About this vehicle
The North Dakota Commercial Food Products state-wide contract (SC 053) provides a comprehensive procurement vehicle for food products serving multiple state agencies, including the Department of Corrections and Rehabilitation, State Hospital, James River Correctional Facility, Life Skills & Transition Center, and Veterans Nursing Home. The contract enables purchasing of a wide range of commercial food items such as bakery ingredients, beverages, canned goods, dairy, frozen foods, fresh produce, and specialty meats, with a focus on meeting USDA and U.S. Department of Education nutritional and safety standards. Designed as a cooperative purchasing agreement, the vehicle allows participation from state institutions, government entities, counties, cities, educational institutions, nonprofit organizations, tribal agencies, and other public sector organizations.
The contract was awarded to multiple prime contractors, specifically US Foods, Inc. and Cash-Wa Distributing Co., with an initial contract period from January 1, 2021, to December 31, 2025. The state-wide vehicle covers all of North Dakota and is structured as a cost-plus fixed markup contract, with vendors providing web-based ordering systems and the ability to supply additional products through a Mark-Up Product List. The contract includes options for price adjustments after an initial 30-day firm pricing period and requires vendors to maintain comprehensive product information, handle product substitutions, and comply with specific delivery requirements. While specific total contract value is not explicitly stated, the market basket pricing responses from US Foods and Cash-Wa indicate substantial potential spend across state institutions.
Description

The Vendors are expected to continually apprise the State of opportunities to reduce cost and maintain high standards commercial food quality.
