About this file

This justification and approval document outlines a limited competition contract award for electronic security systems installation services. The Department of Justice United States Marshals Service requires the installation of security equipment at a new courthouse in Reading, Pennsylvania for an estimated total cost of $994,272.05, to begin immediately upon award. The scope of work includes installing security systems for prisoner movement and USMS spaces.

The contract is a follow-on to a previous task order awarded to Johnson Controls Security Solutions on January 30, 2020 for $1,091,250.44 to install equipment at the same courthouse. As the systems being installed are proprietary to Johnson Controls' standards, having a different contractor interface with the existing equipment could result in system failures and security risks. Johnson Controls also currently has sole access to the site without escort. The justification cites decreased oversight and additional security costs if another contractor was selected. Timely completion by the scheduled move-in date of an unspecified future date is also required to secure the facility and allow the judiciary to carry out its mission.

6. Description of the efforts to find competition

A. Describe all efforts taken (or to be to be taken) to ensure that offers are solicited from as many potential sources as practicable under the circumstances. The following issues should be addressed in this paragraph.

B. In this paragraph, discuss any other actions taken or planned to facilitate competition for this acquisition. The discussion should include actions tried or considered even if the actions were unsuccessful. If the efforts were unsuccessful, so state and describe why.

Not Applicable.

7. A determination by the Contracting Officer that the anticipated costs will be fair and reasonable.

Include a statement by the Contracting Officer that the anticipated cost will be considered fair and reasonable and provide the basis for this determination. The steps that will be taken to ensure the final contract price will be fair and reasonable are also described here. Describe the extent of cost or price analysis anticipated including the requirements for certified cost or pricing data, technical evaluations, and audits.

8. A description of the market research conducted and results.

Discuss any market research conducted pursuant to FAR Part 10 and describe results of that research. Market research is any effort undertaken to determine if sources capable of satisfying the agency's requirements exist and to determine if commercial items or non-developmental items are either available or can be modified so that they will satisfy the agency's needs. Market research should be focused not only on identifying alternate sources, but also on alternate equipment or substitutes that might fill the government needs with only minor modification.

Regardless of the approach used, the results should provide a high level of confidence that no other qualified sources exist.

This pricing is accordance with previously accepted pricing for similar work. The price also falls below the IGCE.

As this is a sole source requirement, subject to FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements, the Office of Security Contracts did not conduct additional research as it is not required per the FAR.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition.

Provide any other facts supporting the use of other than full and open competition.

10. A list of sources that expressed, in writing an interest in the acquisition.

11. A statement of the actions, if any; the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the required services.

Describe any actions taken or to be taken to foster competition for future acquisitions of the supplies or services being acquired. Describe potential actions that could be undertaken to remove the barriers to competition that have been identified in the justification and include a milestone schedule for accomplishing these actions. For example, if a follow-on competitive acquisition is planned, so state and give planned award date.

If there aren't any actions are planned, state such and provide justification. If approval is sought for more than one year, explain why a sole source effort is required for the planned time duration.

USMS has awarded 8 Blanket Purchase Agreements for new ESS installation services. USMS intends to compete new installations under this vehicle in the future.

#4 Text:

The Performance Work Statement (PWS) and Project Information Proposal (PIP) are attached and reflects a project estimate total cost of $994,272.05. The new installation will begin immediately after the project/contract is awarded. This will include substantial completion of the installation of most ESS equipment by move in date, and the remaining ESS equipment for the prisoner movement area . The project includes the installation and setup of the security systems used for prisoner movement and

USMS spaces.

The vendor will install the following:

#5 Text

This requirement is follow on to task order 15M20019FA32NP309 (hereafter “NP309”), which was awarded , to Johnson Controls Security Solutions (JCSS) under indefinite-delivery contract (IDIQ) DJM-14-A32-V-0014 for $1,091,250.44 for the installation of ESS equipment at the new

Court House in Reading, Pennsylvania. This Task Order funded to cover the Court Space; with funding for the Marshal space not being received until Fiscal Year 20. Therefore, this requirement and NP309 must be installed together to ensure a complete, fully integrated system. Having multiple integrators for one security system increases the likelihood of the entire security system failing to meet security requirements, resulting in an unacceptable risk to the Judiciary. The ESS system being installed at

Reading is proprietary to JCSS's standardized wiring and installation procedures. Having another integrator attempt to interface with this system may result in unintended system failure and operating errors; which could ultimately negatively impact the security of the judiciary.

Currently, only JCSS is permitted to access USMS and Judiciary ESS equipment as the site without escort.

If another integrator were selected to perform this work, then their technicians would require a Deputy

Marshal or Court Security Officer escort until the technicians receive the appropriate adjudication.

Given the relationship between NP309 and the work requested under this Justification & Approval, award to any security system integrator other than the one currently performing in the workspace will result in decreased oversight and the need for additional security resulting in duplications of efforts and subsequent costs that the Government is not expected to recover through competition.

Additionally, if this installation is not completed by the scheduled move-in date of , the

Judiciary will not be adequately secured and will present a risk to the life and safety of both the Judiciary and the public. Should these areas not be secured by the move-in date, the Judiciary will not be able to complete its mission and may have to suspend operations until the security requirements are met. JCSS has already completed its assessment of the site, and already possesses knowledge of site conditions, which may affect the successful completion of the project.
