2. 41 U.S.C. 3304(a)(5), as authorized by 38 U.S.C. 8127(b), VAAR 806.302‐5‐70(b)

6. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Fort Sam Houston NC experienced severe storms with gale force winds over the period of several days. This series of storms damaged many trees in the cemetery. Many of these trees pose safety hazards to both visitors and employees and as such, this work needs to be processed as an emergency and accomplished as soon as possible. The local SDVOSB contractor recommended for this project is an expert at safe tree removals and trim/prune in national cemeteries.

7. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Due to the time constraints innate to emergent cicumstances like this one, soliciting this requirement is not practicable.

8. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost received will be fair and reasonable based on the vendor’s submission of fair and reasonable pricing for similar work requirements at the same worksite. Once the vendor’s quote is received, it will be compared to the governemnt’s estimate to further supplement the price fair and reasobability determination.

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A list of SDVOSBs in the San Antonio Texas area under the applicable NAICS 561730 was retrieved from the vetbiz database.
