UNIT PRICED CONTRACT – SMALL WORKS PROJECT
CLARK REGIONAL WASTEWATER DISTRICT (District) reserves the right to cancel this request or reject any and all quotations received or to waive any informalities and irregularities if it determines that such action is in the best interest of the District.
Clark Regional Wastewater District code chapter 2.32, RCW 57.08.050, and RCW 39.04.151-152 outlines the requirements for obtaining written quotations, and the requirements for formal bids (requiring advertising and public bid opening). In brief, the District obtains quotations for public works projects or work estimated to cost $350,000 or less. If the estimated cost of the project or work is over $350,000, the formal bid process must be followed.
Quotations are to be submitted on the forms provided for this purpose, using the District’s procurement portal. Quotations submitted using any other method of delivery or received after the designated time will not be accepted.
After an award is made, the Bid Tabulation shall be posted to the District’s procurement portal. Bid quotations shall be open to public inspection and available upon request.
The Unit Priced Contract will be awarded to the lowest responsible bidder whose quotation is responsive conforming to the solicitation.
It is the intent of the District to award a contract to the lowest responsive and responsible bidder.
In accordance with RCW 39.04.350, before award, the bidder must meet the following bidder responsibility criteria to be considered a responsible bidder. The bidder may be required to provide the District with documentation demonstrating compliance with the criteria. The bidder must:
a) At the time of quotation submittal, have a current certificate of registration as a contractor in compliance with chapter 18.27 RCW;
b) Before award of contract, have a current Washington Unified Business Identifier (UBI) number;
c) Before award of contract, if applicable:

2. Have a Washington Employment Security Department number, as required in Title
50 RCW;
3. Have a Washington Department of Revenue state excise tax registration number, as required in Title 82 RCW;
d) At the time of award of contract, not be disqualified from bidding on any public works contract under RCW 39.06.010 or 39.12.065(3).
e) At the time of award of contract, have received training on the requirements related to public works and prevailing wage under chapters 39.04 and 39.12 RCW, unless exempt from training pursuant to RCW 39.04.350(1)(f).
f) Within the three-year period immediately preceding the date of the solicitation, not have been determined to have willfully violated any provision of chapter 49.46, 49.48, or 49.52 RCW.
Small Works Unit Priced Contract 4
Pursuant to RCW 39.06.020, the bidder who is awarded the contract must verify responsibility criteria as listed in a) – f) above for each first-tier subcontractor, and a subcontractor of any tier that hires other subcontractors must verify responsibility criteria for each of its subcontractors.
Verification shall include that each subcontractor, at the time of subcontract execution, meets the responsibility listed in a) – f) above and possesses an electrical contractor license, if required by chapter 19.28 RCW, or an elevator contractor license, if required by chapter 70.87 RCW. This verification requirement, as well as the responsibility criteria, must be included in the project contract and in each subcontract of every tier.
The bidder's attention is especially called to the following identified forms. This checklist has been prepared and furnished to bidders as an aid in preparing and including all necessary supporting information with their quotation. The District does not represent or warrant that the checklist is complete or accurate, and the sole responsibility for compliance with all requirements remains with the bidder.
By signing the signature page of the quotation, the Contractor acknowledges and agrees to the terms and conditions of each of the following forms, included in the quote documents.
Supplemental Bidder Responsibility Criteria. District reserves the right to request documentation. Failure to provide responses to each of the supplemental responsible bidder criteria listed will render the bid non-responsive and therefore void.
Proposal. Show prices in legible figures (not words) written in ink or typed. Where conflict occurs unit price shall prevail.
Your quotation will be considered irregular and will be rejected if:
- The unit price is left blank
Your quotation shall be considered non-responsive and therefore, void if:
- Figures are illegible
- Minimum bid requirements are not met (when applicable)
Acknowledgement of Addenda. In the space provided on the Addenda
Acknowledgement Form, the Bidder shall confirm that all Addenda have been received.
Failure to comply with this provision will render the quotation non-responsive and therefore void.
The bidder is solely responsible for obtaining and learning of Addenda. The District will provide no accommodation to bidders who fail to check for addendums and submit inadequate or incorrect responses.
Such information may be obtained from the District’s procurement portal at https://mrscrosters.bonfirehub.com. If a bidder has not previously done so, the bidder will need to create a free user account. If assistance is needed with access to or registration on the portal, please contact Trish Peters at (360) 719-1683 or tpeters@crwwd.com.
Certification of Compliance with Wage Payment Statutes. The bidder shall submit a sworn statement, on a form provided by the District, that they have not willfully violated wage payment laws within the three-year period immediately preceding the date of the bid solicitation (RCW 39.04.350).
Proposal Signature Page. Failure to execute the “Proposal Signature Page” at the end of this proposal packet will cause the bid to be considered irregular and therefore to be rejected. The person signing the Proposal on the Bidder’s behalf shall have the authority https://mrscrosters.bonfirehub.com/ mailto:tpeters@crwwd.com
Small Works Unit Priced Contract 5 to speak on the entity’s behalf and sign the proposal, forms, certifications, and contracts required herein. Upon request, the Bidder shall provide proof of such authority.
1. The successful bidder will be expected to meet the Small Works Roster requirements prior to award.
2. The successful bidder will be required to meet the following:
a) Payment and Performance Bond
Quotations Under $50,000 Unless waived by the District in accordance with RCW 39.04.155(3)(b), a payment and performance bond shall be executed by the successful bidder and a surety company licensed to do business in the State of Washington, on the required District form, within ten (10) business days after the award date.
Quotations of $50,000 to $150,000 A payment and performance bond shall be executed by the successful bidder and a surety company licensed to do business in the State of Washington, on the required District form, within ten (10) business days after the award date.
For purposes of establishing the bond amount, the District contemplates that the maximum amount of any Work Orders that will be issued and outstanding at any time will not exceed $100,000. Therefore, the District will accept a payment and performance bond amount of $100,000 as being sufficient under the Unit Priced Contract. If the District subsequently requests a payment and performance bond in excess of $100,000, the District will pay the incremental increase in bond costs greater than $100,000.
Quotations Over $150,000 A payment and performance bond shall be executed by the successful bidder and a surety company licensed to do business in the State of Washington, on the required District form, within ten (10) business days after the award date.
b) Prevailing Wage
If awarded the project, the contractor and each subcontractor shall complete or have on file, with the District, a current "Statement of Intent to Pay Prevailing Wages" before payment will be made for work performed. Prevailing wage rates must be updated annually, using the rates in effect at the beginning of each contract year. Statements of Intent to Pay Prevailing Wages and Affidavits of Wages Paid must be submitted annually for all work completed during the previous 12 months, as required in RCW 57.08.050(6)(e). These forms are available from Washington State Department of Labor & Industries and can be filed electronically at http://www.lni.wa.gov/TradesLicensing/PrevWage/WageRates/default.asp.
The Contractor may be required to submit weekly/bi-weekly Certified Payrolls to the District upon request. The Contractor is required to keep Certified Payrolls on file for a minimum of three years.
The final release with Labor & Industries (LNI) will be processed at the end of the contract. If the contract is extended a year for a total of two years, the final release with LNI will be after the two year period, unless otherwise authorized by law. Work order payments will be processed as the work is completed.
c) Industrial Insurance http://www.lni.wa.gov/TradesLicensing/PrevWage/WageRates/default.asp
Small Works Unit Priced Contract 6
The Contractor, and any subcontractors that may perform work on this project, are required to have their Labor & Industries Industrial Insurance Premiums current. The District reserves the right to withhold final payment if the Contractor fails to provide proof of a current Industrial Insurance account for themselves and/or their subcontractors.
d) Retainage
Retainage will be administered in accordance with chapter 60.28 RCW.
Quotations Under $50,000 Retainage is not held.
Quotations of $50,000 and Over There will be reserved and retained from monies earned by the Contractor on estimates during the progress of the improvements of work, a sum equal to five (5) percent of all such estimates.
In lieu of withholding retainage in accordance with RCW 60.28.011, the Contractor may provide a retainage bond. For purposes of establishing the bond amount, based on the District’s contemplated value of work, the District will accept a retainage bond amount of $5,000 as being sufficient. This equates to five (5) percent of the contemplated value of work. Any retainage amount that would otherwise be due under RCW 60.28.011 shall be waived as permitted by RCW 39.04.152(5).
Release of Retainage Retainage will be held and released in accordance with chapter 60.28 RCW, which includes the requirement that the Contractor submit all affidavits of wages paid and District receives the releases required by applicable statutes and regulations.
3. The District will not be responsible for any errors in proposals. Bidders will not be allowed to alter proposals after the submittal deadline.
4. The applicable period of the Contractor’s quotation and its prices shall be one (1) year, commencing on the date of award. The District reserves the right to offer one (1) additional one-year extension. If the extension would be in the best interest of the District, in consideration of the market conditions, the District will allow increase/decrease of the actual cost of a product offered or used as part of the contract. The adjusted price will be approved at the beginning of the extension, and must be firm for the remainder of the contracted period.
Suppliers shall provide, prior to the extension, documentation of price for the year’s extension.
5. Quotation Award: Receipt of an official award letter from the District will evidence the acceptance of a quotation. No other act of the District shall constitute acceptance of a quotation.
6. No bidder may withdraw its bid after the hour set for the Bid due date thereof, unless the award of contract is delayed for a period exceeding forty-five (45) calendar days. If it is determined to be in the best interest of the District, the District reserves the right to request an extension of bid prices during the review process.
7. The District shall allow at least two (2) full business days after bid opening or after providing any requesting bidders with copies of all bids before executing a contract for the project.
Small Works Unit Priced Contract 7
8. The bid shall be prepared without the assistance of any officer, employee or other person employed by or connected in any manner with the District.
Small Works Unit Priced Contract 8
SUPPLEMENTAL BIDDER RESPONSIBILITY CRITERIA
A. In addition to the mandatory bidder responsibility criteria required under RCW 39.04.350(1), the bidder must also meet the following relevant supplemental bidder responsibility criteria applicable to the project:
1. Delinquent State Taxes – The bidders shall not owe delinquent taxes to the
Washington State Department of Revenue without a payment plan approved by the Department of Revenue.
2. State or Federal Disbarment – The bidder shall not currently be debarred or suspended by the State or Federal Government.
3. Claims against Retainage and Bonds – The bidder shall not have a record of excessive claims filed against the retainage or payment bonds for public works projects during the previous three years, that demonstrate a lack of effective management by the bidder of making timely and appropriate payment to its subcontractors, suppliers and workers, unless there are extenuating circumstances acceptable to the District.
B. As evidence that the bidder meets the bidder responsibility criteria in paragraph A above, the apparent low bidder must submit, upon request, documentation to the District within two (2) full business days of notification showing compliance with the criteria. The District reserves the right to request such documentation from other bidders also. The documentation shall include, but not be limited to the following:
1. The bidder shall provide current account statements from the Washington State
Department of Revenue demonstrating that the bidder is not a delinquent taxpayer.
2. The bidder shall not be listed as a current debarred or suspended bidder on the
Federal “System For Award Management” website www.sam.gov.
C. If the District determines the bidder does not meet the bidder responsibility criteria stated above and is therefore not a responsible bidder, the District shall notify the bidder in writing with the reasons for its determination. If the bidder disagrees with this determination, it may appeal the determination within twenty-four (24) hours1 of receipt of the District’s determination by presenting additional information to the District. If the final determination affirms that the bidder is not responsible, the District will not execute a contract with any other bidder until two (2) business days2 after the bidder determined to be not responsible has received the final determination.
By signing the signature page of the proposal, the Contractor acknowledges and agrees to the terms and conditions of this form and represents under oath and under penalty of perjury under the laws of the State of Washington that the Contractor meets the mandatory and supplemental criteria stated in this Section and all representations by the Contractor are true and correct.
1 The time deadline for a bidder to appeal a determination that they are not responsible, as indicated here, may be modified by the District, adopting either a standard for all projects or changing it on a project-by-project basis.
2 This two-day period of time may not be reduced. It is required in RCW 39.04.350(3)(d).
