About this file
This is a Liquidated Damages Form from the Town of Palm Beach, Florida, establishing the financial penalties and accountability structure for contractors failing to meet project completion deadlines. The form serves as a contractual acknowledgment that both the Town and Contractor recognize the difficulty in calculating actual damages resulting from delayed completion, thereby establishing predetermined daily penalties. Under the terms outlined, the Contractor and the Contractor's surety are jointly liable for liquidated damages accruing for each calendar day following the scheduled completion date, including any approved time extensions documented in written Change Orders. If the Contractor is terminated for default prior to project completion, liquidated damages continue to accrue against the Contractor until the work is finally completed. The form requires the Contractor to sign and confirm understanding and compliance with these liquidated damages provisions.
The form is applicable to the Town of Palm Beach's solicitation for compacted garbage collection and disposal services. Contractors responding to this Invitation to Bid must acknowledge their understanding of the liquidated damages requirement by completing and submitting the signed form with their bid proposal. The specific daily damage amount is not specified in this form document itself but would be detailed in the primary bid solicitation documents. This provision ensures that contractors maintain financial responsibility and motivation for timely project completion, with damages assessed continuously until work completion is achieved.
