About this file
This document is a Questions and Answers file for Solicitation 140FNR25Q0014, a contract opportunity with the Department of the Interior Fish and Wildlife Service for ESFO-TSCS Negotiations Support. The Q&A addresses several key clarifications, including revisions to the Performance Work Statement (PWS) regarding deliverables, specifically the cultural claim document and database. The contracting agency clarified that the cultural claim document will be added to Section 5.2 of the PWS, and modified evaluation criteria for Technical Capability.
Key changes include resolving contract type ambiguity (confirmed as firm fixed price), adjusting deliverable timelines and review processes, and removing certain evaluation criteria requirements. The solicitation involves Natural Resource Damage Assessment (NRDA) negotiation support, with the government making modifications to address contractor concerns about scheduling, review processes, and task specifics. The contract aims to provide negotiation support services, with the government making procedural adjustments to improve clarity and feasibility for potential offerors.

Question 1 Performance Work Statement (PWS), Page 7 – Section 5.1
· Includes “Draft final cultural claim document and database” as a task. However, this task is not included in the Deliverables due date table in Section 5.2. Further, the Draft final cultural claim document and database were delivered to the FWS at the completion of the previous contract on this project. Can the Government please confirm that “Draft final cultural claim document and database” should be removed from section 5.1? Otherwise, if another version of the cultural claim document and database are to be produced under this current contract please also add it to Section 5.2. This clarification is important, as it will affect our level of effort and cost assumptions, and thus our ability to respond to the request for quotation.
Answer
Draft final cultural claim document and database is added to Section 5.2.
Question 2
Performance Work Statement (PWS), Page 7 – Section 5.2:
· We note that many of the deliverables are to assist the Government in developing or preparing items. We are fully prepared to provide this support in a timely manner. However, it is challenging to commit to due dates in which we are merely assisting with a task that the Government is leading and therefore in control of the schedule. We also recognize that other factors may affect the schedule, such as the responsiveness of the PRPs, and that the Government has many responsibilities outside of this project that may affect the schedule. It would be helpful if the “due date” language could be adjusted to “due date, dependent upon Government scheduling”, or something similar. If dates are a strict requirement for the PWS, perhaps a range could be given (e.g, “1-3 months” rather than “30 days”)?
· We further note that many of these tasks require at least two levels of review – the Government and the Cherokee Nation, and in our experience, it has been sometimes difficult to stay within “due dates” due to logistical scheduling challenges with large groups, despite our best efforts (ie – things beyond our control may lead to not meeting “due dates”).
· If Due Dates are retained in the PWS, can the timelines under section 5.2 and timelines under the Performance Requirements Summary (page 9) be reconciled? Under Section 5.2, the contractor is allocated 30 days to respond to comments under most tasks, but under the Performance Requirements Summary, the contractor is required to respond within 10 days. Can the Performance Requirements Summary be adjusted from 10 to 30 days?
· The third deliverable states “Finalize Ecological and Cultural presentation based on Trustee feedback”. Given we are to only “…assist in preparing Ecological claim presentation” in the first task, perhaps this language should be adjusted to “Finalize the Cultural presentation and assist with finalizing the Cultural presentation…”? This distinction is important for us in order to determine level of effort needed to complete the requested tasks
Answer
The Performance Work Statement has bee revised to address these concerns. Changes to the PWS are highlighted in yellow.
Question 3
Time and Materials vs Firm Fixed Price
· Page 44 of the SOL specifies that this is anticipated to be a time and materials contract. This makes sense to us, given the nature of the work. However, Section 52.212-2 (page 46) of the SOL and in Section 1.6.6 of the PWS (page 2), it is stated that the contract will be firm fixed price. Can the Government please confirm that the contract is anticipated to be time and materials? This is important information for our ability to price and respond to the request for quotation.
Answer
The solicitation is amended to reflect a firm fixed price contract.
Question 3
Evaluation Factor 2, Technical Capability (page 47 of the SOL)
· #1 states that Offerors shall submit and operation plan and a self-inspection plan. We are familiar with developing work plans for NRDA projects, but not operation and self-inspection plans. Can the Government please provide further context for these documents?
· #2 states that Quoters shall provide a written, job-specific safety plan to avoid harming birds in their habitat. Can the Government please provide further clarification on this requirement, in the context of the requested NRDA negotiation support tasks?
· #4 requires providing a copy of any applicable license required to perform this contract – can the Government confirm that none are required for this contract? Or specify which licenses are required?
Answer
The evaluation criteria has been amended for Evaluation Factor 2 Technical Capability.
1. Offerors shall demonstrate their capability to meet the requirements in the PWS.
#2 and #4 have been removed from the evaluation criteria.
