Solicitation 12639523Q0075, HVAC Maintenance, South Texas Border Area Amendment 0003

52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)

The Government will award a combined firm-fixed price and time-and-materials commercial services contract resulting from this best-value, source-selection solicitation to the responsible quoter whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered.

A responsible quoter shall:

• Have the ability to comply with the required delivery or performance schedule, taking into consideration other business commitments.

• Have a satisfactory record of performance and integrity.

• Have a satisfactory safety and environmental record.

• Have satisfactory references (see Past Performance below).

• Have the necessary facilities, equipment, materials, personnel, organization, experience, technical skills, and financial resources to fulfill the terms of the resultant contract.

In this acquisition, the Government will obtain best value by using the Tradeoff Process source selection approach defined at FAR 15.101-1; i.e., an approach that permits tradeoffs among price and non-price factors and allows the Government to accept other than the lowest priced quote. However, the Government will not make an award at a significantly higher overall price to achieve slightly superior technical expertise.

The Government intends to evaluate quotes and award a contract without discussions with quoters (except clarifications as described in FAR 15.306(a)). Therefore, the quote should contain the quoter’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

If the Contracting Officer determines that the number of quotes that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of quotes in the competitive range to the greatest number that will permit an efficient competition among the most highly rated quotes.

Evaluation factors and subfactors other than cost or price, when combined, are more important than cost or price. The factors and subfactors will be evaluated using Confidence Ratings. The confidence rating structure and definitions used for this procurement are:

High confidence. The government has high confidence that the quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with little or no government intervention.

Some confidence. The government has some confidence that the quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with some government intervention.

Low confidence. The government has low confidence that the quoter understands the requirement, proposes a sound approach, or will be successful in performing the contract even with government intervention.

Confidence ratings are a form of adjectival rating that allow evaluators to assign ratings more holistically. It is a quoter's responsibility to submit a well-written quote, with adequately detailed information, which clearly demonstrates compliance with the solicitation requirements. The quote should allow the government to determine its level of confidence in the ability of the quoter to perform the requirements of the RFQ based on an assessment of the following factors (price, technical, past performance) and subfactors (cost realism, experience, approach):

Price

Generally, price reasonableness may be determined based on adequate competition. However, in evaluating price reasonableness, the contracting officer may consider other information as necessary to establish a fair and reasonable price. This information shall be used for price evaluation purposes only.

The resultant contract will be awarded on a lump-sum basis.

— Cost Realism. Quoters are directed to FAR 2.101(b) for a definition of “cost realism,” which states:

Cost realism means that the costs in an quoter’s quote—

(1) Are realistic for the work to be performed

(2) Reflect a clear understanding of the requirements

(3) Are consistent with the various elements of the quoter’s technical quote. Vendor submissions that are either too low or too high will be deemed unreasonable or incorporating too much risk for the government to accept.

Technical Capability

— Relevant Experience. Quoters shall provide information to demonstrate a minimum of three years of relevant experience, defined as having completed HVAC maintenance projects of similar size and complexity. Information shall include points of contact, phone numbers, email addresses, contract numbers and price, project title/name, location, award, and completion dates. Points of contact must have first‐hand knowledge of the project from a contractual, managerial, and technical perspective.

An assessment of the quality of the work performed for the projects submitted as examples of relevant experience will be evaluated separately under the evaluation factor Past Performance.

— Technical Approach. Quoters shall provide a specific narrative that describes the intended technical approach to executing the work per the detailed requirements herein. The narrative must clearly and concisely describe the technical approach to management, quality control, safety, and execution. Responses restating requirements identified in the Statement of Work or elsewhere in the solicitation documents are not acceptable.

Past Performance

Past performance is a measure of the degree to which an quoter has satisfied customers in the past, and complied with federal, state, and local laws and regulations. The assessment of past performance will be subjective and based mainly on offeror reputations with customers and adherence to schedules. The Government may evaluate the performance data provided by offerors or obtained from other sources. Past performance assessments may be based on information such as the contracting officer’s and evaluator’s knowledge of previous experience with the supply or service being acquired, customer surveys, or other reasonable basis. The assessment will consider the contractor’s record of conforming to specifications, and to standards of good workmanship/customer service. In addition, adherence to contract schedules, including the administrative aspects of performance, will be taken into consideration. The currency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance shall be considered. References may be the same as those submitted to demonstrate relevant experience (if so, please specify).

For the past three years on any project the offeror was involved with, identify whether the quoter has had any of the following actions taken, and if so, explain the reasons for and the remedy/resolution of the action:

(Note: if the quoter did not have any of the following actions taken, include a statement to identify that fact in the quote for this section.)

- Terminated for default;

- Received cure notice;

- Received show cause notice;

- Assessed liquidated damages;

- Had its performance and payment bond surety notified that the contractor was not fulfilling its contract obligations.
