About this program

The Department of the Army, through the Corps of Engineers, provides funding for navigation infrastructure projects not specifically authorized by Congress through CFDA 12.107, with the most recent award activity dating to the portfolio snapshot period. The program finances the design and construction of general navigation improvements determined to be engineering feasible, complete within themselves, and economically justified, subject to a federal cost limit of $4 million per project and a 50-year lifecycle cost cap of the greater of $4.5 million or 2.25 times the federal construction cost, discounted at the current water project discount rate.

Eligible recipients are states, political subdivisions of states, or other responsible local agencies established under state law with full legal authority and financial capacity to undertake the required legal and financial responsibilities. Prospective sponsors must submit a formal letter to the relevant District Engineer indicating clear intent to provide all required local participation, supply evidence of legal authorization and financial capability, and secure Division Engineer approval based on a comprehensive investigation and report by the District Engineer. Construction and award of contracts are subject to availability of funds from the Chief of Engineers.

The nonfederal sponsoring agency bears responsibility for all project costs exceeding the federal contribution, equally shares the cost of feasibility studies with the federal government, contributes toward construction and maintenance costs in proportion to recreational benefits, land enhancement benefits, or other special local benefits, furnishes all necessary lands, easements, and rights-of-way, and provides adequate public landing facilities, wharves, piers, access roads, parking areas, and other public amenities open to all on equal terms. The sponsor must hold and save the United States free from damages. Local cost participation requirements follow procedures similar to those for congressionally authorized navigation projects. The Corps of Engineers designs and constructs each approved project. Detailed program rules appear in Engineer Regulation 1105-2-10, Appendix E (33 CFR 263), with information sheets available from the District Engineer.

Corps of Engineers designs and constructs the project. Each project selected must be engineering feasible, complete within itself, and economically justified. The nonfederal sponsoring agency must agree to assume full responsibility for all project costs in excess of the Federal cost limit of $4,000,000; equally share with the Federal government the cost of feasibility studies; contribute toward project costs for construction and maintenance in view of recreational benefits, land enhancement benefits or other special local benefits; provide all necessary lands, easements, rights-of-way; hold and save the United States free from damages; and, provide adequate public landing or wharf, piers, access roads, parking areas and other needed public facilities open and available to all on equal terms. Local cost participation requirements and procedures for determining the local share of project cost are similar to those for navigation projects specifically authorized by Congress under regular authorization procedures. No project is to be recommended for implementation under the Section 107 authority for which the total constant dollar Federal costs over 50 years exceed the greater of $4,500,000 or 2.25 times the Federal construction cost, both discounted at the current water project discount rate.
