One containing the Kitchen items designated as K2, K4, or K6 person size

One containing Bed/Bath items designated as B2, B4, or B6 person size

NO GREY MARKET OR USED PRODUCTS ARE ACCEPTABLE. NEW PRODUCTS

D-001 MARKING INSTRUCTIONS

Each shipment must be marked with:

(a) Final destination post [insert as appropriate]*; and

(b) U.S. Government PO number [insert as appropriate]; and

Show the Despatch Agent (DA) address as the "ship to" address (not post address).

This information should be on PO, if not contact contracting officer.

D-004 PACKING LIST(S)

A copy of the prepaid commercial bill-of-lading and a copy of the packing list must be scanned and emailed to the appropriate Despatch Agent (DA).

A packing list or other suitable shipping document shall accompany each shipment and shall include the follow-ing information:

(a) Name and address of consignor;

(b) Name and address of consignee;

(c) Government contract number (and delivery order number, if used);

(d) Government bill of lading number covering the shipment, if any;

(e) Description of the items shipped, including item number, quantity, number of containers, and package num-ber, if any; and

(f) Weight and cube of each piece.

D-007 PACKAGING AND PALLETIZING

VENDOR NOTE: The packing and palletizing - if palletizing is required for this order - must conform to the standards in the International Standards for Phytosanitary Measures Publication No. 15: "Guidelines for Regu-lating Wood Packaging Material in International Trade" (ISPM 15) and have the appropriate markings indicat-ing that the materials meet this standard. Any deliveries arriving at our indicated delivery address that do not meet these standards will be rejected at the vendor's expense. F-001 DELIVERY REQUIREMENT

Orders placed under this contract shall be full container loads utilizing a 20 or 40 foot sea con-tainer. Orders shall be fulfilled and the Government notified within 30 calendar days of re-ceipt of order up to the maximums specified.

Delivery schedules for orders exceeding contract maximum quantities will be negotiated at the order level.

If the Government determines it necessary to deviate from this standard (i.e special require-ments), delivery terms will be negotiated at the time of order formation.

652.242-70 CONTRACTING OFFICER'S REPRESENTATIVE (COR) (AUG 1999)

(a) The Contracting Officer may designate in writing one or more Government employees, by name and posi-tion title, to take action for the Contracting Officer under this contract. Each designee shall be identified as a Contracting Officer's Representative (COR). Such designation(s) shall specify the scope and limitations of the authority so delegated; provided, that the designee shall not change the terms or conditions of the contract, un-less the COR is a warranted Contracting Officer and this authority is delegated in the designation.

G-001 ORDERING PROCEDURES

(a) In accordance with FAR 52.216-18 "ORDERING," the following individuals and activities are authorized to issue delivery orders or task orders hereunder:

(1) Date of order;

(2) Contract number and order number;

(3) Item number and description, quantity, and unit price;

(4) Delivery or performance date;

(5) Place of delivery or performance (including consignee);

(6) Packaging, packing, and shipping instructions, if any;

(7) Accounting and appropriation data;

(8) Security clearance level(s), applicable to the order, if any; and

(9) Any other pertinent information.

(c) Issuance of orders by facsimile is authorized in accordance with FAR 52.216-18 "ORDERING."

G-002 INVOICE INSTRUCTIONS

Invoice Payment: Payment will be made via Electronic Fund Transfer (EFT) in accordance with Federal Acquisition Regulation FAR32.9 “Prompt Payment”. The original invoice must be issued to the address as provided in block # 21 on the first page of the or-der and may be either mailed to that address or emailed as a pdf document to DabrosM@state.gov and verwaestc@state.gov

To avoid possible delay in payment, please ensure the invoice:

a) is correctly addressed;

b) references the correct order number (see block # 3 of the order);

c) provides complete bank details.

All payment related matters (only) should be sent to the above email address.

H-001 VALUE ADDED TAX (VAT)

This Contract is VAT exempt as the majority of items are being delivered to a bonded ware-house for direct export to a delivery point outside the European Community. The details regard-ing the procedure for obtaining a certified “proof of export”, if applicable, shall be provided at award or when necessary.

H-002 UPGRADES AND REPLACEMENTS

The firm fixed prices for items shall apply to any upgrades to the transformers cited in this con-tract or any replacement in case of discontinuation. The replacements, if any, shall be equal to or exceed the replaced model in all its features and functions. Any such upgrades or replace-ments shall be considered an integral part of this contract. At the time of delivery, all delivered items shall be models not older than 18 months or be the latest technology in the industry.

H-005 CONTRACTOR COMMITMENTS, WARRANTIES, AND REPRESENTATIONS

Any written commitment by the Contractor within the scope of this contract shall be binding upon the Contract-

or. Failure of the Contractor to fulfill any such commitment shall render the Contractor liable for liquidated or other damages due to the Government under the terms of this contract. For the purpose of this clause, a written commitment by the Contractor is limited to the proposal submitted by the Contractor, and to specific written modifications to the proposal. Written commitments by the Contractor are further defined as including (1) any warranty or representation made by the Contractor in a proposal as to hardware or software performance; total systems performance; and other physical, design, or functional characteristics of equipment, software package or system, or installation date; (2) any warranty or representation made by the Contractor concerning the char-acteristics or items described in (1) above, made in any publications, drawings, or specifications accompanying or referred to in a proposal; and (3) any modification of or affirmation or representation as to the above which is made by the Contractor in or during the course of negotiations, whether or not incorporated into a formal amendment to the proposal.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this para-graph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transac-tions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. L-001 Efficient Competition

Offerors are advised that the Government may not evaluate the technical offers of all offeror's under this RFQ.

The government will first review the total evaluated price of all quotes received. The technical offer of those offerors whose pricing is determined by the Contracting Officer to be most competitive may be reviewed prior to, or instead of, other technical offers received. Based on the initial review of these technical offers, the government may not evaluate the technical offers of other offerors, whose total evaluated pricing was higher than that of one already evaluated and already evaluated as providing a benefit that exceeds the minimum. This would occur when the Contracting Officer determines that any possible technical superiority of an unevaluated (and higher priced) technical offer, over (a lower priced) one that was already evaluated and determined to provide benefits to the Department that clearly exceed the minimum, would not warrant any additional price premium.

Furthermore, if an offeror fails to provide a complete kit or otherwise fails to meet solication requirements the offer will NOT be further evaulated. The purpose of this procedure is to reduce cost and time of the selection process.

L-002 RFQ Requirements

The offeror must provide a complete quote for proper evaluation. An offeror must provide the following information to be cosidered a complete quote.

1. Descriptive Literature (see 52.214-21) or compareable on all items;

2. A Managment Plan that specifically addresses the minimum requirements as specified in the statement of work;

3. Representations and Certifications that are accurate and up-to date at www.sam.gov;

4. Pricing Summary using estimated quantitied specified in the schedule and I-001 Ordering

Limitations Quantity: Minimum, Estimated and Maximum per year.

An offeror that fails to provide a complete offer will NOT be further evaluated.

52.214-21 Descriptive Literature (Apr 2002)

(a) "Descriptive literature," as used in this provision, means information furnished by a bidder, such as cuts, il-lustrations, drawings, and brochures, that shows a product's characteristics or construction or explains its opera-tion. The term includes only that information required to evaluate the acceptability of the product and excludes other information for operating or maintaining the product.

(b) Descriptive literature is required to establish, for the purpose of evaluation and award, details of the product offered that are specified elsewhere in the solicitation and pertain to significant elements such as--

(1) Design;

(2) Materials;

(3) Components;

(4) Performance characteristics; and

(5) Methods of manufacture, assembly, construction, or operation.

(c) Descriptive literature, required elsewhere in this solicitation, shall be--

(1) Identified to show the item(s) of the offer to which it applies; and

(2) Received by the time specified in this solicitation.

L-003 Comparative Evaluation Selection

This selection process will utilize FAR 13 procedures. A comparative evaluation will be per-formed in accordance with FAR 13.106-2(b)(3).

A comparative evaluation is defined as the act of comparing two or more offers in reponse to the RFQ. The item-by-item comparison is performed by comparing each offer to one another to determine which provides the best overall value to the Department.

Offerors are advised:

• The Government reserves the right to select a response that provides value to the Depart-ment that exceeds the minimum;

• The Government is NOT required to select a response that exceeds the minimum;

• Responses may exceed requirements;

• Individual offers will NOT be evaluated against specified evaluation factors. It is NOT a low price technically acceptable or trade-off process.

The following Mandatory Compliance criteria represent 'gates' that an offeror's offer must meet before advan-cing in to the comparative evaluation process.

1. The kit must be proposed completely. Offers with unknown or missing items precludes proper evaluation and will NOT be further evaluated.

2. All proposed items must be commercial items and function for its intended purpose. If any proposed item fails the kit and offer will NOT be selected.

M-002 Basis for Award

The Government will make award to the responsible offeror(s) whose offer conforms to the requirements of the solicitation and is evaluated as being the most advantageous to the Government, price and other factors considered using comparative analysis permitted under FAR 13.106-2 (b). The Government will evaluate price for price reasonableness.
