LIMITED SOURCES JUSTIFICATION

I. Contracting Activity

The State Department’s Bureau of International Narcotics and Law Enforcement Affairs (INL) is providing support to the Colombia National Police (CNP, for the construction of the electrical distribution system in the Counternarcotic Manual Eradication Camp in Caucasia, Colombia.

The Colombia National Police (CNP Counternarcotic Direction requires the installation of the electrical distribution system for the Manual eradication camp that supports the USG Counternarcotic interest in the Antioquia Department. This electrical distribution system is essential for the mission of the Manual Eradication unit; the estimated cost for the construction of the electrical distribution system is redacted.

II. Nature and/or Description of the Action Being Processed

The contract is required to construct the Electrical distribution system in order to support the Manual eradication police camp electrical system so that the new facilities will have electrical power to conduct the normal operations of the Counternarcotic base.

III. Description of the Supplies/Services Required To Meet the Agency’s Needs

The mission of the State Department’s Bureau of International Narcotics and Law Enforcement Affairs (INL is to minimize the impact of international crime and illegal drugs on the United States, its citizens, and partner nations by providing effective foreign assistance and fostering global cooperation. This mission, which centers on helping our partner nations establish a capable and accountable criminal justice sector, was expanded during the past decade to include stabilizing post-conflict societies through criminal justice sector development and reform. This mission supports peace and security by stabilizing and strengthening security institutions and by combating narco-trafficking and other transnational crimes such as money laundering and criminal gangs. It promotes just and democratic governments by strengthening justice sector institutions, good governance and respect for human rights.

INL combines forces with other USG and international agencies and takes a regional approach to widespread problems. INL also encourages more developed governments to take responsibility as equal partners in global efforts to combat transnational crime, include drug trafficking. The Bureau’s priority programs support three inter-related objectives:

• BUILDING CRIMINAL JUSTICE SYSTEMS: Institutionalize rule of law by developing and expanding criminal justice systems to strengthen partner country law enforcement and judicial effectiveness, foster cooperation in legal affairs, and advance respect for human rights;

• COUNTER-NARCOTICS: Disrupt the overseas production and trafficking of illicit drugs through targeted counter-narcotics and institution-building assistance and coordination with foreign nations and international organizations, and;

• TRANSNATIONAL CRIME: Minimize the impact of transnational crime and criminal networks on the U.S. and its allies through enhanced international cooperation and foreign assistance.

The Manual eradication Counternarcotic camp in Caucasia is a critical part of the narco-trafficking combat effort in the Antioquia region. It is essential to construct an Electrical distribution system in order to support the police manual eradication base so that the new construction has an electrical power to conduct the normal operations of the Counternarcotic base.

IV. Identification of the Justification/Rationale for Limiting Sources and Demonstration of the Contractor’s Unique Qualifications to Provide the Required Supply/Service

FAR 6.302-1 allows the sole source of a contract when only one responsible source is available and not other supplies or services will satisfy agency requirements.

Current incumbent contractor is the company that was awarded and has successfully completed the first phase of the electrical distribution system for the DICAR base in Caucasia. The electrical distribution system at the manual eradication Counternarcotic camp at Caucasia is necessary to ensure a continuity of services and operations to support the Colombian national Police in this part of the Colombian territory. Failure to retain the current incumbent contractor throughout the competitive solicitation process would result in potential harm to government operations since a transition to other contractors for this short time frame would be extremely disruptive and will eventually result in unnecessary increased cost to the government. Familiarity of the current incumbent contractor with the planning processes and standard operating procedures of the actual electrical distribution system of the Police base at Caucasia is critical to support operations and the learning curve associated with a transition, which would result in a negative impact to the mission. In addition, the current incumbent contractor has demonstrated experience working with local personnel and subcontractors who have a working knowledge of the technical electrical procedures at the Police base at Caucasia, which is critical to support timely completion of mission milestone in this region of the Colombian territory. A transition to other contractors during a brief extension would result in the loss of working knowledge required to operate in Caucasia and cause unacceptable delays.

V. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with FAR 8.404(d)

Since the current incumbent contractor has successfully completed the first phase of the electrical distribution system for the DICAR base in Caucasia, this company has an extensive history performing similar work under the present Purchase Order, providing support that the anticipated cost to the Government will be fair and reasonable. However, a price analysis will be performed prior to award and there is sufficient data in-house to verify if the proposed cost is fair and reasonable.

VI. Description of the Market Research Conducted Among Schedule Holders and the Results Or a Statement of the Reason Market Research Was Not Conducted

Market surveys were conducted prior to the award of the previous phase for the electrical distribution system of the DICAR base in Caucasia, providing evidence that the prices supplied by the incumbent contractor to be a fair and highly competitive. A market survey will not be conducted at this time since the current provider is the only company at this point that can provide the required services for the brief period of time without a disruptive transition/ on-boarding period.

VII. Other Facts Supporting the Justification

No other facts necessary

VIII. Actions the Agency May Take to Remove or Overcome Any Barriers that Led to the Restricted Consideration Before Any Subsequent Acquisition For the Supplies or Services

Future requirements will have market research conducted to determine the availability of U.S.

Small businesses and other non-U.S. small business contractor with the capability and interest in doing the work.
