This is a project manual and invitation to bid for a public works construction project issued by the Lancaster Area Sewer Authority (LASA) located in Lancaster, Pennsylvania. The work consists of the complete demolition of a 12-foot diameter steel lime silo and its associated superstructure located above the sludge loading garage at the Blue Rock Water Resource Recovery Facility in Manor Township. The silo was installed approximately 35 years ago for sludge treatment to produce Class B biosolids but is no longer needed due to the Authority's transition to anaerobic digestion and sludge drying processes. Online sealed bids are due on April 16, 2026, at 11:00 a.m. prevailing time via the PennBid Program (www.PennBid.net), with bids to be publicly opened and read aloud at that time. Site visits may be arranged by contacting Brian Wilcox at 717-344-5812. The contract term is 90 calendar days for substantial completion and 110 calendar days for final completion. The contract documents include the project manual, general and supplementary conditions, specifications, drawings, and all required bonds and insurance certifications.

Each bid must be accompanied by bid security equal to 10 percent of the total bid amount in the form of a certified check, bank check, or bid bond. The lowest responsible and responsive bidder will be required to submit actual bid security documentation within three business days after bid opening. Liquidated damages are assessed at $100 per calendar day for failure to achieve substantial completion or final completion within the specified timeframes. The contract requires full compliance with Pennsylvania Prevailing Wage Act requirements, with applicable wage rates current as of February 25, 2026, ranging from approximately $41 to $107 per hour depending on worker classification. Contractors must provide performance and payment bonds, comprehensive general liability insurance with limits of $1,000,000 per occurrence and $2,000,000 aggregate, workers' compensation insurance, commercial auto liability coverage, and umbrella liability insurance of $10,000,000. A. Owner reserves the right to reject any or all Bids, including without limitation the rights to reject any or all nonconforming, nonresponsive, unbalanced or conditional Bids and to reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make any award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by Owner. 1.19 SIGNING OF AGREEMENT

A. When Owner gives a Notice of Award to the apparent Successful Bidder, it will be accompanied by four (4) unsigned counterparts of the Agreement (each having a copy of the Bid submission attached), and four (4) each of the Payment Bond, and Performance Bond. Within 15 days thereafter, apparent Successful Bidder shall sign and deliver to the Owner the four (4) signed counterparts of the Agreement accompanied by the four (4) executed counterparts of the performance and payment bonds (with a power-of-attorney certificate attached to each) and four (4) originals of the required insurance certificate(s).

B. If the Owner finds the documents submitted by the apparent Successful Bidder acceptable, it will, within ten days after receipt of such documents, complete the signing of the Agreement and submit two fully executed copies to the Contractor.

C. If the Owner elects to issue a Notice to Proceed, such notice will accompany the fully executed copies of the Agreement. If no Notice to Proceed is issued, the Contract Time will commence to run as specified in Paragraph 4.1 of the General Conditions, as amended by Supplementary Conditions Paragraph SC-4.01.

1.20 PRE-BID MEETING

They also recognize the delays, expense and difficulties involved in proving the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty) Contractor shall pay Owner $100.00 for each calendar day that expires after the time specified in Paragraph 2.1 above for Substantial Completion until that Work is substantially complete. After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the time specified in Paragraph 2.1 above for completion and readiness for final payment or any proper extension thereof granted by Owner, Contractor shall pay Owner $100.00 for each calendar day that expires after the time specified in Paragraph 2.1 above for completion and readiness for final payment. 3.2.2 After the Work is 50% completed, subsequent approved Applications for Payment shall be paid by Owner subject to withholding by Owner of five percent of each such approved Application for Payment so that the total amount withheld from Contractor shall not exceed five percent of the value of completed Work based on approved Applications for Payment.

3.2.3 In the event that a dispute arises between Owner and the Contractor, which dispute is based on increased costs incurred by one contractor occasioned by delays or other actions of another contractor, additional retainage in the sum of one and one-half times the amount of any possible liability may be withheld by the Owner from the Contractor until such times as a final resolution is agreed to by all parties directly or indirectly involved, unless the contractor causing the additional claim furnishes a Bond satisfactory to Owner to indemnify Owner against the claim.
