About this file
This document contains a justification and approval for other than full and open competition and a related federal contract opportunity notice. The USDA Agricultural Marketing Service Cotton and Tobacco Program plans to award a sole-source contract to Hewlett Packard Company for hardware, software, professional services and maintenance to upgrade thirteen Integrity 2100/2200 servers to the 2300 series. HP is the only vendor that can provide the required proprietary operating system software updates, hardware upgrades, and ongoing maintenance for these servers. The potential contract value is $1.5 million over three years.

Justification and Approval for Other Than Full and Open Competition
1. Contracting Activity:
USDA, AMS, Cotton and Tobacco Programs 3275 Appling Road Memphis, TN 38 133
2. Description of Action:
A firm fixed price contract will be awarded to Hewlett-Packard Company. The contract will be for a base year and two option periods . This contract will include hardware, software and professional services to upgrade our Integrity 2 100/2200 processors to the 2300 series.
3. Description of Supplies/Services:
This contract is for hardware, software and professional services to upgrade our Integrity 2 100/2200 processors to the 2300 series. The contract also includes hardware and software maintenance on the thirteen Integrity servers for the base year and up to two option years. The total estimated value is - for hardware, software, installation services and maintenance for the base year and up to two option years. The maintenance includes NonStop Kernel Operating System software updates/patches wh ich can only be provided from HPE.
4. Authority Cited:
FAR 6.302-1, 41 U.S.C. 253(c)(1) - Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
The Cotton and Tobacco Program has owned the HPE equipment for approximately 28 years. HPE is the only vendor capable of providing both software and hardware maintenance on the NonStop servers. We currently use the J.06.19.02 version of the NonStop Kernel Operating System. This is a proprietary Operating System that nobody else can maintain, patch and/or update.
The optional software (e.g. NonStop SQL, Pathway, Cobol85, TAL, TCP/1Pv6, etc.) is also proprietary for the NonStop server and the only vendor capable of providing maintenance is HPE. The existing 2100 and 2200 series processors are at the End of Service Life (EOSL). The Programs ' applications and databases wil l migrate to the 2300 series with few, if any, changes required. For these reasons, migration to the next generation of the NonStop 2300 series processors is in the Cotton and Tobacco Programs' best interest.
6. Efforts to Obtain Competition:
HP has stated that "The total solution outlined on these quotes contains both HW and SW components, none of them which can be sold by a third. Only HPE is able to sell these to you." HPE has agreed to give the Cotton and Tobacco Program full credit for the existing software licenses with the procurement of the 2300 series processors. No other vendors can offer the HPE processor upgrades and existing software licenses. This will allow the Cotton and Tobacco Program to realize a savings of $1,483,212.00.
7. Actions to Increase Competition:
NIA - Other than moving to a different computer platform, there is nothing we can do to increase competition.
8. Market Research:
We have conducted research online, attended trade shows and discussed maintenance with other vendors. Only HPE can provide both software and hardware support for our Non Stop servers and the hardware, software and services required for migration to the Integrity 2300 Series processors.:
9. Interested Sources:.
System Connections has contacted us in the past for maintenance of the S-Series hardware. We informed System Connections that our requirement was for both hardware and software maintenance. We were not going to split the requirement into two separate requirements. No vendors have contacted us concerning their ability to provide processor upgrade services to include hardware, software and professional services.
