About this program

The Department of Labor Veterans Employment and Training Service administers the Uniformed Services Employment and Reemployment Rights program (CFDA 17.803) to protect and facilitate reemployment of uniformed services members, including National Guard and Reserves, following qualifying service, and to prohibit employment discrimination and reprisal based on service obligation or participation in related proceedings.

This program does not disburse grants to recipients. Instead, it operates as a federal enforcement and assistance mechanism. The Department of Labor-VETS investigates complaints filed by service members regarding employment rights violations and works toward voluntary resolution between claimants and employers. Unresolved complaints are referred to the Department of Justice or the Office of Special Counsel for potential representation in Federal District courts or before the Merit Systems Protection Board. The program also provides information and assistance to employers, labor organizations, and community stakeholders regarding veterans' employment and reemployment obligations.

Eligible claimants are persons who have performed voluntary or involuntary service in the uniformed services, including active duty, active duty for training, initial active duty for training, inactive duty training, full-time National Guard duty, the period absent from employment while being examined for fitness, and specified duty or training by intermittent appointees of the National Disaster Medical System. Entitlement terminates upon separation with a bad conduct or dishonorable discharge, or separation under other than honorable conditions, a dismissal, or dropping from the rolls pursuant to sections 1161(a) and 1161(b) of Title 10, U.S. Code. Claimants must conform to all statutory eligibility requirements, including proper notification, statement of intent, and timely action. Applicants should provide evidence of pre-service employment, proper notification of service, length and character of service, and proper request for reinstatement.

Assistance is available through the nearest Department of Labor-VETS office, with contact information available through the Catalog's Appendix IV. Private right of action is authorized; service members may file claims directly or seek assistance regarding alleged violations through the regional VETS office network.
