About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's request for qualifications (RFSQ) for a Firearms and Toolmark Examination Training Program. The RFSQ, issued by the Utah Bureau of Forensic Services (UBFS), seeks statements of qualifications from companies to provide professional services for a Design Professional Service Provider and Consultant contract. The contract term is five years, and the award will be made to the highest-ranked vendor selected through the Utah Procurement Code 63G-6a Part 15 process. Vendors are explicitly instructed not to include pricing information in their qualifications submissions.
The Business Confidentiality Claim form allows vendors submitting qualifications to protect trade secrets and commercial financial information under Utah Code 63G-2-305 by making a formal confidentiality claim with supporting documentation. Vendors must submit both redacted and non-redacted versions of their proposals; the Division of Purchasing will not perform redactions on behalf of vendors. The form requires claimants to provide company information, identify specific pages and paragraphs subject to confidentiality protection, and submit a concise statement of reasons justifying the claim. The confidentiality claim does not guarantee protected classification if the government receives a public records request under GRAMA (Government Records Access and Management Act), but it establishes the vendor's intent to protect specified proprietary information during the procurement process.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
