191BWC20R0009 Amendment 002 Arroyo Colorado Vegetation Management Project

1. Can the Contractor alter the species list for planting as long as they are native to the county, based on USDA Plant Profile Database?

• Yes, the replacement seed species and seeding rates must be “compliance confirmed” by the C.O.R and C.O. See table 3-3 (page 3-7 and 8) of Vegetation Management Plan (rev. 12 Jan 2016) for the list of herbaceous plant for seed mix. The contractor can also reference the USDA-NRCS and USFWS seed list for this Texas Region.

2. Due to the difficulty of obtaining certain plants in a short time, would it be possible to extend the planting deadline to later than 120 days?

• It is always recommended to follow the Planting Dates for establishment, if the plant species on the list is not available the contractor may substitute it. The replacement seed species and seeding rates must be “compliance confirmed” by the C.O.R and C.O. Also see table 3-3 (page 3-7 and 8) of Vegetation Management Plan (rev. 12 Jan 2016) for the list of herbaceous plant for seed mix. It may not be warranted to extend the planting dates in lieu of the in availability of a seed species if a substitute seed is available.

3. When considering discrepancies between the vegetation management plan and the PWS, which document supersedes the other (specifically referencing vegetation removal techniques)?

• The Vegetation Management Plan supersedes the PWS.

4. Will future walking trails and bridges be under construction during the vegetation management project?

• Prior to the construction of any Walking Trails, we will notify the contractor on the proposed walking trails. We will also advise the Stakeholder on the work the USIBWC is implementing. A coordination plan will be developed that will satisfy both parties.

5. Can we submit a proposal with an alternative vegetation treatment plan that deviates from the vegetation management plan?

• Yes, the “Alternative Plan” must “Compliance Confirmed” by the C.O.R. and C.O.

6. Can we submit two proposals, one following the vegetation management plan, and one that provides an alternative treatment option?

• Yes, both Plans and Alternative Treatment Options will be reviewed.

7. Please clarify proposal submission requirements (e‐mail or mail submission, hard copies, digital version of proposal, etc.)

• Proposals should be submitted digitally via email.

8. Can a force majeure clause be added to the contract?

• No, refer to section 2.8 Notification to the Government of Delays and FAR Clause 52.212-4.
