2. The scope included the second floor of the

Johnson Kitchen Dependency and the central hall of the Johnson residence second floor.

Which is accurate and will there be an addendum published. Could you also restate bonding requirements?

Answer 1:

In response to 1 & 2; Larry accidentally failed to include the two upstairs rooms of the dependency on the walk through. What's in the statement of work is correct.

As for the bonding requirements; see the attached highlighted version of FAR Part 28.

I will post an amendment today showing your questions, answers provided and FAR 28 attachment provided.

Question 2: I didn't see any language in the solicitation documents about a bid or payment bond. At the onsite meeting, a payment bond was addressed. Would you clarify the specific requirements.

Answer 2: Based off the magnitude of construction being between 75K and 125K FAR

Clause 52.228-13, Alternative Payment Protections applies to this solicitation (see clause below and ref FAR 28 attachment as well). In looking through the solicitation when I received your email it appears I missed putting this in the clauses. I'm getting ready to post an amendment if not today by tomorrow so when I post the amendment I will add this clause in at that time as well since it appears I overlooked it when I was putting the clauses together.

52.228-13 -- Alternative Payment Protections.

As prescribed in 28.102-3(b), insert the following clause:

Alternative Payment Protections (Jul 2000)

(a) The Contractor shall submit one of the following payment protections:

(i) A payment bond.

(ii) An irrevocable letter of credit (ILC).

(iii) A tripartite escrow agreement. The prime contractor establishes an escrow account in a federally insured financial institution and enters into a tripartite escrow agreement with the financial institution, as escrow agent, and

The Government makes payments to the contractor¿s escrow account, and the escrow agent distributes the payments in accordance with the agreement, or triggers the disputes resolution procedures if required.

(iv) Certificates of deposit. The contractor deposits certificates of deposit from a federally insured financial institution with the contracting officer, in an acceptable form, executable by the contracting officer.

(v) A deposit of the types of security listed in 28.204-1 and 28.204-2.

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within ______ days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

Due to the government representative at the July

26, 2019 site visit accidentally failing to include the two upstairs rooms of the Johnson

Kitchen Dependency on the walk through attached are pictures of the two upstairs rooms of the

Johnson Kitchen Dependency. Also, each contractor that attended the July 26, 2019 site visit will be offered a return site visit on

Thursday, August 1, 2019, at 10:00 am CST to see the two rooms erroneously left off the original walk through.

FAR Clause 52.228-13 was erroneously left out of the original clauses and therefore is added below as it applies to this requirement.
