About this opportunity
Virginia's Office of the Attorney General is soliciting proposals from law firms to defend medical malpractice claims on behalf of the OAG and participating state agencies, local constitutional officers, and local governments, with proposals due October 12, 2026.
The scope spans representation and defense of medical malpractice litigation arising under three distinct risk management plans: the Constitutional Officer and Regional Jail Risk Management Plan (VaRISK), the Virginia Liability Risk Management Plan (VaRISK 2), and the Commonwealth of Virginia Public Liability Risk Management Plan. Under VaRISK and VaRISK 2, the Division of Risk Management investigates claims, determines the need for counsel, and assigns firms to handle all case defense aspects, including appeals where DRM determines appeal is warranted. Under the Public Liability Risk Management Plan, the OAG makes the assignment decision and determines appeal authorization; counsel must coordinate with DRM. Counsel responsibilities include all litigation aspects from initial defense through appeal in each assigned matter.
Firms must submit proposals through the online portal at app.rfpio.com/survey/public/6809043e9cd2cc30c5ab6603_6a7bbbf85de70837068091d1/SFP-2026-08-DRM-Medical-Malpractice. Submissions sent via email or other channels will not be considered. The procurement is governed by Virginia Code § 2.2-510 and §§ 2.2-1832 et seq.
The jurisdictions of performance include Richmond City and Roanoke City, reflecting the geographic scope of plan participants.
