A. The purpose of this amendment is to respond to contractor questions, change the contract type, provide an interested vendor list and extend the proposal due date.
B. The following contractor questions and Government response are provided for consideration:
1. Contractor Question: Does the facility have a roofer who currently has a warranty on the roof?
What type of roof is existing?
Government Response: Roof is not under warranty. The roof is of the fully adhered single-ply membrane type.
2. Contractor Question: Spec section 230548 Vibration and Seismic- submit signed and sealed shop drawings with design calculations and assumptions indicating maximum sound levels are not exceeded- can the stamped drawings for shop drawings be removed from spec’s?
Government Response: No, the requirement for stamped shop drawings will not be removed.
As per Specification 230529 - HANGERS AND SUPPORTS FOR HVAC PIPING AND EQUIPMENT, a delegated design submittal is required for all new piping per Section 1.5.F. If determined it is necessary by the sealed registrant that they are needed, it is acceptable for the contractor to include any isolators as part of the 230529 section.
3. Contractor Question: To go along with section 230548 Vibration and Seismic- they are asking the test and balance contractor to do measurements for noise and deflection- can this be removed from spec’s?
Government Response: Yes, Specification 230548, paragraph 1.4.F. shall be removed.
4. Contractor Question: Will the gov’t have a 3rd party consultant as it’s program manager?
Government Response: Yes, the design engineer on the project will provide service such as in field commissioning of systems and BAS. The testing plan for the recent chiller project has been provided for example reference and is attached to this amendment.
5. Contractor Question: We have noticed that the hydronic specification (232113) only allows copper piping. The current heating hydronic piping for this facility is schedule 40 carbon steel.
We would like for this to be an option in the specifications for hydronic piping (232113) consider the following.
PIPE – 2 ½ or larger schedule 40 carbon steel, with grooved ends or prepped for welding PIPE – 2” or smaller schedule 40 carbon steel, with threaded ends. Copper type “L” FITTINGS – 2 ½ or larger, groove style fittings or manufactured weld fittings FITTINGS – 2” or smaller, threaded malleable fittings, or copper fittings
Are the above items acceptable for the installation of the heating hydronic piping?

Government Response: The proposed alternates options listed in the inquiry, are compliant with the Mechanical Code and are acceptable.
6. Contractor Question: The hydronic spec’s call for all the heating water to be type K or M copper. Can steel pipe with either weld fittings or grooved fittings be used?
Government Response: Please see response to Question 5 above.
7. Contractor Question: In the solicitation, there is a requirement for a temporary fuel fired heater.
Is it possible to save time and cost if we simply put electric space heaters throughout the office vs a major rental and installation of a temporary boiler?
Government Response: Electric space heaters for temporary heat are not acceptable. The Government does require the contractor to provide temporary heat to the facility during construction. Contractor to install emergency boiler connections and isolation valves in hydronic heating water pipe as shown on Sheet M2.0 Keynote #8 and Keynote #10. Once complete, contractor to provide minimum 1,200 MBH temporary gas boiler and pump and connect to existing electrical service, natural gas piping and hydronic heating water piping. Temporary gas boiler system is required to be operational prior to any disconnection of existing heating system, and to be maintained through substantial completion.
8. Contractor Question: We would like to have substitute materials and equipment preapproved?
Government Response: The Government does not preapprove materials and equipment during the solicitation phase of the acquisition. It is the successful contractor’s responsibility to comply with the design specifications and drawings. Any reference to a manufacturers products or equipment are intended to establish a level of quality and are the basis of design, unless otherwise specified.
9. Contractor Question: We are concerned the period of performance does not take in to account the long lead time equipment items.
Government Response: We will work with the successful contractor and issue 2 Notice to Proceed letters. The first will be for material, equipment, review, approval and ordering. This will not count against the overall performance. Once we have delivery dates established for any long lead-time items, we will then work with the contractor to determine the best date to issue the construction NTP.

10. Contractor Question: Can the bid bond be turned in electronically in lieu of sending a hard copy version?
Government Response: A bid bond is required and must be submitted electronically, with the proposal. Mail only the paper bid bond to the Lakewood office address, Contracting, Lake Plaza North, 134 Union Blvd, Lakewood CO 80228.
C. Contract clause 52.216-4 Economic Price Adjustment-Labor and Material, Jan 2017 is hereby added to the solicitation, contract clauses Section I, page 14. The application and use of the clause shall be based on Federal Acquisition Regulation (FAR) 16.203-1 Description, paragraph “(a) A fixed-price contract with economic price adjustment provides for upward and downward revision of the stated contract price upon the occurrence of specified contingencies. Economic price adjustments are of three general types:…(2) Adjustments based on actual costs of labor or material. These price adjustments are based on increases or decreases in specified costs of labor or material that the contractor actually experiences during contract performance.” Specified costs are those costs cited in the bid/proposal schedule, pages 6.
Specified contingencies are those associated with the current market conditions, supply, and manufacturing of construction materials, as impacted by the on-going effects of the Coronavirus pandemic.
Economic Price Adjustment-Labor and Material (Jan 2017)
(a) The Contractor shall notify the Contracting Officer if, at any time during contract performance, the rate of pay for labor (including fringe benefits) or the unit prices for material shown in the Schedule either increase or decrease. The Contractor shall furnish this notice within 60 days after the increase or decrease, or within any additional period that the Contracting Officer may approve in writing, but not later than the date of final payment under this contract. The notice shall include the Contractor’s proposal for an adjustment in the contract unit prices to be negotiated under paragraph (b) of this clause, and shall include, in the form required by the Contracting Officer, supporting data explaining the cause, effective date, and amount of the increase or decrease and the amount of the Contractor’s adjustment proposal.
(b) Promptly after the Contracting Officer receives the notice and data under paragraph (a) of this clause, the Contracting Officer and the Contractor shall negotiate a price adjustment in the contract unit prices and its effective date. However, the Contracting Officer may postpone the negotiations until an accumulation of increases and decreases in the labor rates (including fringe benefits) and unit prices of material shown in the Schedule results in an adjustment allowable under paragraph (c)(3) of this clause. The Contracting Officer shall modify this contract (1)to include the price adjustment and its effective date and (2)to revise the labor rates (including fringe benefits) or unit prices of material as shown in the Schedule to reflect the increases or decreases resulting from the adjustment.
The Contractor shall continue performance pending agreement on, or determination of, any adjustment and its effective date.
(c) Any price adjustment under this clause is subject to the following limitations:
(1) Any adjustment shall be limited to the effect on unit prices of the increases or decreases in the rates of pay for labor (including fringe benefits) or unit prices for material shown in the Schedule. There shall be no adjustment for-
(i) Supplies or services for which the production cost is not affected by such changes;

(ii) Changes in rates or unit prices other than those shown in the Schedule; or
(iii) Changes in the quantities of labor or material used from those shown in the Schedule for each item.
(2) No upward adjustment shall apply to supplies or services that are required to be delivered or performed before the effective date of the adjustment, unless the Contractor’s failure to deliver or perform according to the delivery schedule results from causes beyond the Contractor’s control and without its fault or negligence, within the meaning of the Default clause.
(3) There shall be no adjustment for any change in rates of pay for labor (including fringe benefits) or unit prices for material which would not result in a net change of at least 3 percent of the then-current total contract price. This limitation shall not apply, however, if, after final delivery of all line items, either party requests an adjustment under paragraph (b) of this clause.
(4) The aggregate of the increases in any contract unit price made under this clause shall not exceed 10 percent of the original unit price. There is no percentage limitation on the amount of decreases that may be made under this clause.
(d) The Contracting Officer may examine the Contractor’s books, records, and other supporting data relevant to the cost of labor (including fringe benefits) and material during all reasonable times until the end of 3 years after the date of final payment under this contract or the time periods specified in subpart 4.7 of the Federal Acquisition Regulation (FAR), whichever is earlier.
