About this file
This amendment modifies solicitation number 140P8123Q0092 for HVAC preventative maintenance and installation services at Death Valley National Park. The National Park Service seeks to award a fixed-price contract to provide HVAC preventative maintenance, repair, and installation services for a one year period. The amendment answers contractor questions, updates the evaluation criteria to no longer require a California contractor's license, and extends the quote submission deadline to August 14, 2023 at 2 PM Pacific Time. Quotes will be evaluated based on total price, with technical acceptability focusing on a minimum of three years of relevant experience. The contract award will go to the lowest priced technically acceptable offer from a responsible contractor meeting the requirements.

The purpose of this amendment is to answer contractor questions, revise the evaluation criteria and change the quote due date.
A. Contractor questions and answers are provided as follows:
Question 1: Is there a need for a California license?
Answer 1: No. NPS has reviewed this and contractors do not need to be licensed in California.
B. The evaluation criteria have been updated to reflect the change above.
52.212-2 EVALUATION-COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES. (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose offer is the lowest price, technically acceptable.
Award will be made in accordance with FAR Part 13 to the offeror that provides the lowest price offer that meets the technical specifications and prior experience:
1. Price: Price evaluation will be based on the quote’s Total Evaluated Price. Total evaluated price is the total pricing of the quote for the basic requirement together with any options exercised at the time of the award. The Government reserves the right to award any or no options at or after the time of award. Options may be exercised in any combination, order, or grouping deemed in the judgment of the Contracting Officer to offer the best value to the Government.
2. Technical Requirements: Quoter must meet the criteria below
a) The quoter must be a Licensed California Contractor.
b) The quoter must show a minimum of 3 years (from the issuance of solicitation) of prior experience in HVAC Installation and preventative maintenance.
3. Evaluation process: The quotes received will be ordered from lowest to highest by total evaluated price.
The quote with the lowest total evaluated price will be reviewed for technical acceptability, conformance to the RFQ, and responsibility. If the quote is found to be technically acceptable, the quote conforms to the RFQ, and the quoter is found to be responsible, then the award will be made to that quoter. If the quote is found to be not technically acceptable, the quote does not conform to the RFQ, or the quoter is found to be not responsible, then the quote with the next lowest total evaluated price will be evaluated. This process will be continued until a quote is found to be technically acceptable and award can be made to a responsible quoter that conforms to the RFQ requirements.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
140P8123Q0092 Amendment 0001
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
C. The quote due date changes from 8/10/2023 at 2pm to 8/14/2023 at 2pm.
