Legal Services US Consulate General Toronto, Canada Solicitation Number 19GE5021R0004
Questions and Answers
Q1: Page 1 of the Solicitation indicates we are to complete the items in Block 19 thru 24. 3?
A1: It is not required for blocks 19 thru 24 to be completed. The price schedule starting at page 3 is a continuation of these blocks. All price information shall be inserted in the continuation.
Q2: Is there a target date for closing the transaction? For example, if closing occurred within the first few months of the second year, then the hours required in the second year would be significantly less and more than 200 hours may be required in the first year? Said differently, how is the target "200" hours/year adjusted to account for the timing of the transaction and related scope of work?
A2: The Government’s position is that the contractor shall bill for actual service provided.
Should the initial workload not require the expenditure of all the line item’s ceiling of 200 hours, these remaining hours would be left unspent. Should the workload require more that the ceiling, the Government will consider raising the ceiling. No services are to be performed over and above the ceiling until such time the government has authorized such increase.
Q3: On page 51, under "Volume 1: Price Proposal" item 1 indicates that the SF-1449 cover page blocks, 12, 17, 19-24, and 30 are to be filled-in; however, the first page of the SF- 1449 indicates that blocks 12, 17, 23, 24 & 30 are to be filled in. Please clarify whether items 19-22 are required to be filled in.
A3: See A1, above. The instructions on page 51 shall be revised to better clarify what is required to be submitted.
Q4: On page 51, under “Volume 1: Price Proposal”, there is reference to “Section 5, Representations and Certifications”, while page 45 refers to a “Section 5.1” and slide 9 of the Pre-Proposal Conference PowerPoint indicates four items for the contractor to warrant (652.242-73 Authorization and Performance (Aug 1999)). Could you confirm whether the representation of conflicts of interest under Section 5.1 and the items in slide 9 are intended to satisfy the “Section 5, Representations and Certifications” requirement or otherwise clarify what is required?
A4: The Representation and Certifications section begins on page 27 with provision 52.212-3 and continues thru page 46. Since most of the Reps and Certs are acknowledged through SAM.gov, the only two actions that need to be taken are 1) a statement in the offeror’s Management Plan that a Conflict of Interest analysis was completed and the result of that analysis, and 2) provide the answers to provision 52.229-11, Tax of Certain Foreign Procurements – Notice and Representation found on page 45.
Q5: On page 52, under "Volume 2: Technical Proposal" item 2(c) asks for specific details relating to past performance points of contact. If these same details are provided in the Attachment 1 - Contract Information Sheet / Experience Listing, can we cross-reference this Attachment or does USG require that same details be repeated for this item 2(c)?
A5: Identical details may be cross referenced.
