.g., by practice type, client industry segment, etc.), and clarify whether each such conflict or conflict category is actual, potential, or apparent.

2. A written detailed plan to mitigate all organizational conflicts of interest of the Contractor, its proposed subcontractors, and proposed consultants. Please include specific mitigation control procedures for each conflict or conflict category identified. Please do not cite to external documents unless you excerpt the relevant text from those documents into the mitigation plan (e.g., codes of conduct, ethics policies, etc.).

3. A written detailed plan to identify and mitigate all personal conflicts of interest of the personnel of the Contractor or its proposed consultants who will likely participate in a substantial manner in matters under a resultant contract Contractor. The information shall be no less extensive than that required of certain new federal employees under Office of Government Ethics Form 450 (http://www.usoge.gov/forms/form_450.aspx). Please include specific identification and mitigation control procedures. Please do not cite to external documents unless you excerpt the relevant text from those documents into the mitigation plan (e.g., codes of conduct, ethics policies, etc.).

4. If the Contractor believes neither it nor its proposed subcontractors or consultants have any conflicts of interest, provide an explanation of what such belief is based upon.

5. Information concerning all other business or financial interests of the Contractor and its related entities, which could conflict with the Contractor’s obligations under this Task Order. Such information shall include a description of all current and contemplated matters the Contractor is involved in or plans to undertake, either on its own behalf or for a client, where the subject or work product of the engagement touches or will touch grant applicants directly (e.g., because work is performed for grant applicants or the work impacts the administration of a grant applicants’ program) or indirectly (e.g., because the work product from any resultant contract is or is likely to become part of an applicant’s program).

6. Information concerning all other business or financial interests of any of the Contractor’s proposed subcontractor(s) and consultant(s), and those of any of such proposed subcontractor(s) or consultant(s) related entities, which could conflict with the Contractor’s obligations under any resulting Task Order.

7. If the Offeror has no Conflicts, the proposal shall include a statement to that effect.

Please note that statements of conflict of interest, including plans to mitigate, may need to be amended or updated if/as subcontractors and consultants are engaged.
