About this file

This is a Proposer/Contractor Good Faith Effort form from the Local Assistance Procedures Manual (Exhibit 15-H) applicable to the San Joaquin Council of Governments (SJCOG) website design and development project in California. The form requires proposers and bidders to document their good faith efforts to meet or exceed the established Disadvantaged Business Enterprise (DBE) goal for the contract. Submissions must be made within five calendar days from the cost proposal due date or bid opening date. The form requests comprehensive documentation including the names and dates of publications where DBE participation requests were advertised, names and dates of written notices sent to certified DBEs with follow-up methods used, itemized work made available to DBE firms with cost breakdowns and percentages, names and reasons for rejecting DBE firms, names of selected firms with price comparisons, and evidence of efforts to assist DBEs in obtaining project information, bonding, lines of credit, insurance, equipment, and supplies.

The form further requires documentation of outreach to agencies, organizations, and groups contacted to assist in recruiting DBE firms, along with any additional supporting data demonstrating good faith efforts. Proposers are encouraged to submit this documentation even if they have already met the DBE goal through the appropriate commitment exhibits, as the form provides protection for bidder eligibility if the administering agency determines the bidder failed to meet the goal due to DBE certification issues at bid opening or mathematical errors. All supporting documentation, including copies of advertisements, solicitation letters, telephone records, fax confirmations, quote comparisons, and agency contact records, must be attached to substantiate the good faith efforts claimed.
