PERFORMANCE WORK STATEMENT for:

Trash Disposal and Recycling Services, NIST, Boulder Site

NATIONAL INSTITUTE OF STANDARDS & TECHNOLOGY

United States Department of Commerce

325 Broadway Boulder, CO 80305

10 NOVEMBER, 2020

1.0 DESCRIPTION OF SERVICES.

This basic contract Performance Work Statement (PWS) defines the scope of the trash collection, disposal and recycling services required for the National Institute of Standards and Technology (NIST) campus at Boulder, Colorado. The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision and other items and services necessary to perform the trash collection, disposal and recycling services for the site for one year. The Contractor shall perform to the standards in the contract as well as all local, state and federal laws, regulations, standards, instructions and commercial practices.

The contractor is expected to propose and implement innovative management practices throughout the service period to minimize the cost of performing trash (Municipal Solid Waste or MSW) collection and disposal and recycling services by utilizing best commercial practices which benefit both the environment and the Department of Commerce (DoC). Provide a copy of the Quality Control Plan detailing the Contractor’s strategy to provide innovative solutions to the site’s trash and recycling waste streams with the proposal. A breakdown of the costs between recycling and trash removal shall be included in the proposal. The PWS includes requirements for the quality control plan, and periodic reports to measure contract performance. An estimate of the workload is included in Attachment 1 and is based on historical data. A sketch of the site and the current locations of bins and dumpsters is also included in Attachment 2.

1.1 COLLECTION REQUIREMENTS.

The Contractor shall establish initial vehicle routes, bin sizes and locations, and collection schedules for both trash and recyclables upon contract award. At a minimum, provide a map with routes, collection locations and bin sizes clearly annotated, with collection dates provided separately or on the map. They are to be submitted to the Contracting Officer (CO) 14 calendar days prior to start of contract performance. The Contractor may propose adjustments to the route or locations or schedule at any time to the Contracting Officer’s Representative (COR) or CO for coordination and approval. Adjustments must be justified by actual container fill data collected over a 30-day period minimum. Historical pickup frequency is located in Attachment 1, for each location and bin. When the Contractor completes service at a location there shall be no litter, waste or recyclable material on the ground within a 10-foot radius of the container(s).

1.1.1 Trash Pickup and Disposal.

The Contractor shall furnish a sufficient number and size of trash collection containers to meet trash collection requirements for the site. The Contractor may propose adjustments to the locations, container sizes or collection schedule to ensure that all site trash is collected and disposed, while avoiding dumpster/bin overflow and utilizing the minimum amount of required pickups and trash containers. No trash compacting shall be conducted within 200 yards of any residential structure. The Contractor shall transport and dispose of all trash at a permitted off-site disposal site. The Contractor is responsible for disposal being in accordance with existing local, state and federal regulations. The Contractor shall be responsible for any permit or fees associated with the use of off-site disposal facilities.

1.1.1.1 Unauthorized Materials in Trash Containers.

If there is a noticeable amount of recyclables or other known unauthorized material (hazardous waste, tires, batteries, etc.) in a trash container, the Contractor shall not empty it. The Contractor shall immediately notify the COR verbally, giving the location, building number, the potentially recyclable commodity (cardboard, metal, etc.) found, or the description of the unauthorized material. Photographic evidence may also be provided electronically. The COR will contact the facility manager or responsible party and have the materials removed and properly dispositioned. The Contractor, at their discretion, may remove recyclables and dispose of them properly but shall not remove possible hazardous waste from containers.

Depending on collection schedule, the contractor may be required to return to the container the same day at no additional cost or if capacity of the container allows, collection can be performed on the next scheduled day. For informational purposes only, the Contractor shall submit with the quarterly report a summary of all unauthorized material notifications.

PAGE 11 OF 72 1333ND21QNB190101

1.1.2 Recyclable Pickup and Disposal.

The Contractor shall furnish a sufficient number and size of recycling collection containers to meet recyclable collection requirements for the site. The Contractor may propose adjustments to the locations, container sizes or collection schedule to ensure that all site recycling is collected and disposed, while avoiding container overflow and utilizing the minimum amount of required pickups and recyclable containers. The Contractor shall transport and dispose of all recyclables at a permitted off-site disposal site. The Contractor is responsible for disposal being in accordance with existing local, state and federal regulations. The Contractor shall be responsible for any permit or fees associated with the use of off-site recycling facilities.

1.1.3 Unauthorized Materials in Recyclable Containers.

If a noticeable amount of non-recyclable material is observed in a recycling bin, the Contractor shall immediately notify the COR verbally, giving the location, building number, and a description of the unauthorized material. Photographic evidence may also be provided electronically. The COR will contact the facility manager or responsible party and have the materials removed and properly dispositioned. The Contractor, at their discretion, may remove non-recyclables and dispose of them properly but shall not remove possible hazardous waste from containers. Depending on collection schedule, the contractor may be required to return to the container the same day at no additional cost or if capacity of the container allows, collection can be performed on the next scheduled day. For informational purposes only, the Contractor shall submit with the quarterly report a summary of all unauthorized material notifications.

1.1.4 On Demand Services (contract line item number X003)

The Contractor shall provide a separate price listing for weekly and monthly rental and cost per pickup of the following sized containers (in cubic yards, CY) for both trash and recyclables: 3 CY bin, 3 CY Bear Proof bin, 6 CY bin, 8 CY bin, 8 CY Bear Proof bin, 20 CY dumpster and 30 CY dumpster. Prices are to be included for out-years as well. See Schedule B of the SF-1449 for the pricing schedule. The CO or COR will provide written requests for all on demand service requirements with locations, dates and container(s) sizes. In addition to the established scheduled collections, the CO or COR may request the Contractor make unscheduled additional collections and disposals using this price listing. The Contractor shall respond within 24 hours of notification.

1.1.5 Container Relocations.

Occasionally containers will need to be relocated for various reasons (construction, roadwork, road closures, etc.). The CO or COR will provide written request to the Contractor when relocation is required. Relocation is to be accomplished on the next scheduled collection day for the affected containers.

1.1.6 Inclement Weather and Site Shutdown.

The Contractor shall collect trash and recyclable material during periods of inclement weather. In cases of severe weather, the CO or COR may authorize exceptions. When exceptions are granted, all missed collections shall be performed within 24 hours after the severe weather has ended, unless authorized additional time. In the event of a site shutdown, all missed collections shall be performed within 24 hours after site re-opening unless authorized additional time.

1.1.7 Route and Collection Parameters

The Contractor shall enter the site from the Broadway Gate entrance. All vehicles are subject to search and potential delays.

Collection shall be made during a two-hour period, from 06:30 to 08:30, on Tuesdays through Saturdays only, excluding federal holidays. No compaction of trash shall be done within 200 yards of any residence. Routes and bin locations on site are subject to change due to construction and other temporary conditions.

1.1.8 Points of Collection.

Current container locations for trash and recyclable material are shown in Attachment 2. The Contractor shall position containers for customer ease in depositing materials, to minimize interference with parking areas, sidewalks, roadways, overhead utilities, trees, storm drains, and other obstructions. The quantity, capacity size, and type of container at designated locations will be determined by the Contractor and approved by the CO or COR.

1.1.9 Government Approval of Containers

PAGE 12 OF 72 1333ND21QNB190101

Containers must be easy to use by the customers. If needed, containers shall include instructions on usage on the container. Cleaning and painting of containers shall be accomplished off site at least once per year or as deemed necessary by the CO or COR in order to maintain a clean and sanitary condition.

1.1.10 Bulk Containers.

Containers shall be able to accommodate bulk items and capacity of supplied containers shall be 20 or 30 cubic yard. Covers are not required. Trash compacting bulk containers shall be self-contained and not open to the elements.

1.1.11 Collection Areas.

The Contractor is responsible for cleaning up any spills, debris or other detritus caused by their operations. If access to a collection area is blocked, the Contractor shall verbally notify the COR to have the access restored. If delayed, pickup may be rescheduled to the next normal day for the containers in the location. The Contractor shall notify the CO or COR of locations where trash and recyclables are frequently placed outside of containers so they may notify the facility managers to correct the situation. The Contractor can adjust the container sizes or pickup frequency with the CO or COR approval.

ADDENDUM TO 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

1. SPECIAL NOTICE TO CONTRACTORS

The Government intends to evaluate proposal and award a contract without discussions. The Government intends to make award to the offeror that presents the quote that provides the best value and most advantageous to the Government, in accordance with FAR Part 13 procedures.

Therefore, the Contractor’s initial proposal should contain the Contractor’s best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the CO (Contracting Officer) later determines them to be necessary.

1.1 Proposal shall clearly demonstrate that the Contractor understands both the general and specific technical requirements of the Scope of Work (PWS).

1.1.1 Failure to explain Contractor’s ability to meet all requirements may result in the Contractor's quotation not being considered. Clarity and completeness of quotations are of the utmost importance. Therefore, quotations must be written in a practical, clear and concise manner.

1.1.2 Proposals which merely restate the requirement or state that the requirement will be met without providing supporting rationale are not sufficient.

1.2 This requirement is being awarded utilizing the procedures established in FAR Part 13 procedures.

1.3 Contractor’s may be asked to clarify certain aspects of their proposal to resolve minor or clerical errors and will not constitute discussions.

1.4 Request for Quote (RFQ) pricing for base and option contract line item numbers (CLIN) 0001 and 4003.

1.4.1 The Contractor agrees to hold the prices in its quotation firm for 120 calendar days from the date specified for receipt of quotations, unless another time period is specified in an addendum to the solicitation. Any quotation providing less that the specified acceptance period will be considered non-responsive, will not be evaluated, and will be ineligible for award.

2. INQUIRIES AND QUESTIONS

2.1 The CO and CS (Contract Specialist) are the only approved points of contact for this acquisition. Address any questions or concerns you may have to both the CO and CS via e-mail to: noah.branscom@nist.gov and denise.steel@nist.gov

2.2 All requests for clarification, inquiries, and questions concerning this solicitation shall be submitted in writing via e-mail to: noah.branscom@nist.gov and denise.steel@nist.gov by 12:00 PM MST, 24 March 2021

Questions and responses will be published to Contract Opportunities (formerly FBO) in the form of an amendment to the solicitation. Even if provided in other form, only the question responses included in the amendment(s) to the solicitation will govern performance of the contract.

3. SOLICITATION RESPONSE REQUIREMENTS

3.1 The Government will evaluate quotations based on comparative analysis between all quotes received in consideration of the factors and requirements outlined in this RFQ.

3.1.1 Any quotation that does not provide sufficient detail to meet the stated solicitation requirements or performance objectives will be considered ineligible for award unless the deficiency is corrected through discussions (See paragraph 1).

Addendum to 52.212-2

PAGE 21 OF 72 1333ND21QNB190101

ADDENEDUM TO 52.212-2 EVALUATION – COMMERCIAL ITEMS

I GENERAL

1. The Government anticipates awarding a firm-fixed-price contract to the contractor whose quotation is found to be the best value and most advantageous to the Government, price and other factors considered. The Government will evaluate quotations based on comparative analysis between quotes received in consideration of the factors and requirements outlined in this RFQ.

2. The Government intends to evaluate the quotations and issue a contract based on the initial quotations received. Therefore, the initial quotation should contain the best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. This statement is not to be construed to mean that the Government is obligated to conduct discussions or exchanges.

3. Failure to provide a reasonable and complete quotation may reflect a lack of understanding of the requirements and may result in elimination from further consideration.

4. Quotations which merely restate the requirement or state that the requirement will be met, without providing supporting rationale, are not sufficient.

5. The Contractor shall submit a firm-fixed-price quotation according to the Addendum to 52.212-1 Instructions to Offerors. The factors identified below shall be used to evaluate the quotation.

6. This acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures.

Principles and procedures of FAR Part 15 do not apply. A contractor may be eliminated from consideration without further exchanges if its quotation is not among those considered most advantageous to the Government based the requirements of this solicitation.

7. The contract resulting from this solicitation will be awarded to the responsible Quoter whose quotation conforms to the solicitation and is determined to be the best value to the Government considering Price (Factor A, Technical Details (Factor B), and Past Performance (Factor C).

8. By submission of its quotation, the contractor is required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in a quotation being ineligible for award. Contractors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

II FACTOR A – PRICE:

1. Price submittals will be subjectively evaluated to determine the reasonableness of the quotations for overall price and individual CLIN pricing. The Government will not conduct price realism analysis as part of its price evaluation. The Government will evaluate the quotation using price analysis techniques to determine fairness and reasonableness in relation to the PWS requirements. One or more of the following techniques will be used to ensure a fair and reasonable price:

1.1 Comparison of quoted prices received in response to the Solicitation.

1.2 Comparison of quoted prices with the IGE.

1.3 Comparison of quoted prices with available historical information.

1.4 A total contract price or individual CLIN price that is found to be either unreasonably high or low in relation to the proposed work may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the overall quotation being removed from further consideration.

2. Any inconsistency, whether real or apparent, between quoted performance and price/cost must be clearly explained in the price quotation. For example, if unique and innovative approaches

PAGE 22 OF 72 1333ND21QNB190101

are the basis for an apparently unbalanced/inconsistently priced quotation, the nature of these approaches and their impact on price must be completely documented.

3. A quotation whose price is determined to be unbalanced across CLINs (i.e. unreasonably high for one CLIN and unreasonably low for one CLIN) may not be considered for award and may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.

4. The Government reserves the right to ask for any additional price related information to determine a price to be fair and reasonable.

III NON-PRICE / TECHNICAL EVALUATION

1. The Government shall evaluate the non-price / technical portion of the quotation. This evaluation shall be conducted by comparison of submitted technical details for Factor B.

Factor C shall be evaluated by comparison of information available to the CO (CPARS, FAPIIS, SAM, etc.) Any aspect evaluated that does not meet the requirements of the RFQ may render the entire quotation as unawardable. Only those quotations determined, either initially or as a result of discussions, as meeting the RFQ requirements will be considered for award. However, contractors are reminded that the Government reserves the right to award this effort based on the initial quotations, as received, without discussions.

2. The quotations shall be evaluated against the following technical factor:

2.1 FACTOR (B) - TECHNICAL APPROACH

2.1.1 Evaluation of this factor is a subjective evaluation of the Offeror’s understanding of the contract requirements (clauses, provisions and the PWS) and demonstrated ability to meet contract requirements and PWS tasks based on its proposed technical details.

2.1.2 Technical details which do not adequately address how the Quoter proposes to meet the requirements may not be deemed as a best value to the Government. A technical approach which is primarily a copy and paste version of the PWS requirements and performance standards will not be considered for award.

2.2 FACTOR (C) – PAST PERFORMANCE

2.2.1 Evaluation of this factor shall be accomplished by the Government, including but not limited to the resources identified in FAR Part 13. The past performance evaluation will assess the relative risks associated with an offeror's likelihood of success in fulfilling the solicitation's requirements as indicated by the offeror's record of past performance. In this context, "offeror" refers to the prime contractor. Present and past performance shall be evaluated as a measure of the Government's confidence in the offeror's ability to successfully perform based on previous and current contract efforts.

2.2.2 Past performance will be determined to be relevant if it demonstrates performance on a contract involving work that is similar in nature, size, and complexity to the requirements being procured under this solicitation.
