NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION (NOAA)
STATEMENT OF WORK (SOW)
CONTAINERIZED HAZARDOUS WASTE DISPOSAL
1.0 GENERAL
1.1 OBJECTIVE
The objective is to have containerized hazardous waste removed from the storage site and properly dispose of it at an Environmental Protection Agency (EPA) state licensed and accredited waste management disposal facility.
1.2 BACKGROUND
The National Weather Service (NWS) Eastern Region (ER) has a requirement for the transportation and disposal of hazardous materials. Containerized protective coating materials are beyond their expected application use due to age, and their end of life is past the product’s expiration date. These products can no longer be used for their intended purposes.
1.3 SCOPE
1.3.1 Non-personal services for the transportation and disposal of hazardous materials to a final disposal facility. The scope includes removal of containerized hazardous materials from a storage facility rented by the Government, transportation of the containers in accordance with Environmental Protection Agency (EPA) regulations, and handoff of the containers to an EPA state licensed and accredited waste management disposal facility that accepts the waste.
The Contractor is to include any permit fees, manifest fees, transportation labeling fees, and/or recovery fees.
1.3.2 The quantities for pick-up, waste transportation and final disposal to an EPA state licensed and accredited waste management disposal facility under this contract are as follows:

1.3.3 The Contractor shall contact and brief the Government Technical Point of Contact
(TPOC) prior to starting any work. The Contractor shall perform a visual inspection of all containers prior to any movement. The Contractor shall not move any containers found to be leaking at time of inspection. The Contractor shall remove only fully sealed, non-leaking containers from the site for over the road waste transportation.
2.0 PERIOD OF PERFORMANCE
The period of performance for this contract shall not exceed thirty (30) calendar days from the date of award.
3.0 PLACE OF PERFORMANCE
3.1 PRIMARY PLACE OF PERFORMANCE

3.2 SITE SPECIFIC INFORMATION
The Government will provide the Contractor with access to the job site as necessary for performance of the work.
The storage unit is secured by the Government and access must be arranged in advance through the Government TPOC or Government LPOC.
Access to the storage unit includes the following:

3.3 HOURS OF OPERATION
The Contractor shall contact the Government TPOC or Government LPOC to obtain hours and arrange access.
4.0 APPLICABLE DOCUMENTS
4.1 COMPLIANCE DOCUMENTS
The Contractor shall comply with the following documents that provide specifications, standards, or guidelines that must be complied with in order to meet the requirements of this contract:

49 CFR Parts 100-185 Hazardous Material Regulations

5.0 SPECIFIC REQUIREMENTS/TASKS
The Contractor shall provide all labor, tools, supplies, materials, transportation, services, and supervision required to perform all work outlined in this SOW.
All work shall be performed and completed in a workmanship-like manner and in accordance with the latest proven practices of the trade by thoroughly skilled and experienced workers.
DANGER: The handling of hazardous materials can be dangerous.
WARNING: Handling of hazardous chemicals should be performed by Qualified Personnel only. Keep unauthorized personnel away from these materials.
5.1 TASK ONE: PICK-UP ARRANGEMENTS
The Contractor shall contact the Government LPOC in advance of their visit to the pick-up location. The property is not owned by the Government; however, only the Government can provide access to the secure unit where the containerized hazardous materials reside.
The Contractor shall not proceed to the location without an agreed upon date and time provided by the Government LPOC.
5.2 TASK TWO: LOAD CONTAINERIZED HAZARDOUS MATERIALS ONTO VEHICLE
The Contractor shall visually inspect each container prior to movement.
If the Contractor’s inspection reveals any leakage, the Contractor shall bring this to the attention of the Government LPOC. The Government LPOC must then perform an inspection.
The Contractor shall remove all containerized hazardous waste during one site visit.
Any damage caused by the Contractor shall be totally cleaned up by the Contractor in accordance with any EPA and/or storage unit requirements.
5.3 TASK THREE: TRANSPORT CONTAINERIZED HAZARDOUS WASTE
The Contractor shall deliver containers directly to an EPA state licensed and accredited waste management disposal facility.
5.4 TASK FOUR: PROPERLY DISPOSE OF HAZARDOUS WASTE
The Contractor shall dispose of all removed hazardous waste through a licensed and accredited EPA waste management facility. Proof of proper disposal is required and shall be provided to the Government TPOC.
6.0 CONTRACTOR PERSONNEL
6.1 QUALIFIED PERSONNEL
The Contractor shall provide qualified personnel to perform all of the requirements specified in this SOW.
The Contractor shall ensure that all personnel performing the work are trained in OSHA 29 CFR 1910, 49 CFR Parts 100-185, and the proper use of personal protective equipment (PPE).
At a minimum, the Contractor is required to have one (1) hazardous material (HAZMAT) trained worker onsite at all times work is being performed.
Any additional workers at the site must also be trained in hazardous material recognition and the awareness of hazardous chemicals to protect the Contractor’s employees from physical exposure to the dangers of spills or contact.
Only qualified personnel may handle the containerized hazardous waste. A “qualified person” is defined as one who has skills and knowledge related to proper handling and has also received safety training to recognize and avoid all hazards involved. The qualified personnel shall be properly trained regarding working safely around chemicals and shall be familiar with the proper use of special precautionary techniques, and PPE.
6.2 PROJECT MANAGER
The Contractor shall provide a Project Manager who shall be responsible for all Contractor work performed under this SOW.
The Contractor’s Project Manager shall be a single point of contact for the Government TPOC. The name of the Contractor’s Project Manager, and the name(s) of any alternate(s) who shall act for the Contractor in the absence of the Contractor’s Project Manager, shall be provided to the Government TPOC no later than the Post Award Conference. The Contractor’s Project Manager and all designated alternates shall be able to read, write, speak and understand English.
The Contractor’s Project Manager shall be available to the Government TPOC via telephone between the hours of 8:00 a.m. and 5:00 p.m. ET, Monday through Friday, and shall respond to a request for discussion or resolution of any technical problems within two (2) hours of notification.
6.3 EMPLOYEE IDENTIFICATION
Contractor employees shall wear a company identification badge that, at a minimum, displays the Contractor name, the employee’s photo, the employee’s name.
6.4 EMPLOYEE CONDUCT
The Contractor’s Project Manager shall ensure Contractor employees understand and abide by applicable rules, regulations and policies concerning safety and security.
6.5 REMOVING EMPLOYEES FOR MISCONDUCT OR SECURITY REASONS
The Government may, at its sole discretion, direct the Contractor to remove any Contractor employee from performing on this SOW for misconduct or security reasons.
Removal does not relieve the Contractor of the responsibility to continue providing the services required under the contract.
7.0 DELIVERABLES AND EVENTS
7.1 POST AWARD CONFERENCE
The Contractor shall attend a Post Award Conference with the Government TPOC no later than ten (10) calendar days after the date of award. The purpose of the Post Award Conference is to review the Contractor's draft Project Plan and Schedule. The Post Award Conference will be held via a teleconference.
7.2 PROJECT PLAN AND SCHEDULE
The Contractor shall provide a draft Project Plan and Schedule at the Post Award Conference for the Government to review and provide initial comment. The Contractor shall provide a final Project Plan and Schedule to the Government TPOC not later than five (5) business days after Post Award Conference.
All notifications pertaining to a Contractor’s visit must be approved by the Government in advance of their visit. The Contractor shall confirm the arrival date a minimum of three
(3) business days prior to start with both the Government TPOC and Government LPOC.
The Contractor shall contact the Government TPOC and Government LPOC if inclement weather is in the forecast in order to determine if a delay of the pick-up date/time is necessary.
7.3 SITE COMPLETION (UPDATE) AND FIELD ACTIVITY REPORT
The Contractor shall issue to the Government LPOC all signed waste manifest(s) and, prior to leaving the site, provide a verbal report that summarizes all work that was performed, and identifies any critical issues. The Contractor shall also note any environmental concerns and site conditions.
The Contractor shall issue a written Site Completion Field Activity Report containing applicable manifests, notes and observations, including environmental concerns and site conditions, to the Government TPOC within five (5) business days after completion and acceptance.
The Contractor shall remove from the area all trash, rubbish, packing material, and debris caused by its operations, leaving the job site clean.
7.4 GOVERNMENT ACCEPTANCE PERIOD
The Contractor shall submit deliverables to the Government TPOC for review and acceptance. When performance is acceptable, the Government TPOC will provide the Contractor with notification via electronic mail that provides notification of acceptance or documented reasons for non-acceptance.
The Government TPOC has the right to reject or require the Contractor to make correction of any deficiencies found in the deliverables. In the event of a rejected deliverable, the Contractor will be notified in writing by the Government TPOC with the specific reasons for rejection.
The Government TPOC will have three (3) business days to review deliverables and make comments. The Contractor shall have seven (7) business days to make corrections and re-deliver.
7.5 DELIVERABLES
The Contractor’s Project Manager shall provide deliverable(s) and/or report(s) to the Government TPOC via electronic mail.
