XXVI. REQUIREMENTS FOR THE STATEMENT OF QUALIFICATIONS

A. The Statement of Qualifications must be submitted with the proposal and include the information as described in this section of the Proposal and Contract Documents.

Failure to submit the required information in the Statement of Qualifications may result in the Owner considering the proposal non-responsive and result in rejection of the proposal by the Owner. Offerors may be required to provide supplemental information if requested by the Owner to clarify, enhance, or supplement the information provided in the Statement of Qualifications.

B. Offerors must provide the information in the Statement of Qualifications using the forms following this Section. The information requested in these forms must be completely provided in the level of detail requested by the form. The information in these forms will be used to make direct comparisons with the information provided by other Offerors. Failure to include all of the information may result in lower scores in the evaluations. Any information that cannot be completed on the form may be provided by including additional pays to the form. Any additional pages added to any forms must be sufficiently identified so that the Owner may tell exactly which forms are supplemented by the additional pages. It is the Offerors’ obligation to also identify on each additional page, the question(s) or item(s) from each form for which an answer is being supplemented. Failure on the part of the Offeror to adequately identify the additional or supplemental pages may result in the Owner rejecting the additional information.

XXVII. EVALUATION, RANKING, AND AWARD

A. Evaluation Criteria

1. The Owner will consider all of the qualifications of the Offerors, in addition to the proposed contract amount and Offeror’s narrative approach to construction when evaluating the submitted proposals to determine which proposal offers the best value to the Owner, per Chapter 2269 of the Texas Government Code, Subchapter D. The proposals will be evaluated using the following criteria:

Evaluation Category Description Points

A-1 Offeror’s Narrative Approach to Construction 20 A-2 Contractor and Subcontractor Qualifications 20 A-3 Proposal Price 40 A-4 Proposed Schedule/Time Completion 20

Total: 100

2. The Owner reserves the right to reject any proposal containing a schedule determined by the Owner to be unrealistic, inadequately supported, inconsistent with industry standards, or otherwise infeasible for successful completion of the Project.

3. The successful Offeror’s proposed milestone dates and completion dates shall become contractual obligations incorporated into the Contract Documents.

4. The Owners reserves the right to request clarifications, supplemental schedule information, manpower loading information, procurement schedules, subcontractor commitments, and critical path schedule narratives from any Offeror.

5. A-1 OFFEROR’S NARRATIVE APPROACH TO CONSTRUCTION: The Offeror shall submit no more than a two (2) page narrative on their approach toward completing the proposed work according to the Contract Documents. The approach by the Offeror shall be evaluated for completeness, and ability to demonstrate knowledge of the overall work required. Each evaluator assigns or deducts points based upon completeness of the responses. A more complete detailed submission will earn additional points. A scarce narrative will cause a deduction in points. A maximum of twenty (20) points is allowable for this category.

The Narrative Approach shall include, but not limited to, the following items:

• Project management plan- include daily oversight approach

• Proposed Project Timeline (calendar days), sequencing, and scheduling logic

• Identify long lead times or supply chain concerns

• Approach to coordination with subcontractors and suppliers

6. A-2 CONTRACTOR AND SUBCONTRACTOR QUALIFICATIONS: When evaluating an Offeror’s qualifications, the Owner will utilize the “Statement of Offeror’s Qualifications and Experience” and “Safety Record Questionnaire & Statement of Offeror’s Safety Experience” of this section of the bidding documents. The “Statement of Offeror’s Qualifications & Experience” shall also include the “Statement of Subcontractor’s Qualifications & Experience”.

The Offeror’s proposed key personnel shall be attached/provided along with brief resumes for key personnel showing similar work experience. All of these parts will be utilized to judge qualification. This criterion will be subjectively evaluated, up to a maximum of twenty (20) points. Each evaluator assigns points based upon completeness of the responses the Offeror provides in the “Statement of Offeror’s Qualifications and Experience”. A reference check will be performed by contacting project owners and/or engineers for projects of similar type of work included in the “Statement of Offeror’s Qualifications and Experience”. Any additional narrative, if provided, shall not exceed one (1) page.

7. A-3 PROPOSAL PRICE: The quality of the Offerors is not judged solely by a low price or conversely, eliminated solely because of a high price. The following is the formula used when determining price as a factor for construction contract proposals. The lowest price of all the proposals becomes the standard by which all prices are evaluated. One at a time, each proposal is evaluated by taking the lowest Base Bid Proposal price and dividing it by the price of the proposal being evaluated. That fraction is then multiplied by the maximum point value for the price score. For example: (Lowest Price/Current Proposal Price) x Maximum Point Value = Price score, with a maximum of forty (40) points allowable for this category.

8. A-4 PROPOSED SCHEDULE/ TIME TO COMPLETION: The Owner has established anticipated milestone and completion dates for the Project. Offerors may propose earlier milestone dates and completion dates.

• Offerors shall submit:

1. Preliminary CPM (Critical Path Method) schedule;

2. Critical path narrative;

3. Manpower histogram;

4. Procurement schedule for long-lead items;

5. Proposed milestone dates;

6. Proposed Substantial Completion date;

7. Proposed Final Completion date;

8. Assumptions log;

9. Planned overtime or shift work assumptions

• Schedule proposals shall be evaluated for:

1. Overall duration;

2. Feasibility;

3. Adequacy of manpower loading;

4. Procurement realism;

5. Critical path logic;

6. Demonstrated understanding of project sequencing;

7. Ability to achieve operational readiness for the Project.

• The Offeror proposing the shortest acceptable contract duration shall receive the maximum available points for the Schedule criterion.

• Other Offerors shall receive proportionally reduced scores calculated as follows:

(Shortest Proposed Duration ÷ Offeror’s Proposed Duration) × Maximum Schedule Points

• For purposes of evaluation, the Owner may establish a minimum acceptable duration and a maximum recognized acceleration duration.

• Schedules determined by the Owner to be unrealistic, inadequately supported, or inconsistent with industry standards may be rejected, adjusted for scoring purposes, or deemed non-responsive.

• A maximum of twenty (20) points is allowable for this category.

B. Ranking of Offerors

1. The Owner will consider the qualifications of the Offerors, subcontractors, and licensed subcontractors, in addition to the proposed Project Approach, Proposal price, and Safety Record, as set forth in the evaluation criteria above. The Owner reserves the right to waive any irregularities in determining the firm’s qualifications and reserves the right to require the submission of additional information.

2. The qualifications of an Offeror shall not deprive the Owner of the right to accept a proposal, which in its judgment offers the best value to the Owner, reject any and all proposals, to waive irregularities in proposals, or to reject nonconforming, non-responsive, or conditional proposals. In addition, the Owner reserves the right to reject any proposal where circumstances and developments have in the opinion of the Owner changed the qualifications or responsibility of the Offeror.

3. Material misstatements in the material submitted for evaluation may be grounds for rejection of an Offeror’s proposal. Any such misstatement, if discovered after award of the contract to such Offeror, may be grounds for immediate termination of the contract. Additionally, the Offeror will be liable for the Owner for any additional costs or damages to the Owner resulting from such misstatements, including costs and attorney’s fees for collecting such costs and damages.

4. The Owner shall evaluate and rank each proposal as established herein above and in accordance with state law. The Owner shall establish review panel of not less than three (3) individuals which shall include at least two (2) representatives of the Owner and one (1) representative of the Engineer. The panel shall independently evaluate and rank each proposal using the above criteria.

C. Evaluation and Award Schedule

At the time and date indicated in the Advertisement for Competitive Sealed Proposals, the proposals will be opened, and the total proposal prices will be read aloud. The Owner will have up to forty-five (45) days to evaluate and rank the proposals and determine which proposal provides the best value to the Owner. The Owner will attempt to negotiate and enter into a contract with the Offeror who has offered the best value to the Owner.

XXVIII. PROJECT RIGHT OF WAY CLEARANCE TIMELINE

The City is in the process of acquiring certain right-of-way interests required for construction of the Project. In addition, multiple franchise utility companies are performing relocations associated with the Project improvements. The following sections identify areas where right-of-way acquisition and/or franchise utility relocations remain incomplete as of the date of advertisement.

The Contractor may mobilize and perform Work in all areas available to the Contractor;

however, the Contractor shall not perform Work within any area identified as unavailable due to pending right-of-way acquisition or utility relocation activities until such area has been released by the Owner for construction. The Contractor shall coordinate its operations and sequencing of Work to accommodate these right-of-way acquisition and utility relocation activities. Availability of individual work areas may occur on a phased basis throughout the Project.

The Contractor acknowledges that access to certain portions of the Project may be provided on a phased basis and that the timing of right-of-way acquisition and utility relocation activities may change from the dates anticipated at the time of bidding. The Owner will provide written notification when restricted areas become available for construction activities.
