This purchase order covers approximately half of the base's fuel requirements for the month of March, and was necessary due to the urgent need for continuous fuel coverage. Justification for Other than Full and Open Competition

1. Summary/Introduction:

This Justification and Approval (J&A) is issued to support the award of purchase order SPE605- 20-P-9748 using other than full and open competition by the Defense Logistics Agency Energy (DLA Energy), a major subordinate command of the Defense Logistics Agency. On February 14, 2020, DLA Energy awarded one purchase order to DGCI Corporation (DGCI), SPE605-20- P-9748, on a sole-source basis due to unusual and compelling circumstances. These procurement actions were for the acquisition of Aviation Turbine Fuel (JP8) for delivery to during the month of March 2020. The order was issued to procure a total of 693,333 gallons of JP8 for a total value of . This justification supports the decision to award a one-month purchase order using other than full and open competition.

This J&A has been approved and publicized after award, in accordance with Federal Acquisition Regulation (FAR) 6.303-1(e). Due to the unusual and compelling nature of this requirement, preparation and approval of this J&A prior to award would have unreasonably delayed the acquisition.

2. Nature and/or description of the action being approved (FAR 6.303-2(b)(2):

The action being approved is the February 14, 2020, award of a sole-source purchase order, SPE605-20-P-9748, using other than full and open competition due to unusual and compelling urgency to have continuous fuel coverage at the requiring site. The purchase order was awarded to DGCI on a sole-source basis to procure a total of 693,333 gallons of JP8 for a total value of which would be paid using the Defense Working Capital Fund. The purchase order was placed to cover the requirements for fuel from March 1, 2020 through March 18, 2020, for 693,333 gallons approximately of the base’s total March requirements to cover approximately three weeks of requirements. Then of the March requirements, approximately 346,667 gallons, were competed between four vendors for the performance from March 18, 2020 through March 31, 2020. The purchase order to DGCI was for delivery within an 18-day period and cover about of the fuel required at through March 18, 2020.

The remaining was ordered under recently awarded contracts with Strategic Social, LLC (Strategic Social) and Varec, Inc. (Varec), which were awarded after full and open competition.

Because contractors must follow a in order to deliver fuel in outside the DLA Energy estimated that Strategic Social and Varec would not be able to commence deliveries until the third week of March 2020 at the earliest. DGCI was the only contractor with the capability to perform these purchase orders. DGCI was the only
