The following solicitation provisions apply to this acquisition:

FAR 52.212-1, “Instructions to Offerors–Commercial Items” (MAR 2020)

FAR 52.212-2, “Evaluation – Commercial Items” (OCT 2014)

Evaluation Factors for Award

Award will be firm-fixed-price made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal, evaluated by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced Technically Acceptable (LPTA) offer.

Trade-offs between /price and non- price factors are not permitted. Unreasonably high, unbalanced, inaccurate or incomplete price proposals, may be the grounds for eliminating proposals from competition. The Government intends to make award on the basis of initial quotes, without discussions, but reserves the right to conduct discussions, if determined necessary.

Each Offeror shall respond to the criteria listed below to be considered responsive.

1.0 EVALUATION CRITERIA

Factor A: Technical Capability

Sub-factor A.1 Experience

Sub-factor A.2 Equipment

Factor A – Technical Capability. The technical factor evaluation provides an assessment of the offeror’s capability to satisfy the government’s minimum requirements. For a proposal to be determined “technically acceptable” and receive consideration for award based upon lowest price submitted, the proposal must receive a rating of “Acceptable” for each technical subfactor and “Acceptable” for past performance. The technical capability factor and each subfactor will receive one of the adjectival ratings defined below. The subfactor ratings will be used to determine an overall rating for the factor.

The award will be made to the lowest priced technically acceptable quote. Quotes will be evaluated for technical acceptability (including experience), but will not be ranked using the non-price factors (and subfactors). In order for an Offeror to be considered for award, the quote must receive an "Acceptable" rating in every non-price factor. A quote receiving a rating of “Unacceptable" in any non-price factor will not be eligible for award.

Rating Description

Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

Factor B: Cost/Price The Government’s contractor selection will be based on an integrated assessment of all of the evaluation factors, as defined in the section below.

Factor A: Technical Capability

Sub-factor A.1: Experience- The Government will evaluate contractor’s prior work experience of a similar nature, scope, complexity, and difficulty to that which will be performed under the prospective effort.

Sub-factor A.2: Equipment- The Government will evaluate contractor’s equipment that meet the requirements of the project and efficiently provide quality service.

Factor B: Cost/Price

Price will not be scored or rated. Price will be evaluated for reasonableness using one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques the government will determine whether prices are fair, reasonable, complete and balanced. Unreasonably high proposed prices may be grounds for eliminating a proposal from the competitive range.

Offeror’s cost/price proposal for realism, reasonableness, and completeness.

Realism of the proposed cost/price by assessing whether the proposed cost elements are consistent with the Offeror’s technical approaches as defined in FAR Part 15.4.

Reasonableness of the proposed cost/price using the analysis techniques defined in FAR 15.404. The

Government will also determine if the Offeror’s proposed cost, in nature and amount, do not exceed those which would be incurred by a prudent company in the conduct of competitive business. The Government reserves the right to not award this contract to a contractor whose price is unrealistic.

FAR 52.212-3, “Offerors Representations and Certifications–Commercial Items” (MAR 2020)

Offerors must complete annual representations and certifications on-line at http://beta.sam.gov in accordance with FAR 52.212-3, “Offerors Representations and Certifications–Commercial Items.” If paragraph (j) of the provision is applicable, a written submission is required.

The following contract clauses apply to this acquisition:
