JUSTIFICATION FOR OTHERTHAN FULL ANDOPEN COMPETITION

Pursuant to the Federal Acquisition Regulation (FAR) 6.302-1 (c) (1) as well as the Bureau of Prisons Acquisition Policy (BPAP) 6.304(b), the Federal Bureau of Prisons (FBOP) has determined that the procurement to Upgrade Fire Alarm Panels at the Federal Correctional Institution in Herlong, California, meets the criteria established for other than full and open competition. This limitation on competition is justified as supported by the following information:

1. IDENTIFICATION OFTHEAGENCYANDTHECONTRACTING ACTIVITY:

Department of Justice Federal Bureau of Prisons Federal Correctional Institution Herlong 741-925 Herlong Access Rd. A-25 Herlong, CA 96113

2. NATUREAND/ORDESCRIPTIONOFTHEACTIONBEINGAPPROVED:

This action is for acquisition of replacement/upgrade of EST-2 (Edwards Systems Technology) to EST-3 (Edwards System Technology) Fire Alarm Panels for the Federal Correctional Institution (FCI Herlong) in Herlong, California.

3. DESCRIPTION OFSUPPLIES AND SERVICES REQUIRED TO MEET THE

AGENCY' S NEEDS (INCLUDING ESTIMATED VALUES:

FCI Herlong, has a requirement for the provision of all labor, materials, and equipment necessary to replace fire alarm, indicator and annunciator panels. This action covers only the EST-3 fire alarm and annunciator panels. The fire alarm, indicator, and annunciator panels have an estimated value between $425,000.00 and $450,000.00.

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING

OTHER THAN FULLAND OPEN COMPETITION:

41 U.S.C. 253(c) (2), as implemented by FAR 6.302-1 (c)(l ), "Only one responsible source and no other supplies will satisfy agency requirements. Application for "brand-name description". It is determined that the procurement of replacement/upgrade of the fire alarm, indicator, and annunciator panels at FCI Herlong, meets the criteria established for other than full and open competition for the product required.

5. DETERMINATION THAT PROPOSED MANUFACTURE' S UNIQUE

QUALIFICATIONS ORTHENATURE OFTHE ACQUISITION REQUIRES

USE OFTHE AUTHORITY CITED:

The fire alarm panels at FCI Herlong are antiquated and replacement parts are obsolete. There have currently been several failures, which have been non-repairable within the past year. There is currently no software available nor is there any means of extracting the software for the existing data points of our system.

However, the peripherals associated with the fire alarm system are functional, and it would be in the Governments best financial interest that they remain in place. It is therefore necessary to limit the upgrade of the fire alarm, indicator, and annunciator panels to a sole manufacture (Edwards Systems Technology) for interface with all other existing system equipment and peripherals.

6. EFFORTS TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCESASPRACTICAL:

Itisnottheintentiontolimit theprospective contractors solicitedtobidonthisproject, only that the new upgraded system should interface with the existing system equipment and peripherals that are to remain.

In accordance with FAR 5.102(a)(6) and 1l.105(a)(3), this approved JOFOC will be posted with the solicitation at www.tbo.gov.

7. DETERMINATION THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BEFAIRANDREASONABLE:

The Contracting Officer anticipates the cost to the Government will be fair and reasonable. Edwards Systems Technology is familiar with the requirements and constraints of the Federal Bureau of Prisons and many institutions have their systems.

Multiple contractors will be able to place a bid for installation of the Edwards System Technology fire alarm, indicator, and annunciator panels.

8. DESCRIPTION OFMARKET RESEARCH:

This manufacture has equipment in many Bureau of Prisons facilities, including FCC Victorville. Upgrade of the EST-2 (Edwards Systems Technology) to EST-3 seems to be the most financially sound procurement to interface with existing systems to remain.

Market Research found companies capable of providing and installation of the product.

Further product was not examined.

9. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

To upgrade all existing peripherals and systems to remain would not only cost more, but would also require much more time than presently allotted for an upgrade utilizing the same manufacturer.

10. SOURCES THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION:

No other sources expressed in writing an interest in the acquisition.

11. ACTIONS TAKEN BY THE AGENCY TO REMOVE OR OVERCOME

BARRIERS TO COMPETITION:

FCI Herlongwillcontinuetomonitor themarket trendsinthe industrytoseek competition or sources that may be able to meet the minimum needs of the Government and its fire alarm, indicator, and annunciator panels. Should opportunities arise in the future; FCI Herlong will take appropriate action.
