About this file

This is a Question and Answers document for IFB 161107, a General Contracting Service opportunity issued by the Virginia Department of Transportation (VDOT) for facilities within the Bristol District. The document addresses clarifications regarding contractor responsibilities, prevailing wage requirements, and award criteria. Key topics covered include disposal procedures, debris management, dumpster provisions, and prevailing wage rate reporting obligations. The contract will be awarded on a Grand Total per Lot basis to the lowest responsive and responsible bidder, with the Commonwealth reserving the right to reject any or all bids in whole or in part and to delete items prior to award.

Regarding pricing and operational requirements, contractors are responsible for all disposal costs, including containers and dumpsters, which will be reimbursed at cost when supported by invoices. For locations with existing VDOT contracts, dumpsters are provided; for locations without existing contracts, the VDOT Contract Administrator must approve the dumpster need and size prior to project start. Prevailing wage rates determined by the Virginia Commissioner of Labor and Industry are mandatory and must be paid for the entire contract term. Upon contract award, contractors must submit a prevailing wage certification form to the Virginia Department of Labor and Industry detailing pay scales by craft or trade, itemized wages and fringe benefits, and third-party fund information. Bidders who fail to provide prices for all labor categories within a lot on time and materials service contracts will be deemed nonresponsive.

IFB 161107 General Contractor Service Question and Answers #1

1. For disposal, what if it’s for a job like roof work that has a lot of debris and a container or dumpster is needed? Will we not be reimbursed for that?

Answer: The Contractor will be reimbursed for the cost of disposal, including containers. Refer to Addendum 1, item 6, which states:

9. DISPOSAL: The Contractor is responsible to dispose of all refuse, rubbish, scrap materials and debris caused by their operations. No such refuse, rubbish, scrap material and debris shall be left within the completed work area nor buried on the project site but shall be removed from the site and properly disposed of in a licensed landfill or otherwise as required by law.

a. DUMPSTERS: On occasion larger jobs may require a roll off dumpster on the job site. For locations with an existing VDOT contract, a container at the agreed upon size will be provided for the Contractor’s use for the duration of the project. For locations without a VDOT contract, the VDOT Contract Administrator will approve the need and size of the dumpster prior to the job start date. All costs associated with the dumpster and disposal of debris in the dumpster will be charged to VDOT at cost as supported by invoices.

2. Do prevailing wage rates need to be reported? Like a weekly report?

Answer: The provisions of laws requiring the payment of a prevailing minimum wage rate are incorporated in and expressly made a part of this Contract. Refer to Attachment G for the Prevailing Wage Rate Determination(s). Also refer to paragraph X.25 which states:

PREVAILING WAGE RATE: The provisions of laws requiring the payment of a prevailing minimum wage rate are incorporated in and expressly made a part of this Contract. The Contractor and the Contractor’s subcontractors shall pay wages, salaries, benefits, and other remuneration to any mechanic, laborer, or worker employed, retained, or otherwise hired to perform services in connection with the Contract at a rate at least equal to the prevailing wage rates determined by the Virginia Commissioner of Labor and Industry for work to be performed under this Contract, as outlined in Attachment G. The wage determination establishes the rates that must be paid for the entire term of the Contract.

Upon award of contract, the Contractor shall send a certification form to DOLI. Refer to paragraph X.25.C, which states:

Upon the award of the Contract, the Contractor shall certify, under oath, to the Commissioner of VDOLI the pay scale for each craft or trade employed on the project to be used by the Contractor and any of the Contractor’s subcontractors for work to be performed under the Contract. This certification shall, for each craft or trade employed on the project, specify the total hourly amount to be paid to employees, including wages and applicable fringe benefits, provide an itemization of the amount paid in wages and each applicable benefit, and list the names and addresses of any third party fund, plan or program to which benefit payments will be made on behalf of employees. The certification form is available at: www.doli.virginia.gov/wp-content/uploads/2021/04/DOLI-Pay-Scale-Certification-for- Public-Works-Projects.pdf. The form may be emailed to prevailingwage@doli.virginia.gov, faxed to 804-371-6524, or mailed to Virginia Department of Labor and Industry, 600 East Main St., Suite 207, Richmond, VA, 23219, Attn: Prevailing Wage.

3. Some recent maintenance contracts include awards for a primary and secondary contractor. Does this one?

Answer: This contract will be awarded on a Grand Total per Lot basis to the lowest responsive and responsible bidder. Refer to paragraph X.5, which states:

AWARD: The Commonwealth will make the award(s) on GRAND TOTAL PER LOT basis to the lowest responsive and responsible bidder. The purchasing office reserves the right to conduct any test it may deem advisable and to make all evaluations. The Commonwealth also reserves the right to reject any or all bids, in whole or in part, to waive informalities and to delete items prior to making the award, whenever it is deemed in the sole opinion of the procuring public body to be in its best interest.

A bidder who fails to provide prices for all categories of labor within a lot (enters $0, No Bid, N/A on a pricing blank or leaves it blank) in the pricing schedule of a time and materials service contract is considered nonresponsive.
