INSTRUCTIONS TO BIDDERS

CITY OF BRISTOL, CONNECTICUT 06010

The following instructions and specifications shall be observed by all Interested Contractors:

1. Time and Place of Submission Opening Submissions will be received until 1:30 pm, October 7, 2026, at the Purchasing Department, with an office at 111 North Main Street, Third Floor, Bristol, CT 06010. Submissions may be withdrawn 90 days after opening if no award has been made.

The owner/operator shall furnish for the City of Bristol Purchasing Department a completed Snow Plow Vehicle Data Sheet (2026-2027 Season) for EACH vehicle to be considered on or before October 7, 2026, at 1:30 pm. All other required documentation must be submitted on or before November 9, 2026.

Please note that all information is required to consistently reflect the vehicle owner information; i.e. if a vehicle is owned by an individual, LLC, or corporation, then corresponding registration and insurance shall be secured by the named vehicle owner, and payment for services rendered will be made to the named vehicle owner.

No bid bond is required for submission. Failure of a contractor to perform services as specified will constitute authority for the City of Bristol to pursue the services on the open market. The contractor shall agree to promptly reimburse the City for excess cost of such services.

2. Intent This document intends to secure submissions from individuals and/or companies desiring consideration for assisting the City of Bristol in snow plowing operations for the 2026-2027 Winter Season.

ALL OPERATORS OF VEHICLES SELECTED FOR THE ACTIVE AND RESERVE LISTS MUST ATTEND A

SNOWPLOW OPERATORS MEETING THAT WILL BE HELD ON MONDAY, NOVEMBER 9, 2026 AT THE

PUBLIC WORKS YARD, VINCENT P. KELLY ROAD AT 7:00 PM. Active and/or reserve list contractors who, for legitimate business reasons, cannot send drivers and trucks to this meeting must send a responsible representative.

Be advised that purchase orders as issued by the Purchasing Agent, together with these specifications, shall serve as the entire contract between the City and any entity engaged in snow plowing operations.

3. Scope of Services The City of Bristol Public Works Department is seeking the services of qualified individuals and/or companies to assist in snow plowing operations for the 2026-2027 Winter Season. The City intends to contract for forty-four (44) trucks with operators, consisting of up to eighteen (18) small four-wheel drive trucks, Ford F350 or equivalent, with a Gross Vehicle Weight (GVW) of less than 23,999 lbs.; and twenty-six (26) or more large trucks, dump or tractor type with a GVW of at least 24,000 lbs. The

City of Bristol, Connecticut 2027-021 Snow Plowing Operations Purchasing Department Specifications - Page 2 of 7 number of trucks with operators to be assigned to the active list will be limited, with preference given to larger trucks (i.e., if more than 26 large truck submissions are received, the Public Works Department reserves the right to accordingly reduce the number of small trucks contracted). A maximum of four (4) 3-or-4 axle dump trucks may be accepted only, if necessary, to reach the needed number of large trucks.

All trucks must have a body suitable for carrying a ballast load (furnished by owner) or shall have other suitable ballast, such as securely attached concrete blocks.

If the City receives more responses than needed for operations, a reserve list of at least five (5) smaller trucks (less than 23,999 lbs.) and five (5) larger trucks (at least 24,000 lbs.) will also be established to fill in when vehicles from the active list are unavailable. Reserve trucks are required to conform to the same specifications required of trucks selected for the active list.

Please note that in selection of vehicles for use within this program, preference is given to vehicles with GVW weights as follows:

1. between 24,000 and 55,000 lbs.

2. between 18,000 and 23,999 lbs.

3. greater than 55,000 lbs.

4. between 10,000 and 17,000 lbs.

5. between 8,000 and 9,999 lbs.

Notwithstanding the above provision, assignment of vehicles to the Active List will first be made in sequence of date and time of receipt of submission to the Purchasing Department; vehicles accepted after fulfillment of the Active List will be included on the list of reserve vehicles. In establishing the active and reserve lists for trucks, additional consideration will be given to past performance and experience in City snow plowing operations. Payment for snow plowing services rendered will be for only those hours actually worked based on the following rates as established by the Board of Public Works:

Current Rates as of September 17, 2026:

Trucks with GVW between 8,000 lbs. and 9,999 lbs. --- $120.00/hour

Truck with GVW between 10,000 lbs. and 17,999 lbs. --- $190.00/hour

Truck with GVW between 18,000 lbs. and 23,999 lbs. --- $200.00/hour

Truck with GVW greater than 24,000 lbs. --- $255.00/hour

3-yard pay loaders with angle plow not less than 12 ft. --- $255.00/hour

3-yard pay loaders with a 3-yard bucket --- $255.00/hour

Please note that the rates posted above include a Fuel Adjustment Factor (Gas and Diesel) that is subject to change based on actual fuel cost as reported by the State of Connecticut Procurement Services Division (“CPSFP”) via the website below.

Purchasing Department Specifications - Page 3 of 7

Fuel Adjustment Factor

(Factor based on CPSFP Fuel Cost posted on 09/16/2026: Gas $5.4533/gal and Diesel $5.4990/gal) Gas Fuel Adjustment Factor = CPSFP New Haven Harbor Gasoline Prices - 5.4533 Diesel Fuel Adjustment Cost = CPSFP New Haven Harbor Diesel Fuel Prices – 5.4990

CPSFP New Haven Harbor Costs are indicated on the website below:

https://biznet.ct.gov/fuelprice/

Please note that the price contained within the Connecticut Fuel Cost Report is wholesale cost, not the cost at the pump, and is used by the City of Bristol for comparative purposes. For example, the above database cost on September 16, 2026 was $5.4990 per gallon for diesel and $5.4533per gallon for gasoline, and the cost at the pump was $6.34 per gallon for diesel and $4.49 per gallon for gasoline.

The purpose of the adjustment factor is to compensate contractors if the cost of fuel increases.

No adjustment will be made if the price decreases below the index.

Calculated rates are determined based on the following

The rate for trucks between 8,000 lbs. and 9,999 lbs. will be

120.00 + (6.74 x (CPSFP{day of storm} minus CPSFP{Sept 6 price})) = 8,000 to 9,999 lb. rate

The rate for trucks between 10,000 lbs. and 17,999 lbs. will be

190.00 + (7.86 x (CPSFP{day of storm} minus CPSFP{Sept 6 price})) = 10,000 to 17,000 lb. rate

The rate for trucks between 18,000 lbs. and 23,999 lbs. will be

200.00 + (7.85 x (CPSFP{day of storm} minus CPSFP{Sept 6 price})) = 18,000 to 17,000 lb. rate

The rate for trucks greater than 24,000 lbs. will be

255.00 + (7.85 x (CPSFP{day of storm} minus CPSFP{Sept 6 price})) = greater than 24,000 lbs.

and loaders

A representative example is shown as follows:

1. The hourly rate paid for a 20,000 GVW vehicle will in part be based on the fuel cost on the day of snow plowing. For example, if the price of diesel on the index increases fifty cents from $4.999/gal to 5.4990, the diesel fuel adjustment factor will be 0.50 and the hour rate paid for a 20,000 GVW would be $206.60 per hour.

Purchasing Department Specifications - Page 4 of 7

200.00 + (7.86 x (6.34 –5.4990)) = 200.00 + (7.85 x 0.841) = 200.00 + 6.60 = 206.60

4. Requirements A copy of the City's Rules and Regulations for Hired Plows and Drivers for snow plowing operations is included for reference in Attachment A. Drivers must conform to all requirements outlined in Attachment A, and must have all documentation on file with the Purchasing Department. Failure to supply required documentation may result in the contractor being removed from consideration of service.

All work shall be performed in a professional manner, consistent with trade standards. The City shall be sole judge in determining the acceptability of all work performed under this contract. Failure to maintain an acceptable level of quality and responsive service will be documented by the Public Works Department; one (1) or more documented instances shall be grounds for termination of this agreement, and will result in the contractor being debarred from provision of service for a period of up to two years.

The City of Bristol debarment policy is available via the following link:

http://www.bristolct.gov/DocumentCenter/View/11910

All trucks will be required to have either a cellular telephone or two-way radio communication to another vehicle that can be contacted by phone. Trucks must also have an operational auxiliary 12V plug [cigarette lighter type receptacle] for a portable GPS system to be plugged into if/when a truck is assigned a GPS unit. As a trial this year, the City may periodically and randomly assign a GPS unit to one or more trucks during a contracted storm

Vehicles being considered for the active or reserve lists may require an inspection by the City.

Arrangements for vehicle inspections shall be made through the Public Works Superintendent of Equipment Maintenance James Divirgilio at 1-860-584-7792 x 3, if notification is made by the City that the vehicle is being considered for either the active or reserve lists.

All owners and/or operators are also reminded of the FHWA drug testing rules for all drivers subject to CDL requirements. Companies with 50 or more drivers shall have implemented these rules on or before January 1, 1995. Companies with less than 50 drivers shall have implemented the rules on or before January 1, 1996.

All permits, licenses and insurance necessary for prosecution of work shall be secured by Contractor.

All work done and equipment used shall comply with all pertinent O.S.H.A., Federal, State, and Local regulations.

5. Active List Trucks selected for the active list will be guaranteed a minimum total payment for the entire winter season of 2026-2027 based on the following: $1,000.00 for selected trucks between 8,000 lbs. and 17,999 lbs. (GVW), and $1,500.00 for selected trucks greater than 18,000 lbs. (GVW); provided that each vehicle on the active list satisfies the conditions outlined in Attachment B. Please note that trucks selected for the reserve list will not qualify for the guaranteed minimum payment.

8. Termination The Contract may be terminated by the city if at any time, work is unnecessarily delayed, willful violations of Contract conditions exist, the contractor fails to follow direction provided by the Streets superintendent or his designee, or the conditions are being executed in bad faith. The city's written termination notice to the Contractor will allow five (5) days thereafter to commence corrective measures satisfactory to the City. In the event of non-compliance, the City shall notify the Contractor in writing to immediately discontinue any further work. Subsequently, the City shall take the necessary action to complete the remaining contract work.

Purchasing Department Specifications - Page 6 of 7 declares that the contractor does not discriminate on the basis of race, color, religion, gender, national origin or age and which specifies goals and target dates to assure the implementation of equal employment. 10. Award Considerations The Purchasing Agent reserves the right to reject any or all submissions, to waive any informality in submissions and unless otherwise specified to buy any part or the whole from one or more bidders when it is to the City's best interest to do so.

Determination of the best interests of the City shall include consideration of active or pending civil litigation between the City and any firm (or its subcontractor or supplier) submitting a bid to the City.

Additionally, the City shall take into consideration tax debt obligations that are in arrears for more than one year. The City further reserves the right to garnish amounts due, for the purpose of resolving said tax obligations.

The individual signing this submittal hereby declares that no person or persons other than members of his/her own organization are interested in this Project or in the contract proposed to be taken; that it is made without any connection with any other person or persons making a proposal for the same work and is in all respects fair and without collusion or fraud; that no person acting for or employed by the City of Bristol is directly or indirectly interested therein, or in the supplies or works to which it relates or will receive any part of the profit or ant commission therefrom in any manner which is unethical or contrary to the best interest of the City of Bristol.

Repeated failure to report for plowing operations on time may result in removal from the list of active drivers and trucks available for snow plowing operations.

5) No trucks will be allowed to commence snow plowing operations without ID signs, a full ballast load, full fuel tanks, and tire chains in place. Four-wheel drive vehicles equipped with snow tires on all wheels may commence plowing operations without chains with the prior consent of the City Supervisor.

11) Equipment breakdowns shall be promptly reported to the City Supervisor or the City Yard. All repairs shall be the responsibility of and at the expense of the truck owner or contractor. Equipment breakdowns that extend beyond sixty (60) minutes may result in an adjustment of hours paid and/or release from the plowing operation.

12) Hired plows will be compensated based on the actual hours worked. INVOICES SHALL BE SUBMITTED NO

LATER THAN THIRTY (30) DAYS FROM PROVISION OF SERVICE. The City’s fiscal year ends annually on June 30th, and funds available for payment of snow plowing obligations prior to that date are no longer available on July 1st or thereafter. Invoices received after June 15th will not be considered for payment.

Further, the operator and contracting company/individual will be responsible for any damage the GPS unit sustains while the unit is in their possession. An adjustment of hours paid and/or release from the plowing operation may result if the operator and/or contracting company/individual fails to keep an assigned GPS unit plugged in and operational or the GPS unit is damaged while in the possession of the operator and/or contracting company/individual.

1. Trucks not available at all when called. Time reduction equal to the average number of hours worked by all trucks responding to the call and plowing until released.

2. Trucks not responding within one-half hour of the call. Time reduction is equal to response time minus one-half hour.

3. Trucks not working continuously until released. Time reduction equal to unpaid down time plus time from early release to average release time.

4. If the City issues/assigns a portable GPS unit to a truck and the operator and/or contracting company/individual fails to keep the GPS unit plugged in and operational at all times during the contracted time of the storm.

5. The GPS unit is damaged while in the possession of the operator and/or contracting company/individual.

Payment will be made in May 2027 for the difference between the adjusted guaranteed minimum and the total accumulated payments due for plowing services rendered for the time period from October 7, 2026, through April 15, 2027; provided such total is less than the adjusted minimum.
