Q# Vendor Question Government Response

Could you please tell me if this is a new requirement, or if there is a current or previous contractor who has performed similar services? If available, can you please send along the incumbent contract or task order number?

The current contrator for these services is American Medical Foundation under contract number PC-15-9-008.

Objectives (page 6), Scope (page7), Tasks (page 7), Project Milestones/Completion Date (page 8), Delivery (page 8), Security Considerations (page 8), Period of Performance (pages 9 and 10) – In each of these sections, the contractor is asked to “provide a PSWP”, or to “deliver PSWP”, can you please clarify what the Government means when it refers to “PSWP”? PSWP is the information that is protected by the privilege and confidentiality protections of the Act and the Final Rule, until it is in a de-identified form. PSWP may identify providers, and or a provider/employee that reported information, it may also include PHI.

Is the term “PSWP” intended to refer to information that is protected as a result of being submitted by the Peace Corps to a PSO, and/or to deliverables and services (i.e., Task 1 Analysis for OHS and Task 2 Peer Review), provided by the PSO contractor to the Peace Corps, which include de-identified information?

Patient Safety Work Product (PSWP) refers to the deliverables and services provided by the PSO contractor to Peace Corps.

3 (Pages 7 and 8) On average, how many analyses and peer reviews does the Peace Corps expect the PSO to perform per year? The number of tasks will vary, depending on the number of sentinel events that occur each year.

4 Will the Peace Corps perform a Root Cause Analysis (RCA) and share that information with the PSO for analysis? Or is it the intention that the PSO awardee will perform the RCA?

Patient Safety Events are reviewed internally and then determine the need to refer to PSO contractor to perform RCA.

5 How does the Peace Corps intend on sharing PSWP and additional information with the PSO awardee (i.e., via secure website)?

The PSO will be responsible for setting up a secure, web-based portal for document exchange.

6 What documents will be made accessible to the PSO in order to evaluate the events (i.e., medical records, results or findings from the Peace Corps)?

All necessary documents (health records, diagnotic reports, timeline of events, etc.) related to the PSE will be accessible to the PSO to perform a full RCA with recommendations.

7 Please provide clarification on how a contractor provides a “complete PSWP within 30 business days of BPA call award.” Is this meant to be the completion of the deliverables from Task 1 and Task 2?

It is expected that deliverables from Tasks 1 and 2 will be completed within 30 days of BPA call order award. Extensions may be granted, based on relevant circumstances.

(Page 8, Project Milestones/Completion Date and Delivery) In order to complete Tasks 1 and 2, the Peace Corps will need to share documents and other information with the PSO; does the 30 business day due date for deliverables begin when the Peace Corps has shared all relevant information with the

PSO?

The 30 business day due date for deliverables begins when the Peace Corps has shared all relevant information with the PSO. An extension may be granted, based on the circumstances of the event.

9 May we include an appendix to Volume I with biographies of anticipated staff members to illustrate experience and expertise? If so, can this appendix be excluded from the overall page count?

An appendix to Volume I, that consists of staff experience and expertise, may be provided. The appendix is limited to three (3) pages.

Amendment 1 - Patient Safety Organization (PSO) RFQ 140D0420Q0456 Technical Questions and Answers

10 (Page 24) Is the overall page limit for Volume I 20 pages (10 pages for Factor 1 and 10 pages for Factor 2)?

The overall page limit for Volume I is ten (10) pages. The 10 page total limit includes submissions for both Factors 1 and 2.

In the event that an award(s) is made, will the Government agree to the inclusion of certain supplementary terms and conditions to the Government’s contract so that proper PSO protections apply, and so that the Government and the PSO’s rights and obligations with respect to PSWP are clearly defined consistent with the Act and Final Rule?

Government will review and may consider supplementary terms and condiitons consistent with the Patient Safety Act, and Patient Safety Quality Improvement Final Rule.

Travel (page 5), and Place of Performance (page 9) – Does the Government anticipate the awardee to travel for this contract? If so, where are the localities at which the onsite work is anticipated to be performed?

Travel is rarely necessary. In the event that travel is necessary, the list of Peace Corps countries can be found at: https://www.peacecorps.gov/countries/

Security Considerations (page 9) - Is the requirement to have a continuity of operations plan (COOP) satisfied by providing proof of: privacy/security policies and procedures, as well as encryption and redundant back-up procedures and policies?

Yes, the requirement to have a continuity of operations plan (COOP) is satisfied by providing proof of:

privacy/security policies and procedures, as well as encryption and redundant back-up procedures and policies. These security measures are required for day to day operations and in the event of a cyber incident/breach of PII.

FAR 52.217-8 – Option to Extend Services (1999) – Please clarify whether additional funds will be paid to contractor(s), in excess of the $250,000, if the Government requires continued performance of any services for a period of up to six additional months.

RFQ 140D0420Q0456 requires that the vendor's quote include pricing for an additional 6-month option period under FAR 52.217-8. In the event FAR 52.217-8 is exercised, it will be done in accordance with the price quoted by the awarded contractor during the solicitation process.

Volume II Pricing (page 25) - Please confirm that the "Representations and Certifications," "Responsibility Statement" and accompanying documents, and the "OCI," as applicable, are NOT part of the 5 page limit for Volume II.

Representations and Certifications, Responsibility Statement and OCI are not included in the five (5) page limit for Volume II.

(Page 27, Factor 2, Technical Experience, Part (b)): We are required by the PSO Act, Final Rule, and by the contractual terms of our agreements with our members to maintain confidentiality and privacy of our members and their contracts, as well as the services that we provide to them, and so we cannot provide the information requested in Part (b). Please confirm that it is acceptable to provide general and deidentified information about our experience as a PSO to satisfy the requirements of this section.

Relevant experience gained under Government contracts is requested. Disclosure of experience that violates any privacy rules, regulations or agreements is not required, though a general description is requested.
