About this file

This is a Notice to Public Bodies and Contractors issued by the Illinois Department of Labor (IDOL) regarding the Employment of Illinois Workers on Public Works Act. The notice informs all contractors and public bodies that the Act has come into effect due to Illinois unemployment rates exceeding 5% for two consecutive months (March and April, both at 5.1%). The Act requires contractors to employ at least 90% Illinois laborers on all public works projects receiving State funds or funds administered by the State. An Illinois laborer is defined as any individual who has resided in the state for at least 30 days with the intent to become or remain an Illinois resident.

IDOL is actively accepting complaints regarding violations of the Act on public works projects and will impose civil penalties on entities that employ more than 10% non-Illinois laborers on State public works projects during periods when the Act is in effect. Contractors bidding on projects such as the 2026 MFT Resurfacing Contract B must ensure compliance with these requirements. For additional information and guidance regarding the Act's requirements, contractors and public bodies are directed to contact Craig Colbrook at Craig.Colbrook@illinois.gov or 217-843-0463, or to visit IDOL's website for comprehensive details and resources.
