About this file

This document is a Contract Amendment (Amendment Number 2) for the PeopleSoft Test Framework Contract #280, involving the State of North Dakota through its Information Technology Department and Office of Management and Budget, and SpearMC Consulting, Inc., a California corporation. The amendment notably removes the North Dakota University System from the contract and updates various terms and conditions.

The contract covers Testing as a Service for ongoing software license, maintenance, and subscription services, with a defined pricing structure from Year One through Year Seven. The pricing remains consistent at $28,100 for the first five years, then increases to $29,600 for Years Six and Seven. The contract term is extended to October 10, 2028, with no remaining renewal options. Key amendments include updates to insurance requirements based on 2021 House Bill 1057, implementation of a Third-Party Risk Management Program effective July 1, 2023, and added provisions related to nondiscrimination and compliance with laws, including a specific clause about not boycotting Israel.
