This is an Invitation for Bids (IFB) issued by the Indianapolis Public Transportation Corporation (IPTC or IndyGo), a municipal public transportation authority in Marion County, Indiana. IPTC seeks bids from qualified contractors for the full demolition and replacement of an existing asphalt driveway with a new concrete drive at the Owner's south lot located off Harding Street across from the 1501 West Washington Street facility. The project scope includes approximately 650 feet of driveway, 21 feet wide, with work items encompassing construction staking and layout, mobilization, excavation, subgrade treatment, dense graded subbase, Portland cement concrete pavement (8 inches), erosion control, and mulched seeding. A pre-bid conference and site walk is scheduled for July 9, 2026, at 9:00 AM at the Owner's West Campus facility. Electronic bids are due via the Bonfire e-procurement platform by July 29, 2026, at 3:00 PM local time, with public bid opening and reading via Microsoft Teams at approximately 3:30 PM the same day. Contract award is anticipated in August 2026. The contractor shall achieve substantial completion within 45 calendar days of the Notice to Proceed and final completion within 59 calendar days, with a contract term not subject to renewal.

Bidders must submit bids without inclusion of Indiana sales tax, as IPTC is tax-exempt on tangible personal property incorporated into the permanent structure. Bid security of five percent of the base bid amount is required, with the successful bidder required to furnish performance and payment bonds equal to 100 percent of the contract price. This project is subject to the Davis-Bacon Act prevailing wage requirements and federal funding compliance through the Federal Transit Administration (FTA). Liquidated damages are assessed at $500 per calendar day for delays in achieving substantial completion and an additional $500 per calendar day for delays in final completion. Retainage of ten percent shall be withheld until 50 percent completion is achieved. The apparent low bidder must demonstrate Indiana Code qualification (INDOT code A(a) Concrete Pavement – General or IDOA code 1611.01 Concrete Construction of Roads and Curbing) and compliance with the IPTC Responsible Bidding Practices & Submission Requirements Policy prior to Notice to Proceed issuance. No DBE goal has been established for this project. 2. The Performance and Labor and Material Payment Bonds, and such Certificates of Insurance, will be furnished, and such Contract shall be executed and delivered to Owner, by the successful Bidder, within five (5) business days after it has received notice of the acceptance of its bid.

3. The successful Bidder shall within fifteen (15) days from the Contract effective date submit, in writing, the names of persons or entities (including those who are to furnish materials or equipment fabricated to a special design) proposed for each principal portion of the Work as required in Paragraph 4.6 of the Contract. In addition, the successful Bidder shall within fifteen (15) days from the Contract effective date submit separately, in writing, a Submittal Schedule as required in Paragraph 4.6.1 of the Contract. After submission of these lists by Bidder/Contractor, and after approval by Owner, they shall not be changed unless written approval of change is authorized by Owner. The successful Bidder shall also submit a construction schedule within fifteen (15) days from the Contract effective date.

4. The failure of the successful Bidder to execute the Contract and to supply the required bonds when the Contract is presented for signature, or within such extended period as the Owner may grant, based upon reasons determined adequate by the Owner, shall constitute a default, and Owner may either award the Contract to the next lowest, responsive, responsible bidder or re-advertise for bids. In the event of a default, Owner shall have the right to declare the amount of the bid security forfeited. Owner shall be entitled to collect on a defaulted bid, at a minimum, the difference between the defaulted bid amount and the bid of the firm to which the award is made, after giving due weight and consideration to alternatives accepted.

E. Liquidated Damages for Failure to Enter Into Contract:

1. The successful bidder, upon its failure or refusal to execute and deliver the Contract, Bonds, Certificates and other required documents, within seven (7) business days after it has received notice of the acceptance of its bid, shall forfeit to Owner, at Owner’s sole option, as liquidated damages for such failure or refusal, the bid security deposited with its bid.

1.15 PROTEST PROCEDURE

A. A Bidder may only challenge an IPTC action or decision made in conjunction with or relating to this IPTC Procurement as set forth in Section 00 21 19 Protest Procedure.

1.16 TIME OF COMMENCEMENT AND COMPLETION

A. Barring unforeseen circumstances, an Owner decision to postpone the Award or to reject all bids, Owner anticipates that the award of the Contract for the Work shall be in August 2026.

B. The Notice to Proceed with the Work shall be issued to Contractor within fourteen (14) days from the date of the Contract Award, provided Contractor has met the conditions precedent for such Notice being issued, namely, (1) the execution of the Contract by Contractor and its return to Owner, (2) submission of the required Bonds to Owner, (3) submission of the required Certificates of Insurance to Owner, (4) submission to Owner of Exhibit D, as required by Paragraph 4.6 of the Contract, (5) evidence of capacity to perform the Work, and (6) submission of any other documentation or information required of Contractor in accordance with the terms and conditions of the Division 1 Specifications, the Contract and the General Conditions.

C. Contractor shall commence Work on receipt of the Notice to Proceed, and shall complete the Work, including completion of performance testing, commissioning and such remedial work as may be required by Owner, within the Contract Time and dates set forth in the Contract.

1.17 INDIANA STATE GROSS RETAIL AND USE TAX

A. The Owner is exempt from the Indiana Gross Retail Tax and Use Tax under the provisions of Section 39(b)(6), Chapter 50, Acts of 1933, as amended. All of its purchases of tangible personal property are therefore exempt from such taxes. This is only for materials that become a part of the permanent structure.

This statement shall apply to all Contractors bidding any work in anticipation of a direct contract with the Owner.

B. All bids shall be submitted without inclusion in the bid price of the amounts, if any, of Gross

Retail and Use Tax (generally called the “Sales Tax”) due the State of Indiana for services performed or material furnished in connection with the work contemplated by the Bidder.

This provision shall apply both to contracts directly with the Owner and to transactions between a prime or general contractor and any subcontractor or supplier furnishing services or material to the general/prime contractor.

However, any tax on rental equipment and on material not incorporated in the work shall be paid by the contractor if assessed by the State of Indiana and shall not be paid by the Owner.

1.18 DBE PARTICIPATION REQUIREMENTS

A. It is Owner’s policy that Disadvantaged Business Enterprises (DBE) shall have the maximum feasible opportunity to participate in the performance of the Work. However, there is no DBE goal set for this Project. IPTC may not resume setting DBE contract goals until INDOT completes the reevaluation process described in 49 CFR 26.111.

The decision rendered by the Director of Procurement shall be final.

B. IPTC expressly reserves the right to reject all bids at any time prior to a formal contract award and elect to re-procure.

C. If the IPTC determines that a Protest submission is timely, complete and meritorious, the Protestor’s relief shall be limited to the IPTC’s decision and recommended course of action. The Protestor shall not be entitled to any monetary relief, including, but not limited to, expectancy damages and bid preparation costs.

A Protestor must exhaust all administrative remedies as set forth herein as a pre-condition for any legal or equity relief sought in a judicial forum.
